HomeMy WebLinkAboutORDINANCE 1061-19853 Suggested by: Administration CITY OF XENAI ORDINANCE NO. 1061-85 AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, AMENDING THE KENAI ZONING CODE SECTION 14.20.020(a)(5) INTERIOR LOT LINES. WHEREAS, the Kenai Zoning Code now does riot allow a building to atraddle an interior lot line when both lots are under the same ownership, and WHEREAS, this has proved to be too regtrfctive, and WHEREAS, the Kenai Advisory Planning, & Zoning Commission has conducted the required public hearing on June 12, 1985 and received favoring testimony, and WHEREAS, the Commission approved Resolution PZ85-34 and recommend approval to the Council. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, that Section 14.20.020(a)(5) be amended as follouls: Section 1: "Every building hereafter erected shall be located on a lot as herein defined, except that, if two or more contiguous lots are under the same ownership, a building may straddle the interior lot line or lines provided that no interior partition of the building falls on a lot line so that such portion could be sold separately from the remainder of the building. This would not preclude the sale of property as condominiums or townhouses pruvided they are built as such." PASSED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, this 3rd day of July, 1985.
