CITY OF KENAI
ORDINANCE NO. 994-84
AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA,
REVISING KMC CHAPTER 22.05, DISPOSITION OF CITY LANDS, TO
ESTABLISH REQUIREMENTS GOVERNING THE SALE CLOSING PROCEDURES OF
CITY LANDS.
WHEREAS, KMC Chapter 22.05 governs the disposition of city -owned
lands, and
WHEREAS, the Code does not currently require the execution by the
purchaser of a binding sale agreejnent, and
WHEREAS, a land sale closing can now be accomplished beyond six
months of the date of the appraisal, and
WHEREAS, it is in the best interest of the City to require the
lend sale closing within the six month period, and
WHEREAS, it is further desirable that the appropriate interest be
paid upon closing if not accomplished within the valid appraisal
period.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
KENAI, ALASKA, au follows:
Section 1: That KMC 22.05.030(b) is repealed and re -acted
as fol ows..
(b) Sales of land pursuant to sub -section (a) above
shall be made at not less than fair market value. The
- purchaser shall execute the "Agreement For Sale of Land"
within six months of the date of appraisal. The City
Manager has the option to dispose of such properties in
accordance with the sale procedures set out in this Title:
(1) By negotiated sale, or
i (2) By outcry auction to the highest responsible
bidder. or
(3) By competitive sealed bids to the highest
responsible bidder.

In the event that the sale is not closed within six months
of the date of appraisal, the buyer will be charged, upon
closing, interest computed in accordance with the
applicable provisions of the Kenai Municipal Cude, based
upon the total sales price for the number of days past the
expiration of the six month period.
Section 2: KMC 22.O5.O40(a) is amended as follows:
(a) [IF THE LAND TO BE SOLD HAS NOT BEEN APPRAISED BY
A QUALIFIED APPRAISER WITHIN SIX MONTHS OF APPLICATION FOR
SALE OF THE DATE OF THE OFFER OR ADVERTISEMENT OF LAND FOR
SALE (WHICHâ–º:VER FIRST OCCURS), THEN] The City Manager will
obtain such an appraisal for a determination of the minimum
price on said land.
Section 3: KMC 22.05.40(c) is amended as follows:

(c) If the tract of land proposed to be sold is
leased land upon w:,ich substantial improvements have been
made the lessee may
, at his request, negotiate the sale of
said land at not less than the fair market value. i3ET BY
