Street Address: 105 Haida Drive KPB Parcel No.: 04715022 Existing Zoning: RS -Suburban Residential Current Land Use: Residential Land Use Plan: Neighborhood Residential ANALYSIS General Information: Applicant is requesting a 15-foot rear setback variance to construct a 16 X 10 square foot shed. The 5-foot side setback is met. The applicant advised that this shed is approximately 10.5' high. A 20-foot rear setback is required in the zone. Applicant has noted that to comply with the 20-foot rear setback the shed would be in the middle of his back yard. Attached is a site plan of the property showing the proposed location of the shed. KMC 14.20.180 details the intent and application process for Variance Permits. The Code also outlines the review criteria that should be used by the Planning and Zoning Commission to determine if a variance should be granted. The Commission shall establish a finding that all of the following conditions exist as a prerequisite to issuance of a variance permit: Special conditions or circumstances are present which are peculiar to the land or structures involved which are not applicable to other lands or structures in the same zoning district. This parcel is zoned RS -Suburban Residential. According to the Kenai Peninsula Borough's records, the parcel is .26 acres, approximately 11,325 square feet. In the City of Kenai in the Suburban Residential zone, lots vary in size. The minimum size allowed in the zone is 7'200 square feet. This is a developed parcel. Possibly planning prior to the construction of the residence could have provided alternative 0831 Conunent.doc Paga 2 options for location of a shed. Because this planning did not occur, working within fhe constrainfs of the rear yard provides special circumstances for Phis particular parcel. • The special conditions or circumstances have not been caused by actions of the applicant and such conditions and circumstances do not merely constitute a pecuniary hardship or inconvenience. The applicant did not develop this subdivision and inherited the development constraints with fhe purchase of the residence. The rear sefback requirement limits development options. • The granting of the variance shall not authorize a use that is not a permitted principal use in the zoning district in which the property is located. Sheds are accessory structures and permifted within the zone. • The granting of a variance shall be the minimum variance that will provide for the reasonable use of the land andlor structure. A 95-foot variance cart be viewed as excessive; however, allowing an accessory structure to be built 5- feet from fhe rear !of line does not appear unreasonable and appears reasonable in light of fhe available rear yard. The side lof, as shown on the asbuilt, is 923.13'. From the rear of the house to the rear lof line, (here are approximately 52 feet remaining. Reducing Phis area wifh the required 20- foot rear sefback leaves 30 feet far the rear yard. Using these measurements, the request appears reasonable and minimum. • The granting of a variance shall not be based upon other non-conforming land uses or structures within the same land use or zoning district. The request is not based on ofherhon-conforming uses or structures. Public Works Director: concur with the recommendation. Building Official: Not available to comment. RECOMMENDATIONS The applicant is requesting a 15-foot variance to build a single story, 160-square foot, shed in the rear setback. Structures 120 square feet or less may be built within three- feet of the side or rear lot line. Requiring the shed to meet the rear setback would drastically reduce the usable rear yard and as noted in the application, "The shed will end up in the middle of my back yard." The Commission recently discussed the 20-foot rear setback for accessory structures and amendments to the code requirement were considered. The proposed variance meets the guidelines in the Commission's recently recommended ordinance. With the development constraints on this lot, granting the requested variance appears reasonable. The code also specifies the review criteria that must be satisfied prior to issuing the permit. The criteria are: 1. The use is consistent with the purpose of this chapter and the purposes and intent of the zoning district; 2. The value of the adjoining property and neighborhood will not be significantly impaired; 3. The proposed use is in harmony with the Comprehensive Plan; 4. Public services and facilities are adequate to serve the proposed use; 5. The proposed use will not be harmful to the public safety, health or welfare; 6. Any and all specific conditions deemed necessary by the commission to fulfill the above-mentioned conditions should be met by the applicant. These may include, but are not limited to measures relative 0$32 Comment Page 2 to access, screening, site development, building design, operation of the use and other similar aspects related to the proposed use. The City contacted the applicant after receiving a complaint of lawn supplies being stored in the City's right-af--way. Mr. Woodcock was unaware a conditional use permit was required to operate his lawn business from his home and immediately applied for a permit. Twice a year pallets of seed, fertilizer, and mulch are placed at the entrance of applicant`s empty lot. The applicant then relocates them onto his lot for storage. The applicant has been operating his lawn business from the above-referenced locations for the past 6-years. The Commission approved a Home Occupation permit to operate a daycare from this location in 2001. The City has received no complaints until this incident. Mr. Woodcock has a business license and is registered with the Kenai Peninsula Borough