RESOLUTION NO. PZ2016-21
A RESOLUTION OF THE PLANNING AND ZONING ADMINISTRATION OF THE CITY OF
KENAI APPROVING THE ATTACHED LANDSCAPING/SITE PLAN:
WHEREAS, the attached Landscaping/Site Plan Review was:

WHEREAS, the City of Kenai Planning and Zoning Administration finds this plan provides for
orderly and safe development within the City commensurate with protecting the health, safety,
and welfare of its citizens, and provides adequate and convenient open spaces, light and air in
order to avoid congestion of commercial and industrial areas; and,
WHEREAS, the plan appears to provide for landscaping and/or the retention of natural
vegetation in conjunction with commercial and industrial development within the City; and,
WHEREAS, the purpose of landscaping is to visually enhance the City's appearance and
reduce erosion and stormwater runoff, and the plan appears to meet these criteria.
NOW, THEREFORE, BE IT RESOLVED, BY THE PLANNING AND ZONING
ADMINISTRATION OF THE CITY OF KENAI:
Section 1. That the applicant meets the conditions required for a landscaping/site plan permit,
including:
a) Variety of techniques to address perimeter/buffer/interior/street right-of-way parking
lot landscaping;
The renovation of the existing building will not impact the parking lot or parking lot
landscaping. The existing trees along the Kenai Spur Highway right-of-way will be
retained. Also, the existing trees along the North and South side of the building will
not be removed. In addition, a combination of ten new Alaska spruce and birch trees
will be planted along the Southwesterly boundary of the property.

b) A use compatible with surrounding properties;
This property is adjacent to the Kenai Spur Highway and lies within the Limited
Commercial (LC) Zone. The land use plan category within the 2016 Envision Kenai
2030 Comprehensive Plan for this area is Mixed Use, which allows for commercial
and residential uses. The parcels adjacent to this parcel are also zoned Limited
Commercial (LC), with the exception of the residence lying to the West, which is
zoned Rural Residential (RR).
c) Additional permits or approvals;
Building permits and approval from the City Manager, Public Works Director, and
Building Inspector have been obtained as applicable. PZ2016-06 granted a
Conditional Use Permit approved by the City of Kenai Planning and Zoning
Commission.
d) Parking lots must comply with KMC 14.20.250;
This existing parking lot is paved. The site plan designates fourteen (14) parking
spaces, which meets the parking requirements (5 spaces for the marijuana cultivation
facility and 8 spaces for the retail business). Two spaces will be ADA accessible.
e) Snow storage and drainage must be referenced on the site plan;
The site plan indicates that snow storage will be at the front of the lot in the Northeast
corner of the parcel. The snow storage area will not block the required parking spaces
or visibility of ingress or egress.
f) Dumpsters must be screened with a sight-obscuring structure;
The dumpster will be located at Southwest corner of the building and screened with a
wooden enclosure.
g) Ingress and egress should route traffic away from residential streets;
Access to subject parcel shall be via the Kenai Spur Highway, which is a major
collector street.
h) Trees, shrubs, and plants should be appropriate for the climate and not invasive;
The property owner has indicated that the natural vegetation and existing trees will be
maintained. In addition, a combination of ten new Alaska Spruce and Birch trees will
be planted along the Western boundary of the property. The right-of-way between the
property line and the existing bike path will be reseeded with Blue Grass, ATC mix.
Section 2. That the landscaping/site plan permit is subject to the following conditions:
a) Development of the property shall conform to all federal, State of Alaska, and local
regulations.
b) No snow may be stored in such a manner that would block visibility for ingress and
egress to the parcel.
c) If construction of the project has not started within one year of the approval of the
landscaping/site plan (August 3, 2020), the approval may be revoked by the
Administrative Official after providing at least thirty (30) Day notice unless extended
for good cause.

d) Any plants used for landscaping will be appropriate for the climate and not invasive
per the Alaska Cooperative Extension Service.
e) All required landscaping as presented in the approved landscaping plan shall be
installed within two (2) years of the approved landscaping plan (by August 3, 2022).
