PZ08-31 - An application for a for a 15-foot rear setback variance the property known as Lot 9, Block 3, Redoubt Terrace Subdivision, Ha11 Addition (105 Haida Drive) . Application submitted by Ryan Tunseth, 105 Haida Drive, Kenai, Alaska. City Planner Kebschull reviewed the staff report included in the packet, noting the following the applicant was requesting a 15-foot rear setback variance to construct a 15 x 10 s.f. shed. Kebschull also reviewed the criteria required to KMC 1.20.180 to determine if a variance should be granted and her findings which were also included in the staff report. Kebschull noted the following: • The five-foot side setback was met. • Special conditions or circumstances: Because the parcel was developed, options for location of a shed within the constraints of the rear yard provided special circumstances. • The applicant inherited the development constraints when purchasing the residence. • Sheds are accessary structures permitted within the zone. • Using the measurements provided, it appeared the request was reasonable and minimum. The request was not based on other non-conforming uses or structures. Because the request was reasonable in light of the available lot left for the year yard and still meeting the side setbacks, she recommended approval of the variance. Chair Twait opened for public hearing. There being no one wishing to be heard, the public hearing was closed. PZ08-32 - A Conditional Use Permit to operate a lawn care business from 1902 & 1904 Aliak Drive, Lots 1 8v 2, Woodcock 1984 Subdivision of Gov't. Lot 69. Application submitted by Charles Woodcock, 1902 Aliak Drive, Kenai, Alaska. Kebschull reviewed the staff report included in the packet, noting the following: • A complaint had been received related to supplies being stored in the right of way. • The applicant had been contacted by the city and was informed he needed to have a conditional use permit for the lawn care business. • The location currently held a home occupation permit for a day care. • The lawn care business had been operating at this location. for six years and was current with Borough sales tax. • The business caused minimal traffic. • The supplies were removed from the city right of way. • Administration recommended the permit be approved as submitted but any expansion of the business would require an amendment to the Conditional Use Permit. The floor was opened far public hearing. Randy Peck, 82II Shillelah, Kenai -- Stated his concern of noise after hours and requested the approval reflect operation could only take place during certain hours and suggested no later than 9:00 p.rn. A brief question and answer period took place during which it was noted morning activity at the business was not a problem, the location of the business was not unsightly, and the noise was produced mostly from filling the hydro-seeder which was being done during the evening hours. There being no one further wishing to speak, the public hearing was closed. MOTION: Commissioner Bryson MOVED to approve Resolution No. PZ08-32, a conditional use permit, with the incorporation of staff comments. Commissioner Brookman SECONDED the motion. Commission a brief discussion followed, noting noise concerns should be considered. Discussion -~ An ordinance of the Council amending KMC 1.85.Ob0 and KMC 1.85.070 -Conflict of Interest. Comments included: • Subparagraph (b) of the first page could be problematic far an architect or surveyor. • Subparagraph (b} should give a person the opportunity to a chance to abstain or recuse. • Subparagraph (h} of the second page: who would track a former municipal officer, commissioner or employee who may not represent, advise, or assist a person for compensation, etc. (it was noted council could waive the application of the restriction}. ITEM 8: PENDING ITEMS 8-a. PZ07-25 -Recommending Council enact KMC 9.10.015 to require durnpsters be screened on at Least three sides. ITEM 9• REPORTS 9-a. City Council -- Council Member Ross referred to the June 4, 2008 council meeting action agenda included in the packet and reviewed actions taken, including the passage of an ordinance to compensate the commission $100 a month. 9-b. Borough Planning -- Commissioner Bryson reviewed the agenda of the June 9, 2008 Borough Planning Commission and noted actions taken. 