HomeMy WebLinkAboutORDINANCE 0269-1975 CITY OF KENAI ORDINANCE NO. 269-75 AN ORDINANCE OF TItE COUNCIL OF TtlE CITY OF KENAI AMENDING CHAPTER 4 OF THE CODE OF THE CITY OF KENAI TO PROVIDE FOR THE ENACTMENT OF CURRENT EDITIONS OF VARIOUS TECHNICAL UNIFORm. CODES BE IT ORDAINED by the Council of the C.~y of Kenai, Alaska: That the Code of the City of Kenai, as amended, is further amended as follows: Section 1. Chapter 4, Buildingt Plumbing and Electrical Installations is hereby amended to read in its entirety as foll6~s: Chapter 4 UNIFORbl CODES Article 1 Building CoErCed-Regulations Section 4-1 Uniform Buildin~ Code adopted. There is hereby adoptcd for the purpose of establishing rules and regulations for tho construction, alteration~ removal~ demolition, equipment, use and occupancy, location and main- tenance o£ buildings and structures, including permits and penalties~ that certain bound volume known as the "Uniform Building Code", 1973 Edition, o£ the International Conference o£ Building Officials, including the appendices except for such portions as are herein after deleted, modified, or amended; and the same is hereby adopted and incorporated as fully as if set out verbatim herein. Section 4-2 Building Official- Inspectors. (a) The Building Official Of this City shall have the powers, duties and functions prescribed for the "building official" by the Uniform Building Code, adopted by Section 4-1 provided that the said powers, duties and functions may be performed by authorized representatives of the P,~lllding ~ffi~;t~ll ,n¢t un(let his supervision and eont,~,,! - (b) The City Administrator shall be ex offteto building, official unless he appoints another person to be building official. Tho. authorized representatives of the Building Official referred to above, when nad tf appointed, shall be appointed by the City Administrate' . Section 4-5 Section 303(a) amended - Permit fees. The first paragraph of Sec. 303(a) of the Building Code adopted by this Chapter is amended to read as follows: "Sec. 303(a) Building Permit Fees. A fee for each building permit shall be paid to the Building Official as set forth in Table No. 3-^, except that fees shall be charged for new construction of ~,roup ! and Group J, Division 1 ocoupancies, or portions thereof as follows: (1) Group I ............. $0.09 per square foot of foundstt, on area. (2) Group J, Division 1 ~ - - - $0.04 per square foot of foundation area ." Section 4-4 Section 2305(e) amended - Snow load. Sec. 2305(c) of the Building Code adopted by this Chapter is amended by adding the following: "The basic design snow load shall be forty pounds per ~quare foot on the horizontal projection of the roof." (nrd. 2~0 ~1, 1975.) Section 4-5 Section 2308¢a) amended ~ Wind pressure. Sec. 2308(a) of the Building Code adopted by this Chapter is amended by adding the following: "Wind pressure shall be computed from Column 25 in Table 23-F." (O~'d. 260 §1, 1975) Section 4-~ Section 2517(e)6 amended - Foundation ventilation. See. 2517(c)6 of the Building Code adopted by this Chapter is amended to read as follows: "Underfloor area ventilation shall not be required, provided that a ground cover of at least four n~.~ polyethylene film or equal is installed." (Ord. 260 §1, 1975.) Section 4-7 Table No. 29-A - Foundations for stud bearing wnlls. Exterior bearing foundation walls shall be continuous, Section 4-8 Section 3302(a) amended - Exits. Sec. 3302(a) of the Building Coae aaopted' by this Chapter is amended by adding the following: "Every dwelling shall be provtdad with n minimum of two exits." Section 4-9 Definitions. For the purpose of Seettons 4-gthrough 4,~14 terms or Woras used herein shall be interpreted or defined as follows: (a) The term "trailer" shall be defined *" any vehtele or structure used or intended for use as a dwellin~ ~nd designed for transportation after fabrteattor. on streets and highways on its own wheels, and arriving at the site where it is to be occupied as a dwelling complete and ready for occupancy, except for minor and incidental unpacking and assembly operations, location on ~aeks or permanent foundations, connection to utilities and tho like. (b) The term "lean-to" shall mean an accessory structure attached and appurtenant to a trailer. 97 (e) "Utility" or "recreational" trailers are defined as vehicles, ,nd if intended for occupancy, destfIned for use on ~, limited time basis and not for continuous y,~ar.-round use. (Ord. 2!0 ~I, 1972; Ord. 260 ~1, 1975.) Section 4-10 .