for sales tax. On-site activities will involve using phone, fax, and delivery service and loading and unloading of his lawn care equipment. The business will have minimal traffic impact to the area as it is anticipated that deliveries are made twice a year. City Engineer: I concur with the recommendation for the reason stated. Building Official: Not available for comment. RECOMMENDATIONS Because the business as is presently operated minimally affects the surrounding property owners, recommend approval with the following requirements: 1. WHEREAS, KMC 1.85.060 (Conflicts of interest prohibited) currently regulates conduct of elected and appointed officials and city employees; and WHEREAS, properly functioning municipal government requires ethical behavior by public officials and employees; and WHEREAS, reasonable standards of conduct are needed for elected and appointed public officials and city employees in order to maintain the public's trust in municipal government; and WHEREAS, the current conflict of interest rules need to be replaced by a more comprehensive set of guidelines for council and commission members and city employees; and WHEREAS, it is in the best interest of the City of Kenai to amend KMC 1.85.060 and .070. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA that KMC 1.85.060 and .070 is amended as follows: 1.85.060 Conflicts of interest prohibited. (a) A municipal officer, appointed commission member, or employee of the City of Kenai may not solicit or receive money for advice or assistance given in the course of their official duties for the City of Kenai. (b) A municipal officer, appointed commission mexr~ber, or employee of the City of Kenai may not represent a client before the City Council for a fee. However, a commission member ma re resent a client before a commission or the Cit Council for a fee if it does not involve a matter that is/was before the member's cornrnission. (c) A municipal officer, appointed cornrnission member, or employee of the City of Kenai may not accept a gift, Ioan, gratuity, or other valuable consideration, or a promise of any of them, with the understanding or agreement, expressed or implied, that he/she will cast a vote or given an opinion, decision, or judgment in a particular manner, in a matter, question, cause, or proceeding which then is or may by law come or be brought before him, or with the understanding or agreement that the officer or Ordinance No. 2319-2008 Page 2 of 4 employee will, in his/her official capacity, act in a particular manner to produce or prevent a particular result. (d) No Council or Commission Member may vote on any question in which he she has a substantial direct or indirect financial [PECUNIARY] interest. Direct or indirect financial [PECUNIARY] interests shall be disclosed to the presiding officer prior to a vote on the question anal the presiding officer shall determine whether the financial interest exists and whether the prohibition from voting is applicable. (a) "Municipal Officer" means the Mayor, City Manager, Members of Council, City Attorney and City Clerk. (bJ "Source of Income" means an employer, other person, ar entity paying compensation, dividends, or interest, directly or indirectly, for services, products, or investments. If the income being reported is derived from employment by a sole proprietorship, partnership, or corporation in which the reporting person, spouse, or children, or a combination of them hold a controlling interest, that proprietorship, partnership, or corporation may be designated as the source of income without specifying clients or customers if the business is one that is normally conducted on a cash basis and typically does not keep records of individual customers. The addition requires a review as defined in KMC 14.25.020. This is an established site, so a full landscapelsite plan is not required. A site visit was conducted on May 2, 2008 with the applicant. Based on that visit and a review of the existing site, a site plan was submitted showing the existing and proposed building, driveway, parking lot, snow storage, and planned landscaping. This proposed addition also required an asbuilt to insure the addition does not encroach into the 100-foo# building restriction line along the airport apron. A plat is being processed to vacate the lot fine and two 10-foot utility easements. This plat will eliminate a non-conforming building and allow for the expansion (the existing building straddles the lot line and is built over the easements}. The parking requirements were reviewed. Using the floor plans for the existing and proposed building, the site requires 24 spaces. There is a paved parking lot along the front of the building facing North Willow Street. In addition, there is parking available for employees and service vehicles located behind the security fence on both sides of the building. Additional paving will not be required. It was agreed that the area between the driveways, parking lot, and North Willow Street would be landscaped. The plan is to gravel the area, place a 12' X 12' timber treated box for landscaping. One chokecherry tree will be planted. Two spruce trees will be retained. The area along the sides of the paved parking area to the security fence will be 0830 Comment.doc Page 2 graveled. It is recognized that this plan includes graveling some area in the North Willow Street right-of-way and that a portion of the planter box will extend into the right-of-way. The City is agreeable to this noting there is no immediate plan #o widen the right-of-way. Public Works Director: Concur with the recommendations below. The project does not have an apparent adverse impact on drainage. Building Official: Not available to comment.
