HomeMy WebLinkAboutORDINANCE 0639-1981CITY OF KENAI ORDINANCE NO. 6 39 -81 AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, AMENDING KMC 23.25.060(b), KMC 23.30.050(b), AND KMC 23.40.020(c) TO CLARIFY AND EQUALIZE ORDINANCE PROVISIONS FOR RATES OF PAY FOR OVERTIME IN VARIOUS CATEGORIES, HOURS OF WORK, AND PAYMENT FOR HOLIDAYS FOR SHIFT EMPLOYEES, WHEREAS, the current ordinances for overtime pay for various classifications of employees, rates of pay for overtime on various days, and treatment of holidays are unnecessarily confusing and difficult to interpret, and in some instances seem to lead to lack of equal treatment between various classifications of employees, and WHEREAS, because employees of the City are engaged in various types of shift work that make equalization of pay and benefits difficult, and WHEREAS, it is felt desirable to clarify the intent of the ordinances and to make treatment of various classifications of employees as equal as possible, NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, as f ollowss section is KMC 23.25.060(b) is hereby repealed and re-enacted to read as follows$ "(b) When employees are required to work overtime, department heads shall authorize compensatory time off or overtime pay. Determination to grant overtime pay or compensatory time off shall rest with the department head, City Manager, or acting department heads, who shall give due consideration to desires of the employee, to budgetary controls and to the provisions of Subsection (c) of this section. Rates for overtime (in addition to regular compensation based upon salary schedules) shall bes (1) General Government (excluding Sewer Treatment Plant)s Regular Workday (for hours in excess of 8) 1 Saturday 1 Sunday 2 Holiday 2h (2) General Government employees must be in a paid status for 40 hours in the work week before overtime may be paid. (3) Public Safety and Sewer Treatment Plants Regular workday (for hours in excess of regular shift) lh Saturday (See KMC 23.30,050 (b) and (c) ) lit Sunday (See KMC 23.30.050 (b) and (c)) 2 Holiday (See KMC 23.40.020(c) for treatment) (4) Before overtime may be paid, Public Safety and Ewer Treatment Plant employees must be in a paid status for their normal work week, as follows: Police 40 hours Fire 56 hours Communications 42 hours Jail 42 hours Sewer Treatment Plant 40 hours" Sec_ tien 2s KMC 23.30.050(b) is hereby amended as follows% "(b) Public Safety employees', not including administrators, normal work week is: (1) Police - 4 shifts of 10 hours per week, 2080 hours annually, when working this shift, 1st and 3rd days off shall be treated as Saturdays and the middle day off (the 2nd day) shall be treated as a Sunday for purposes of paying overtimes (2) Fire - 24 hours on, 24 hours off for 6 day cycle, then 3 days off --equivalent of 56 hours per week, 2912 hours annually, when working this shifts lot and 3rd davit of the (3 Communications and Jail - 12 hours on, for 3 days; off for 3 days --equivalent of 42 hours per week, 2184 hours 2 a , a. annually. overtimes" - section 3s KMC 23.40.020(c) is hereby amended to reads "(c) Public Safety and Sewer Treatment plant employees shall receive in December [PRO RATA AN ANNUAL] payment at 1h times their norm 1 hourlv_nav [EACH DECEMBER) for authorized holidays y.wU as follows: Firefighters (56 hour week), 11.2 hours pay per holiday Police (40 hour week), 8 hours pay per holidal Jail and Dispatchers (42 hour week), 8.4 hours pay per holiday Holidays which occur during vacation shall be charged against such leave."