9-c. Administration -- Kebschull noted the following: • Forms needing the commission members to complete related to the ~ 100 a month compensation. • She would be working with the city attorney related to a code amendment for accessory structure setbacks. • Requested members insert the Comprehensive Plan Update into their plans. • She expected additional activity with regard to landscape/site plans. • Over the last several months, City administration had been planning for the upcoming dip net fishery. • The State courthouse received funding to lease the property next to it for a parking lot. Alaska Digital sig-red an agreement with the Kenai Grace Brethren Church to allow Alaska Digital to lease a portion of the church property in order to build axrd. sustain a 120 foot cell tower. We live directly across McCollum Drive from the church, and within 300 feet from the proposed cell tower site, We did not figure out what was being built until about the satr-e time the City of T~enai became aware of the tower as it was under construction and stopped the pracess as the appropriate permits had not been requested and granted. We are currently following and participating in the process as Alaska Digital lass requested a height allowance variance from the Kenai planning and zoning commission. The first variance request for 1.20 feet was denied at a meeting aver many of our neighbors and we testified. against the variance. Now, Alaska Digital has submitted a request fcsr variance on~an 80 foot tower, of which we are also not in favor of We platy to attend the next planning and zoning meeting on June 25 to again testify. This morning the pastor of Kenai Grace Brethren Church came anal. knocked an our door to let us ktaow that Alaska Digital was sending dawn equipment to run some tests to determine if it would he feasible to put in a 3 5 foot tower. The pastor again apologized to us saying the claureh no longer wanted to be involved with leasing their property to Alaska Digital but didn't know vahat else to do. The pastor, Al Kidder told us again that when the processes began, he told Alaska Digital, "You are the experts and. you know what needs to be done and what you are doing so you need to go door to door and explain it to the neighbors". I-l;e indscated that Alaska Digital agreed to take the responsibility before any eonstruotion began. He was shocked to find out that Wane of the neighbors had been informed until the planning acrd zoning hearing was scheduled. They want to be part of the community in a good way, net stirring up controversy. We fee! Alaska Digital has taken advantage of a church, by-not following the can•ect du.e pracess and not following through with informing the neighborhood of what they were doing until. they had ai.ready spent quite a bit of money on this site and don't want to back out of it. is there anything the City of Kenai can do to help remedy this situation? Also, with what we are experiencing we would like fa encourage tlxe City of Kenai to come up with a CeII Tower Moratorium. We are all for progress arad technology but what has and is.happening Lo us in the name of progress is not right. We believe there are appropriate places fax cell towers within the City of Kenai but bullying their way into residential neighborhoods is not fife way to establish this progress. It seems prudent that prospective cell phone tower sites can be predestinated whicly gees along with good smart plaru-~ing as well as Happy neighborhoods that don't have to fight bullyug.' Sincerely, Roy & Janine )/spy d03 McCollum Drive Ken.al, Alaska 996 ~ I 283-Sb21 2 STAFF REPORT To: Planning & Zoning Commission Date: June 2, 2008 ~~ Res:' PZ08-34 GENERAL INFORMATION Applicant: Rick Koch, City Manager 283-7535 City of Kenai 210 Fidalgo Avenue Kenai, AK 99611 Requested Action: Rezone -- Conservation to Light Industrial Legal Description: Lot 4, FBO Sub No 7 & Lot 5, FBO Sub No. 8 -See Attachment B Street Address: 525 & 535 North Willow Street KPB Parcel No.: 04336040 & 04336043 Existing Zoning: Split {Light Industrial & Conservation} & Conservation Current Land Use: Forestry Lease & Vacant Land Use Plan: Airport Industrial &Airport-Dependent Development District ANALYSIS Genera] Information: This is an application by the City of Kenai to rezone two airport parcels from split zone {Light ]ndustrial & Conservation} and Conservation to Light Industrial. Lot 4 is leased by the Forestry Department and Lot 5 is vacant. These parcels are located between North Willow Street and the taxiway. During a recent review of the Forestry lease, uses were questioned as related to the Light Industrial zoning. It was noted that not all uses are compatible with the Conservation zone. Ta eliminate the split- zone situation and to insure the zoning is compatible with future uses, the City is applying to rezone these parcels. During development of the Airport Supplemental Plan, the City's procedures for leasing airport lands were discussed. One of those issues dealt with zoning and that properties zoned Conservation could restrict development. The Land Use Table in Chapter 14 of the Kenai Municipal Code was amended to allow FAA authorized uses for properties inside the airport perimeter fence or having access to aircraft movement areas, ramps, taxiways, or parking aprons. This amendment was ashort- term solution for properties abutting those areas noted above. The 2003 Comprehensive Plan also identified issues with the zoning of airport lands 0834 Comment.doc Page 2 and recommended a revision of zoning of airport properties to comply with future expected uses. (Implementation Measure -Policy AP3 -Page 58) KMC 14.20.270 describes amendment procedures. The proposed rezone encompasses approximately 5.5 acres and