~ertain types uses for trailers prohibited. (a) ~/o trailers may be Installed for use in the City of I(enai fey public, eommerci~l or assembly purposes. Those trailers in use for the prohibited purposes on the effective dateofthis Ordinance shall terminate such use on or before the 1st day of 'January, 1978, and such existing non-conforming uses as present1Y exist may not be altered, enhanced or improved in any fashion. Co) Trailers utilized on construction sites for offices, storage or other such purposes may be so used anywhere within the City limits on the construction Job they serve without permit, but shall be removed immediately upon completion of said construction. (Ord. 210 §1, 1971; Ord. 260 §1, 1975.) Sect ion 4-11 Criteria for trailer placement. Trailers placed or "set up" for occupancy within the City of Kenai shall conform to the following criteria: (a) Those standards prescribed by A .,~. 45.30. Co) The foundation area upon which the trailer is placed shall bc excavated to non-frost susceptible material, or forty-two inches from adjacent surface, whichever is the lesser depth. Such excavation shall be back-filled with non-frost susceptible material to the same or higher elevation as the surrounding terrain. (c) Trailers shall be placed upon substantial blocking. "Substantial" in this context ehall mean adequate to support the trailer, its contents, and sustain thc shocks or vibrations of occupancy in such fashion as to permit all doors or exits Dom the said trailer to operate in accordance with their design. (d) The determination of adequate conformance to the standards specified herein shall be made by the l~uildtng Inspector. Section 4-12 Lean-tos. (a) Structures designated as lean-tos shall conform to all applicable codes as adopted by the City of Kenai, except that lean-tos of four hundred square feet or less may be set on foundations as specified in Section4-11 for trailer foundations. (b) If any lean-to covers both exits from a trailer, then the lean-to shall have two exits remote from each other. Section 4-13 Building permit fees applicable to trailers and lean-tos. (,) Building permits shall be obtained before trailer placement anywhere within the City limits, and before starting any consh;uction on lean tea. 98 (b) The fees for a building permit for a trailer shall be computed at the rate of four cents per square foot. (c) The fees for a building permit for a lean-to of four hundred square feet or less shall be computed at the rate of four cents per square foot. (d) If work on placement of a trailer or construction of a lean-to is commenced before obtaining a building permit, the fee specified herein shall be doubled. The penalty fee shall not relieve the person from complying with any other requirements of this Section. Section 4-I4 Application of trailer regulations. The provisions of '-]5~JH~fi~-~l~hrough 4-14shall apply to the trailers set up on individual lots, or to trailers moved~from one location to another within the City. Any improvements to existing trailers or lean-tos shall comply with this Art i c 1 e Lean-tos moved or built onto a trailer in a mobile home park shall conform to the standards set forth in this Article. Article 2. Uniform Code For the Abatement of Dangerous ~uildtnffs Section 4-1_5 Uniform Code for the Abatement of Dangerous Buildings adopted. The~'e is hereby adopted for the purpose of establishing rules and regulations for the abatement of dilapidated, defective buildings which endanger life, health, property and public safety, that certain code known as the "Uniform Code for the Abatement of Dangerous Buildings", 1973 edition, of the International Conference of Building officials, except for such portions as are hereinafter deleted, modified or amended, and the same is hereby adopted and incorporated as fully as if set out verbatim herein. Saction 4-16 Buildin~ Official. The Budding Official of this City shall have the powers, duties and functions prescribed for the "Budding Official" by the Uniform Code for the Abatement of Dangerous Buildings, adopted by Section 4-15 provided that the said powers, duties and functions may be performed by authorized representatives of the Building Official and under his supervision and control. Article 3. Uniform ,~ign Code Adopted Section ~-17 Uniform Sign Code adopted. 99 There is hereby adopted for the purpose of establishing rules and regulations to promote the development of better sign construction, and to provide minimum standards to safeguard life, health, property and public welfare, by regulating structural requirements for all signs and sign structures located outside of buildings, that certain code known as the ,,Uniform Sign Code", 1973 edition, of the International Conference of Building Officials, except for such portions as are hereinafter deleted, modified or amended; and the same is hereby ~dopted and incorporated ss fully as if set out verbatim herein. 