HomeMy WebLinkAboutORDINANCE 1062-19856 Suggested by: Administration CITY OF KENAI ORDINANCE NO. 1062-85 AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, AMENDING THE OFFICIAL KENAI ZONING MAP BY REZONING GOVERNMENT LOT 8, SECTION 33, T6N' R11W S.M. TO SUBURBAN RESIDENTIAL (RS). WHEREAS, KMC 14.20.270 establishes e. procedure to amend the Official Zoning Nap of the City of Kenai, and WHEREAS, the rezoning petition was initiated by George M. Tarlas to rezone Government Lot 8, Section 33, T6N, Rl1W, S.M. from Rural Residential One (RR-1) to Suburban Residential (RS) District, and WHFRSAS, the Kenai Advisory Planning & Zoning Commission has conducted the required public hearing on June 12, 1985, and received testimony both favoring and opposing the request, and WHEREAS, the Commission recommended denial of the rezoning petition and defeated Resolution PZ85-52, and WHEREAS, the Commission found that the rezoning request constituted spot zoning and was not consistent with the new rezoning to RR-1 for this area. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, that the Official Zoning Map of the City of Kenai shall be amended as follows: Section 1: Subject property consisting of Government Lot 8, Section 33, T6N, R11W, S.M. is her6by rezoned to Suburban Residential (RS) District. Two persons, representing adjacent homeowners came forward to voice objection to the rezoning and presented photos of the area. The Commission failed the rezoning unanimously tossed on two major factors, 1) it would clearly be spot zoning, 2) that an RS designation would be too high in density and would be too high an impact on the neighborhood. A third factor was the fact that the adjoining residents had, in fact, voiced opposition.
