SuggeQted by: Planning & Zoning Commission CITY OF KENAI ORDINANCE NO. 981-84 AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, AMENDING KMC 14.20.150 AND KMC 14.20.180 TO PROVIDE FOR AN EFFECTIVE PERIOD FOR CONDITIONAL USE AND VARIANCE PERMITS. WHEREAS, the Kenai Zoning Code authorizes the Kenai Advisory Planning and Zoning Commission to grant conditional use and variance permits under specified conditions, and WHEREAS, the Code does not restrict the length of time for which a permit is valid, and WHEREAS, the compatibility of the proposed activity with the surrounding properties is an important issue in the consideration of granting a permit, and WHEREAS, neighborhood conditions are continually subject to change, and WHEREAS, the Commission has deemed it desirable to establish a twelve-month validity period with an optional six-month extension term, and WHEREAS, the Commission specified that this provision should not apply to townhouse and planned unit residential development projects which are normally multi -phased activities, and WHEREAS, the Kenai Advisory Planning and Zoning Commission has conducted the required public hearing on September 26, 1984, and WHEREAS, the Commission recommended approval of this amendment to the Kenai Zoning Code at their meeting on September 26, 1984. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, as follows: Section 1: That KMC 14.20.150 shall be amended by adding a new subsection as follows: 14.20.150 (c) (3) An approved conditional use ermit shall lapse twelve M-27—m-o-n—tTis from the date of aperoval ir no certificate of ocrupancv has been issuedby the Ui73in OrFicial.