enlarges an adjacent boundary meeting the requirements for an amendment to the official zoning map. Public Worics Director: Na comment. Building Official: No building code issues. RECOMMENDATIONS The City of Kenai is applying to rezone approximately 5.5 acres of airport land located between North Willow Street and the taxiway. One of these parcels is split-zoned and the rezone will eliminate this situation. The rezone from Conservation to Light Industrial is typically done as follow-up to the subdivision. It is unclear why this rezone was not processed. The rezone will provide for uses consistent with airport Uses and the area, The Supplemental Airport Master Plan and the 2003 Comprehensive Plan bath recommend rezoning airport lands to meet the future needs of the airport. Tract B is leased by James H. Doyle dlbla Weaver Brothers, Inc. Tract A and C-1 are vacant. These parcels are located an the south end of the airport off Coral Street. During a recent review of the Weaver Brothers lease, it was discovered that the lots were zoned Conservation. Under the Land Use Table, the lease would not be a permitted use. This lease dates to the early 1980s. it appears the original lease was approved as parking which is a permitted use in the Conservation zone, The City is requesting the rezone to insure the zoning is compatible with future airport uses. During development of the Airport Supplemental Plan, the City's procedures for leasing airport lands were discussed. One of those issues dealt with zoning and that properties zoned Conservation could restrict development. The Plan recommended rezoning properties to zoning compatible with airport uses, The 2003 Comprehensive Plan also identified issues with the zoning of airport lands and recommended a revision of zoning of airport properties to comply with future expected uses. (Implementation Measure -Policy AP3 -Page 58) 0835 Comment.doc Page 2 KMC 94.20.270 describes amendment procedures. The proposed rezone encompasses approximately 3.66 acres and enlarges an adjacent boundary meeting the requirements far an amendment to the official zoning map. Public Works Director: No comment. Building Official: No building code issues. RECOMMENDATIONS The City of Kenai is applying to rezone approximately 3.66 acres of airport land located at the south end of the airport off Coral Street. The rezone will eliminate a non-conforming use for along-standing lease and provide for uses consistent with airport uses and the area. The Supplemental Airport Master Pian and the 2003 Comprehensive Plan both recommend rezoning airport lands to meet the future needs of the airport. Recommend approval. ATTACHMENTS: 9. This is the second variance application for a cell tower for this site. The first application was heard by the Commission on May 14, 2008. Attached to this report is a copy of the staff comments, application, and excerpt of the minutes from the May 14, 2008 meeting. The original request was fora 120-foot high tower, a height variance of 85 feet. That application was denied. The applicant has revised their request and is now requesting #o build an 80-foot high tower which requires a height variance of 45- feet. KMC 14.20.180 details the intent and application process for Variance Permits. The Code also outlines the review criteria that should be used by the Planning and Zoning Commission to determine if a variance should be granted. The revised request does not alter the original review of the conditions as required in KMC 14.20.180. Special conditions or circumstances are present which are peculiar to the land or structures involved which are not applicable to other lands or structures in the same zoning district. !t does not appear there are special conditions or circumstances present for this parse! or structure. 2. It appears that the variance is being requested because Alaska Digitel chose this site for the tower thus being caused by fhe applicant. If a site were chosen in a commercial or industrial zone, height restrictions would be based on fhe building code or airport height restrictions and should not be an issue for an 80-foot strucfure. 3. The granting of the variance shall not authorize a use that is not a permitted principal use in the zoning district in which the property is located. RECOMMENDATIONS This is the second request from Alaska Digitel to build a cell tower at this location. The original application for an 85-foot height variance was denied. The request now is fora 45-foot height variance. The applicant has modified their request to try to provide cellular service while being cognizant of the concerns voiced at the original hearing. Specifically, the height of the tower has been reduced by one-third and the tower will be painted. The tower will extend 2Q-feet above the cluster of trees; the part of the tower that is above the trees will be the smaller, tapered portion. 