HomeMy WebLinkAboutORDINANCE 0932-1984Suggested by: Administrat ion CITY OF KENAI ORDINANCE NO. 932-84 AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, REVISING KMC CH4PTER 21.10, LEASING OF AIRPORT LANDS, By AMENDING KMC 21.10.060(c) AND ADDING A NEW SECTION KMC 21.10.140. WHEREAS, KMC Title 21 governs the leasing of municipally -owned lands within the City of Kenai, and WHEREAS, the effective period for a lease application is currently authorized for six monthu , and WHEREAS, the Code does not require the execution of a lease agreement; upon approval by Council, within a specified period of time, and WHEREAS, these existing leasing procedures encourage City property to be secured for a period of up to six months without an executed lease agreement, and WHEREAS, the City of Kenai does not receive any rental payments nor can devPlopmeni be required during this period, and WHEREAS, certain code revisions are recommended for the expeditious proceeding and consummation of lease agreements to the benefit of the City. -_ NOW, THEREFORE, 9E II ORDAINED BY THE COUNCIL OF THE CITY OF `I3Z KENAI, ALASKA, as follows: Ile Section 1: KMC 21.10.060(c) is hereby amended to read as follows: (c) Conceptual applications relative to unplatted land and/or unrRlwaaPd lands will also be considered on a first -come, first -served basis under the sarsie conditions set forth above. On approval of concept by the Advisory Planning and Zoning Commission and the City Council, the applicant is assured the riyht of first refusal of the lease following the determination of the lease rate in accordance with established policy[.
