CITY OF KENAI ORDINANCE NO. 473-79 AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA AMENDING THE 1963 KENAI CODE AS AMENDED AS IT CONCERNS THE PENALTIES PROVISION UNDER THE FIRE CODE. WHEREAS, the Council of the City of Kenai adopted a Uniform Fire Code on August 5, 1978, and WHEREAS, it would enable more efficient operation and encourage the compliance of the fire codes and regulations if a civil penalty provision were added to this ordinance as an additional and alternative means of enforcement, and WHEREAS, said provision would give the City of Kenai Fire Department and the Legal Department immediate access to the Superior Court in order to obtain the abeyance of fire hazards which may cause jeopardy to life and property, NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA that Ordinance 4I1-78 be amended to read as follows: To Section 8.05.140 Penalties add the following sentences: In addition to, or as an alternative to the criminal penalty aforementioned, or the penalties and compliance provisions of the Uniform Codes adopted by this ordinance, any person violating any provisions of this ordinance, the uniform codes that it adopts, or any written order of the Fire Chief or his designee based on the above, to correct afire hazard, shall be subject to a civil penalty of not more than $100. Each and every day that such violation continues shall be deemed a separate and distinc~ violation. In addition, a civil injunction or temporary restraining order may be obtained in order to obtain immediw;.c compliance with the provisions of this ordinance or the uniform codes that it adopts in order to abate a fire hazard.
