CITY OF KENAI
ORDINANCE NO. 504-79
AN ORDINANCE OF THE CITY OF KENAI AUTHORIZING SALE OF LOT
2, SPUR SUBDIVIaION I, 16.25 ACRES, AND ESTABLISHING TERMS
AND CONDITIONS OF SUCH SALE.
WHEREAS, in consonance with the recommendations of the Mayor's
Committee on Airport Land, the Council of the Cfty of Kenai,
Alaska has determined that a pilot disposition plan for airport,
nonaeronautical land needs to be implemented, and
WHEREAS, Lot 2, Spur Subdivision I is nonaeronautical land, sale
of which can generate these needed funds, and
WHEREAS, Ordinance 312 sets forth procedures for the sale of
City owned lands which shall be followed for this sale, and
WHEREAS, the City Manager has recommended that this land be sold ~•
pursuant to Ordinance 312, has presented the City Council with an
estimated value of the property obtained from a qualified appraiser. '~
NOW, THEREFORE, BE IT ORDAINED BY '1'~iE COUNCIL OF THE CITY OF ~~(~-f
KENAI, ALASKA that: ~~
Section 1. In the judgment of the City Council, Lot 2, ..~
Spur Sub~d v -soon I, consisting of 16.25 acres is no longer needed ~ ,
for Municipal purposes. ,
Section 2. In the judgment of the City CaurCil, special
circumstances exist making it unnecessary for the Advisory
Planning & Zoning to review this disposition of land. S!.nce
this land is in such a location as to not make it feasible
for future recreational or public use.

Section 3. Notice of the sale and manner in which it shall
~~ be sol~all be published in a newspaper of general circulation
within the City once each week for 2 consecutive weeks not less
than 30 days prior to the date of sale, and nr~tice shall be
,; posted in at least 3 public places within the City and Borough
for at least 30 days prior to sale.
Section 4. The sale :,f Lot 2, Spur Subdivision I, 10.25
acres s here y authorized. Such sale is to be by public out-
cry auction to be held August 1, 1979 at the City of Kenai
Public Safety Building at 7:00 p.m. Alaska Daylight Savings

Time with a minimum bid of $800,000. Terms of the sale are
ten percent down, cash or k~ank draft, with full cash payment
within 90 days, close of business October 29, 1979.
Section 5. Proceeds from the sale are to be placed in a
segregated trust account. The principal from the trust account
may be used to finance the local share of Airport Development
Aid Programs (AAAP). Earnings of the trust fund may be used
only for airport and airport land capital improvements, operation
and maintenance.
