NOW, THEREFORE, BE IT RESOLVED, BY THE PLANNING AND ZONING ADMINISTRATION OF THE CITY OF KENAI THAT THE LANDSCAPING/SITE PLAN IS APPROVED SUBJECT TO THE FOLLOWING CONDITIONS OF APPROVAL: 1.Development of the property shall conform to all federal, State of Alaska, and local regulations. 2.If construction of the project has not started within one year of the approval of the landscaping/site plan (September 3, 2021), the approval may be revoked by the Administrative Official after providing at least thirty (30) Day notice unless extended for Resolution No. PZ2020-29 Page 2 of 2 good cause. 3. Any plants used for landscaping will be appropriate for the climate and not invasive per the Alaska Cooperative Extension Service. 4. All required landscaping as presented in the approved landscaping plan shall be installed within two (2) years of the approved landscaping plan (by September 3, 2022). 5. Snow storage shall be located along the northern edge of the parking lot. No snow may be stored in such a manner that would block visibility for ingress and egress. 6. Subsequent development or changes to the design will require additional City approval with a new landscaping/site plan application. 7. The on-site dumpster must be screened and placed on a concrete slab. 8.The parking lot shall be paved and contain 150 spaces, 5 of which are ADA accessible spaces. Box 988 Kenai, AK 99611 Submitted By: Blazy Construction 36130 Kenai Spur Highway Soldotna, AK 99669 Requested Action: Landscaping/Site Plan Approval Legal Description: Lot 53, Block 1, Redoubt Terrance Subdivision Property Address: 12271 Kenai Spur Highway KPB Parcel No: 04712026 Lot Size: 5.03 Acres (approximately 219, 107 square feet) Existing Zoning: General Commercial (CG) Current Land Use: Vacant Land Use Plan: General Commercial GENERAL INFORMATION Blazy Construction submitted a landscaping/site plan on behalf of the property owner, Kenaitze Indian Tribe, for the parcel described as Lot 53, Block 1, Redoubt Terrace Subdivision, located at 12271 Kenai Spur Highway. Blazy Construction has been retained by the Kenaitze Indian Tribe to construct an approximately 32,000 square foot education facility for private use by the Kenaitze Indian Tribe. The facility includes an education wing, large entrance plaza , a large multi-purpose room, a commercial kitchen, cafeteria, and storage rooms. ( ANALYSIS KMC 14.25 outlines landscaping/site plan regulations. The intent of these regulations is to provide for orderly and safe development of the City of Kenai and to have landscaping that retains natural vegetation in conjunction with development. The City Planner deemed the application to be complete and in accordance with KMC 14.25.030 -Landscaping/site plan- Submittal requirements. Performance criteria for landscaping/site plans are outlined in KMC 14.25.040 and KMC 14.25.045. These criteria are reviewed and summarized as follows: • Variety of techniques to address perimeter/buffer/interior/street right-of-way/parking lot landscaping; o The previous owners cleared the trees and vegetation along the portion of the property fronting the Kenai Spur Highway and S. Forest Drive. There are trees along the perimeter of the East and South boundaries of the property. According to the site plan the existing trees and natural vegetation will remain on the parcel. o The parking lot is divided into three main sections, with interior landscaping between or at the ends of all parking aisles. Attached drawings show planting zones that provide buffer space from the Kenai Spur Highway and the neighborhood. • A use compatible with surrounding properties; o This parcel is within the General Commercial Zone of the City and the Land Use Plan classifies this area as General Commercial (CG). There are residential neighborhoods to the East and South of the parcel. The area to the West and across South Forest Drive is the National Guard Armory. The property to the North is the right-of-way for the Kenai Spur Highway. There is an approximately 0.91 acre (approximately 39,640 square feet) parcel adjacent to the highway that is owned by the City of Kenai; however, it is unlikely this parcel will be developed by the City according to the City's internal lands data. • Additional permits or approvals; o A Building Permit must be obtained with approval from the Building Inspector prior to construction and occupancy. The Fire Marshal must also approve of the occupancy of the building. • Parking lots must comply with KMC 14.20.250; o The applicants must provide 150 spaces for the facility. The site plan shows 150 spaces, of which 5 spaces are ADA accessible. • Snow storage and drainage must be referenced on the site plan; o The site plan indicates that the snow storage area will be located on the Northwest corner of the parking lot. The property owner will be responsible for snow removal from the subject parcel if snow berms become large enough to reduce the area available for parking, become a hazard for occupants on the premises, or become a nuisance for the adjacent neighborhood. o The site drains in all directions from the building and parking lot. A large area for Page 2 of4 The City of Kenai I www.kenai.city temporary surface run-off storage is provided in the Northwest corner of the site. Additional run-off storage areas are located to the Northeast, East and South of the parking lot, minimizing drainage to the Forest Drive right-of-way. Any run-off that enters the Forest Drive right-of-way will travel along the existing curb and gutter to a storm water inlet new the Southeast corner of the parcel. • Dumpsters must be screened with a sight-obscuring structure; o A dumpster is shown on the site plan with an enclosure on the west side of the proposed building. The dumpster will be placed on a concrete slab. The dumpster will be enclosed on three sides by a CMU wall with plantings along two sides • Ingress and egress should route traffic away from residential streets; o This site plan shows three entrance/exit points from Forest Drive into the parking lot and drop-off areas. The National Guard Armory lies East of the proposed building and the Kenai Spur Highway lies to the North of the building. There are residential neighborhoods lying to the West and South of the parcel. Access off of South Forest Drive will route traffic away from residential streets. • Trees, shrubs, and plants should be appropriate for the climate and not invasive; o The site plan indicates that there is a 15 foot vegetated buffer along the West and South property lines. The trees within this buffer a very mature and provide limited understory screening. Wood screen panels will be provided to augment the vegetation for screening purposes. Along the East one-third of the South property line, there is no existing vegetation. The design for this section of the 15 foot landscape buffer include new plantings of conifer trees and large shrubs in addition to providing a generous 27 foot landscape area between the residential properties and the parking lot. A detailed plan shows a planting schedule for numerous native plants and flowers to be placed at the western edge of the parcel. APPROVAL CONDITIONS Based on the application and a review of the criteria required to approve the landscaping/site plan, the application meets the intent of landscaping/site plan requirements and performance criteria. The plan is approved as submitted with the following conditions of approval: 1. Development of the property shall conform to all federal, State of Alaska, and local regulations. 2. If construction of the project has not started within one year of the approval of the landscaping/site plan (September 3, 2021 ), the approval may be revoked by the Administrative Official after providing at least thirty (30} Day notice unless extended for good cause. 3. I do need the attached application to formally approve of the landscaping/site plan. This application has no fee. I looked back and I had told Nancy 150 was the lowest they could go on spaces I think we got there with a private school and multi-purpose.