4-18 Building Official. The nuilding Official of this City shall have the powers, duties and functions prescribed for the "Building Official" by the Uniform Sign Code adopted by Section 4-17; provided that the powers, duties and functions may be performed by authorized representatives of the Building Official and under his supervision and control. 4-! 9 Section 304 amended - Fees. Sec. 304 of the Sign Code adopted bv"~{~ Attic leis amended to read as follows: "Permit fees shall be computed according to the valuation of the construction and erection of each sign in accordance with Table No. 3-A of the Uniform Building Code, adopted by K.C. 8.01.010." (Ord. 260 §1, 1975.) Article 4. Uniform Mechanical Code 4-2 0 Uniform Mechanical Code adopte~d. There is hereby adopted for the purpose of establishing rules and regulations for the installation and maintenance of heating, ventilating, cooling and refrigeration systems, that certain code known as the "Uniform Mechanical Code", 1973 edition, of the International Conference of Building Officials, including Apandix "1~", except for such portions as are hereafter deleted, modified or amended; and the same is i:e~eby adopted and incorporated as fully as if set out verbatim herein, ford. 260 §1, 1975.) 4 - 21 Buildin~ Official. The Building Official of this City shall have the-'~p'~e~s, dut~ies and functions prescribed for the "Building Official" by the Uniform Mechanical Code adopted by 8.04.010; provided that the po-:..ers, duties and functions may be performed by authoriz0d representatives of the Building Official and uz,der his supervision and control. (Ord. g{~0 "' 1975.) 4- 22 Section 304 amended - Fees. Sec. 304 of the Mechanical Code adopted by th{~ Chapter is amended to add the following; 100 "If a buildinff pei'mit is issued, these fees shall be connidered as paid as a part of such permit fee. If no such building permit is t~,sued, then the fee schedule set forth herein shall apply." (Ord. 260 §1, 1975.) Article 5. Uniform Plumbing Code. 4-25 Uniform Plumbtn[~ Code adopted. There is hereby adopted for the purpose of establishing rules and rcgulatiom~ for the qualification of persons engaged in the business of plumbing and the installetten, alteration or repair of plumbing systems, that certain hound volume known as the "Uniform Plumbing Code," 1970 edition, of the Inernational A~,_ ciatien of Plumbing and Mechanical Officials, except for such portions as arc be~'etnafter deleted, modified or amended; and the same is hereby adopted and incorporated as fully as ff set out verbatim herein. (Ord. 260 91, 1975.) 4-24 Section 1.1 amended - Administrative authority. Sec. 1.1 of the ~-lu-m-'~n~ Code adopted by this Chapter is amended to read as follows: "Whenever the term administrative authority is used in this Code, it shall be construed to mean the City Manager of the City of Kenai, or his authorized representative." (Ord. 260 §1, 1975.) 4-25 Sc~tion 1.2 amended - Assistants. See. 1.2 of the Plumbing Code adopted by this Chapter is amended to read as follows: "Whenever the terra "assistants" is used in this Code, it shall be construed to mean any author-ized representative of the City Manager of the City of Kenai.' (Ord. 260 §1, 1975. ) ,4-2(~ , Section 1.3 amended - Jurisdiction. Unless otherwise provided for by law, the office of the administrative authority shall be part of the Administrative Department. (Ord. 260 §1, 1975.) 4-27 Section 1.12 amended - Fees..qee. 1.12 of the Plumbing Code adopted by this Chapter is amended to add the follewing: "If a building permit is issued, the~e fees shall be considered as paid as 101 a part of such permit fee. schedule set forth herein shall apply." ford. 260 ~!, 1975.) If no such building permit is issued, then tho. fee 4-28 Section 201(c) amended- ~tnl~num ~anch~rds. Sec. 201(c) of the Plumbing Code adopted by this Chapter is amended to add the following: 'AB$ and PVC pipe, commonly referred to as "plastic pipe", shall be used only above the basement floor." (Ord. 260 91, 1975.) 4- 29 Table A amended - Plumbing material standards. Table A of Chal~ter 2 of the Plumbing Code , adopted by this Chapter, is amended by deleting therefrom the following: fa) "Homogenous bituminized fiber drain and sewer pipe." .~b) "Poiyeihylene building supply (water service lines)(installation)." (c) "Polyethylene pipe (building supply)." ford. 260 §l, 1975. ) 4-30 Section 506 amended - Vent termination. See. 506 of the Plumbing Code adopted by this Chapter is emended to add the following: "(f) No vent which extends above a roof shell be smaller than two inches in diameter." (Ord. 260 §1, 1975.) 