0836 Comment.doc Page 3 Even with the modifications of the application and the reduced height variance request, it does not appear that the proposed variance meets the criteria for a variance listed in KMC 14.20,180 nor the inten# of the Rural Residential zone listed in KMC 14.20.080. That the 4S' extension beyond the 3S' restriction will suffice the minimum signal strength needed to provide quality signal, but is reasonably perceived, that the proximity to the traffic flows of the Spur Highway, traffic lights, street lights, the Church's steeple and the longstanding outward appearance and associated traffic activity of the Church, appears not to compromise the integrity of the specific area and that of the zoning. / Alaska DigiTel is proposing a brown colored, tapered single pole {steel mono) tower. / The measured height {average) of the cluster of trees, in which the tower will reside, is approximately 60'. This variance is not based on othernon-conforming land uses or structures within the zone. During the search for a cell site, Alaska Digitel representatives contacted the City of Kenai. Information was provided an zoning and land use restrictions for properties in the City. Alaska Digitel was encouraged to select a site that was zoned commercial or industrial so that their development would not require special zoning permits. Because this property is the location for the Grace Brethren Church, the zoning may not have been obvious. Church developments are generally more commercial in nature. The parcel is located on the corner of McCollum Drive and the Kenai Spur Highway. The lease site is located on the corner of the church parking lot on the south side of the property -north of the Kenai Spur Highway right-of-way. An asbuilt has been provided showing the site location. The majority of the property in this area has been cleared for a parking lot. There are a few large spruce trees in this area. There is a plan to fence the site with an 8-foot high fence; however, due to the height of the tower the screening provided will be minimal at best, To give some perspective to the height of this tower, the State of Alaska street lights an the Kenai Spur Highway range between 39 and 44 feet in height from finished grade. During the application interview, Alaska Digite! advised that the Church has requested that lights be placed on the tower to provide lighting for their site. Salient Information & Considerations: Alaska DigiTel (AKD) entezed into a mutually considerate dialogue and propezty lease agreement with the Grace Brethren Church of Kenai, for the purpose of constructing, operating and maintaining its communications facilities. A 'f 20' mono-pole (self supporting) communications tower, antennas (6, panel type} and equipment cabinets, surrounded by an 8' cedar fence, will consist of the facility to be constructed. Although there exists probable sites within certain proximity to this site location and they being of commercial use and zone, it bodes well to be able to, not only provide optimum services to the City of Kenai and surrounding area, but to provide the remuneration far the site location, to an expansive number of local residents The specific site location, postures it's self as an optimum location for a variety of reasons, such as: .Optimum RF coverage benefiting the general Kenai Ci#y proper and adjacent areas, as illustrated by the RF Map. .With the inrzpending Kenai Peninsula Borough 911 Phase II service upgrade, the tower will be in an exceptional position to feed emergency services vital data on location of any and all occurrences. .April 23, 20Q8 FAA aeronautical study, revealed that the proposed tower & antennas do not exceed obstruction standards do not pose a hazard to air navigation. .Health safety concerns should be alleviated by virtue of the following Federal Communications Commission OET Bulletin 65, E=dition 97-01 pages 13; "...out of an abundance of caution, the FCC requires fhaf fower-mounted insfallafions be evaluated if antennas are mounfed lower than 10 meters (32.89 feet) above ground and the Total power of al! channels being used is over ? 000 Watfs effecfive radiated power..." The specific site location, postures it's self as a practicable and reasonable location far a variety of reasons, such as: .The appearance of ostensible compatibility to the immediate vicinity, as illustrated in accompanying pictures of the Kenai Spur Highway & Mccullum Dr. •AKD gave consideration for locating at or near the rear of the Church property, but according to future developrrient plans, as indicated by the Church, this would not be feasible. .That there exists within the City limits {with one being near by), two similar communication mono towers . .Trees in close proximity will offer reasonable obscurement to the first, approximately 60', of tower height. .Two soft glow sodium lights will be affixed to the tower, at a height not to exceed 40', which will provide security & illumination For the Church's parking lot. This will eliminate the Church's existing fight post and lights. .Currently, the subject property is exempt from property tax as religious (AS 29.45.030 (c) (3), subsequent to