ORDINANCE NO, 551-90
AN ORDINANCE OF THE COUNCIL OF THE CPrY OF KENAI, ALASKA INCREAS-
ING ESTIMATED REVENUES AND APPROPRIATIONS IN THE 1079-80 GENERAL
FUND BUDGET BY $10,000 FOR A RECONNAISSANCE INVESTIGATION OF THE
FEASIBILITY OF SMALL BOAT HARBOR DEVELOPMENTS IN THE KENAI RIVER,
AND AUTHORIZING THE ACTING CITY MANAGER TO SIGN THE CONTRACT
AGREEMENT WITH THE STATE OF ALASKA FOR SUCH INVESTIGATION.
WHEREAS, the State of Alaska has offered the City of Kenai a grant in the
amount of $5,000, which represents 50% matching funds, for the purpose of
conducting a reconnaissance investigation of the feasibility of small boat harbor
developments in the Kenai River, and
WHEREAS, this investigative study is desirable in order to pursue State funding
sources for a harbor project, and
WHEREAS, proper accounting practices require that all appropriations of City
monies bb made by Ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI,
ALASKA, that:

Section 2: The Acting City Manager be authorized to sign the Contract
Agreement with the State of Alaska, which describes the
tasks to be performed by the City and the reimbursement
method.

CONTRACT AGREEMENT
THIS CONTRACT, entered into this day of ,
19 , between the City of Kenai, Alaska (hereinafter known as the
City) and the State of Alaska through the Deputy Commissioner of
Transportation Planning and Research, Department of Transportation and
Public Facilities (hereinafter known as the State).
WHEREAS, Chapter 113, SLA 1978, provides funding for various small
boat harbor developments throughout the State including Kenai, and
WHEREAS, the feasibility of further City and State involvement in
the improvement or expansion of small boat harbor facilities in the
Kenai River cannot be determined without factual base data, an assessmant
of user needs and a determination of the economic viability of the
project in general, and
WHEREAS, the Administration and the Alaska Legislature will be
evaluating the merits of variuus capital improvement projects of this
nature, and
WHEREAS, a need exists for timely completion of a project feasibility
report, and
WHEREAS, it is considered to be in the best interests of the State
and the City for the City to seek resolution of the viability of this
project and to administer this effort,

Dear Vince:
Attached is a Grant Agreement for $5,000 to be matched
on an equal basis by the City of Kenai for the purposes of
conducting a reconnaissance investigation of the feasibility
of small boat harbor developments in the Kenai River.
Project study features which should be addressed are
listed in the Grant Agreement. I would also like to point
out that should you ultimately desire to apply for a Port
Development Grant the $5,000 granted here would be deducted
from the $585,000 currently available. This is because AS
30.15{+specifically excludes the cast of feasibility studies
as an ellgible project cost. On the other hand, if the
project is pursued as a small boat harbor development project
and funded from other sources of State or local funds, this
refund provision would not be applicable.
If the City agrees with this understanding, and with
the content and conditions of the Grant, please sign all
three copies And return to me. Aftcr they have been nil;ued

not Turituonz, in consideration of the mutual covenants and conditions
hereinafter contained, the parties agree as follows:
1, The City agrees to perform, or contract to perform, an
investigation of the feasibility of constructing Small twat harbor
facilities in the Kenai River, near Kenai, Alaska. Scope of work
should include but is not necessarily limited to the following items:
(a) Define the need.
(b) Determine user preferences.
(c) Determine level of services desired and extent to which user
is willing to pay for services provided,
(d) Investigate availability of adjacent public land.
(e) Evaluate alternative locations, including projects currently
proposed by private interests.
(f) Develop conceptual designs (dry land harbor, bulkheads,
ramps, boat lifts, etc.).
(g) Provide order of magnitude cost estimates for development
(maximum limit $3 million).
(h) Evaluate potential. operation and maintenance problems and
cost, with special attention given to estimated annual
maintenance requirements,
(i) Address environmental concerns.
Duscribe benefits which will accrue to the City as well as
the surrounding area from construction of the proposed
facilities.
(k) Assess impact project would have on the fisheries industry of
the area (provide stimulus or be detrimental to private
development, etc.).

(1) Evaluate the ramifications of doing nothing.
2. The State agrees to reimburse tl City for a portion of the
actual cost associated with performing the tasks outlined above;
however, the maximum amount of this contract shall not exceed $5,000
without prior approval of the State.
3. Periodic payments for labor or other contract costs will be
made any time upon request and submission of appropriate invoices or
other suitable evidence that the work for which payment is being
requested has been accomplished. Payment will be processed as ex-
peditiously as possible and normally will be received within ten days.
4. The City may commence work at its own discretion after
execution of this agreement; however, all work must be completed prior
to April 15, 1980. The State shall be provided a minimum of eight
copies of the completed report.
IN WITNESS WHEREOF, the parties hereto have set their hands the
day and year stated in the first paragraph of this contract.
