ORDINANCE NO. 338-77, AS AMENDED
A_WI ORDi~,IANCli OF THE COUNCIL OF THE CITY OF KENAI, ALASKA PROVIDING
TI{AT TIIE QUESTION OF DEDICATING CERTAIN BOND FUNDS TO THE CONSTRUCTION
OF STREETS AND RECREATIONAL FACILITIES BE SUBMITTED TO THE QUALIFIED
VOTER8 OF THE CITY OF KENAI.
WHEREAS, certain funds were authorized for the construction of a Civic Center by
a bonding referendum of the City of Kenai predicated on matching funds being avail-
able from the State of Alaska, and
WHEREAS, such funds were not approved by State referendum, and
WHEREAS, the construction of a Civic Center is now not economically feasible, and
WHEREAS, there is a continuing need for street improvements and recreation
facilities, and
WHEREAS, redemption of any or all of the outstanding bonds of this issue in whole,
or in part, cannot be accomplished prior to July I, 1981.
NOW, TIiEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI,
as follows:
~eetion I: The Council of the City of Kenai hereby declares that the
publte health, welfare, safety and convenience require the City to provide for
major capital improvements to streets and recreational facilities by reallocation of
$$30,000, the remaining proceeds autho~zed by referendum fo~, construction of
a City Civic Center.
Section 2: The Council hereby finds that it is in the best interest of the
City that such $$$0,000 be reallocated as follows:

lieetion $: The City shall design, plan, aequh'e, eons~uet and equip the
foll~i~g capital improvements.
A. Major improvements to the streets and roadways within the City
by reconstructing, widening, grading, and greveling or paving with asphalt or
concrete, and by installing drainage facilities, sidewalks and required appurtenances,
within the central business district'.
B. Ree~'eational facilities such as but not limited to tennis courts,
tee rink and similax, major facilities and required appurtenances.

Section 4: In the event that the funds realloeated to each category will not
permit the acquisition, construction and installation of ali of the improvements listed
in that category or the acquisition of all equipment listed, such portion of such
improvement or equipment as may be found to be most necessary by the City Council,
shall be acquired, constructed or installed.
Section 5: The proposition of whether or not the City shall reallocate $330,000
of the remaining proceeds of the 1974 Advanced Refunded General Obligation Bond Issue
dedicated to the construction of a Civic Center to the purposes and in the amounts
described in the preceeding sections of this ordinance shall be submitted to the
qualified vo~ers of the City of Kenai, Alaska, for their ratification or rejection at the
General Election to be held within the City on the llth day of October, 1977. Said
proposition shall be in the following form:

REALLOCATION OF BOND FUNDS
DEDICATED TO CONSTRUCTION OF CIVIC CENTER
Sb_a!l the City of Kenai, Alaska reallocate $330,000, the remaining proceeds
dedicated to construction of a Civic Center by referendum dated May 25, 197I, to be
used in the following amounts, in the following categories, to design, plan, acquire,
construct, and equip some or all of the following eapit.~l improvements, allocation
within each category to be made by the Council of the City of Kenai.
$ 280,000 to major improvements to streets within the City including
reconstructing, widening, grading and graveling or paving with asphalt or
