OF THE CITY OF KENAI RARRING DUMPING OF {~EPTIC MATERIALS IN THE SANITARY
SEWER SYSTEM, AS AMENDED.
WHEP~A8, Ordinance No, 302-76 provided for controlled dumping of septio (sewage)
materials into the City sanitary sewer system, and
WHEREAS, abuse of that o~dinane~, has created extensive burdens in the Waste and 8ewer
Utility with costs of operation ond service far exceeding revenue and further carelessness
in dumping has created odo~ and unsanitary oonditions.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of ~'enai, Alaska as follows:
Section 1: A~ticle 8 of Chapter 17 of the Code of the City of ~enai is amended
to read as follows:
Section 17-76: No person shall dumo, deposit or in any other manner
dispose of septic and cesspool material into the City snnita%~./sewer system.
Section 17-77: The City shall establish a facility to accept septte/cesspoo!
materials free from debris and forei~m matter that is deemed treatable fromm
City residents whose lots, with dwellings thereon, are not within 150 feet
of a sanitary sewer.
Section 17-.78: Such material may be deposited in the facility on payment
of an appropriate ts-:i~aage fee. Fee charges, standards of septic materials
to be accepted and procedures shall be established by resolution of the Council
of the City of Kenal.
Section 17-79: Any person, fi~m or eorpm, ation violating any provision
of 8eetton 17-76, 17-77 and/or 17-78 shall be ~fuilty of a misdemeanor and
shall be subject to a fine in an amount not to exaeed $300. Each dumping
shall constitute a sepa~ste violation.
Section 2: Section 17-80 is hereby t, eseinded.
Section 3: The effective date of this ordinance shall be Mat'eh 8, 1978.