the construction and operation of the communication facility, there shall be taxable value added to the Kenai Peninsula Borough and City of Kenai tax roles and payable by the lease con#ract provisions. Also, there may be sales tax revenues, payable by the lease con#ract provisions. Summary Alaska DigiTel (and on behalf of the property owner; Grace Brethren Church of Kenai), respectfully reduests relief as provided in KMC 14.20.220 (a)(9) and prescribed in KMC 14.20.180. At a question from the commission, Haerer noted the foundation was built without a building permit. Patricia Falkenberg, 399 McCollum -Spoke against the variance, noting she had not received notice from the church or Alaska Digitel, and is concerned the tower would lower property values. Robert Bielefeld, Mile 9 Kenai Spur Highway -Spoke against the variance, noting the tower would be seen from his home. With that in mind, if you feel a 120 ft. cell tower is not suitable for this area, I feel the 80 ft. tower would have the same impact as the 120 ft, cell tower. We are o ose to the 80 ft. cell tower that is being proposed, and feel that it would be a huge eyesore from the road and neighboring homes. We also feel that it could be placed in a commercial location, rather than in a residential zoned area. Please think of what it would like to personally open your front window to a VIEW of the cel[ tower. The subdivision included residential lots, extension of water and sewer, and development of the streets. The planned subdivision met the standards for the Suburban Residential zone and an application was processed to rezone the area planned for the subdivision. The rezone was approved; however, the plat was never recorded and the development never progressed past the preliminary platting stage. This created asplit-zone situation. This requested rezone, will eliminate the split-zone created in 1997. KMC 14.20.270 describes amendment procedures. Section 2 states, "Amendments to the Official Zoning Map shall be considered only if the area to be rezoned contains a minimum of one {1) acre (excluding street or alley rights-of-way} unless the PZ08-38 STAFF REPORT amendment enlarges an adjacent district boundary." The area of this rezone is approximately 72 acres and enlarges an adjacent boundary. Public Works Director: No comment. Building Official: No building code issues. RECOMMENDATIONS When reviewing the preliminary plat for Buffalo Run 2008 Replat, administration recommended this rezone and the Planning & Zoning Commission concurred with this recommendation. The applicant has leased this property since the mid-80's and uses the property to store flatbed trailers and vans. This property is located on the corner of Cohoe Avenue and Coral Stree# and is located in the Airport Reserve. - Airport Land Use Plan - A limited ALP was completed in December 2006. Qn sheet 10 of that update, the property is shown as Commercial/Light Industrial and zoned C -Conservation. Sheet 11 of the updated ALP, identifies the parcel as Airfield. The Supplemental Plan defines Airfield as, "Areas directly related to the landing, takeoff, #axiing and parking of aircraft and helicopters, including runways, taxiways, helipads, runway protection zones, approach surfaces, building and obstacle free zones, navigational aids, and City-owned aircraft parking aprons." As noted by Ms. Howard, this property is in the runway protection zone and requires a 90~day cancellation clause in the lease. ]t appears the proposed use was recognized on Sheet 10 of the ALP. Because the property cannot be developed with permanent structures, it appears the use meets the requirements for the 90-day cancellation as required for uses within the runway protection zone. WHEREAS, KMC 14.20.200(x)(2) now allows for accessory structures of not more than one hundred twenty {120) square feet and not more than one story in height to be in setback areas provided they are not closer than three feet to the adjoining lot; and, WHEREAS, existing setbacks for sheds above one hundred twenty (120) square feet cause a significant loss of usable yard space; and WHEREAS, increasing the size of such accessory structures allowed in the rear setback would allow for more inside storage without the added expense of another out building, thus reducing outside storage in yards; and WHEREAS, defining single story height would insure allowing structures in the rear setback do not adversely affect the adjacent properties; and, WHEREAS, it is in the best interest of the City of Kenai to amend KMC 14.20.200(x) to allow accessary structures over one hundred twenty (120) square feet to be placed up to five feet (5') from the adjoining lot and to define single-story height as a maximum of 12 feet (12') high as measured from the ground to the top of the roof. NOW, THEREFORE, THE PLANNING AND ZONING COMMISSION OF THE CITY OF KENAI RECOMMENDS THE COUNCIL OF THE CITY OF KENAI, ALASKA AMEND KMC 14.20.200 as follows: KMC 14.20.200 Accessory structures. (a) Yaxd Requirements for Accessory Structures.