4-31 Section 1004fa) amended - l~atertals. Sec. 1004fa)of the Plumbing Code adopted by this Chapter' is amended to add the followinlaI: *'When copper is used for water service pipe, it shall be Type 'K'. Water service pipe shall have thaw wire connected at the wat~i, main, and brought to the surface at the curb stop or other convenient location. Such wire shall not be smaller than 2/0AWG." (Ord. 260 91, 1975.) 4-32 Section 1010 added - Air chambers. The Plumbing Code adopted by this Chapter is amended by adding Sec. 1010, which shall read as follows: "Sec. 1010 - Air Chambers. Air chambers o~ other approved mechanical devices shall be provided to reduce w~ter hammer to such an extent that no pressure hazard to the piping exists." (Ord. 260 § 1, 1975.) Article 6. Fire Protection Code 4-33 Fire Protection 8tandaz'ds adopted. There is hereby adopted for the purpose of establishing fire prevention standards the following: 102 (a) 1~ AAC 50 (b) 13 AAC 51 (e) 13AAC 52 (d) 13 AAC 55 (e) That ce~tain bound volume known as the "Fire Prevention Code," 1970 edition, of the American Insurance Association, except for such portions as are hereinafter deleted, modified or amended; and the same are hereby adopted and incorporated as fully as if set out verbatim herein. (Ord. 260 §1, 1975.) (f) Th/t certain set of bound volumes known as the "N~ional Fire Codes", 1975 edition, of the National Fire Protection Association, except for such portions as are heretn~ter deleted, modified as amended; and the same are heeeby adopted and incorporated as fully as ff set out verbatim herein. A~ti~le 7. National Electrical Code 1975 4-34 National Electrical Code adopted. There is hereby adopted for the purpose of establishing standards gove~ming the installation of electr/cal conduetors~ fittings, devices and fixtures, hereinafter referred to as "electrical equipment," within or on public and private buildings and premises, that ee~atn code known as the "National Electrical Code," 1975 edition, except for such portions as ere hereinafter deleted, modified or amended; and the same is he~'eby adopted and incorporated as fully as if set out verbatim herein. (Ord. 250 §1, 1975.) 4-35 Wh'ing requLuements. (a) No electric wirin{ for light, heat or"~-°Wer ~hall be installed hereafter in a building or a structure, or on any premises, nor shall an alteration or extension of an existing electric wiring system be made, except in conformity with the provisions of this Chapter and the provisions of the National Electrical Code. (b) All electric wiring and other electrical installations shall be performed by experienced and capable eleciricians. (Ord. 260 § 1, 1975.) Electrical permit required - Application. (a) I~o person, firm or corporation shall commence the installation, alteration, extension or repair of any electric wiring system, without first obtaining; a permit for the work from the Building Official. 103 (b) to be performed, the type of building and the purpose for which it is to be used. (Ord. 260 §1, 1975.) Applications for permits shall state the intent and scope of the work 4- 57 .Inspections. (a) The building official shall, during the installation of an electric wiring system, make the necessary inspections to assure compliance with this Chapter. (b) No work in connection with an electric wiring system shall be covered or concealed until it has been inspected and approved by the Building Official. (e) The Building Official may order work to be stopped at any time, should it be determined that it is not being carried out in accordance with the provisions of this Chapter, or is a menace to the safety and welfare of the public. It is unlawful for any person, firm or corporation to proceed with such work after a stop~ordor has been issued unless the restriction is lifted and authorization to proceed has been given by the Building Official. (Ord. 260 §1, 1975.) 4-58 Section 310-5 amended - Minimum size of conductors. The first sentence of Sec. 310-5 of the Electrical Code adopted by this Chapter is amended to reed as follows: "Whether solid or stranded, conductors shall not be smaller than No. copper or No. 6 aluminum or copper-clad aluminum." (Ord. 260 § 1, 1975. 4-39 Section 410-73 amended - Lighting systems. Sec. 410-73 of the Electrical Code adopted by this Chapter is amended by adding Subsection (D, which shall read as follows: "Slimline flourescent fixtures shall not be used." (Ord. 260 §1, 1975.) 4-4 0 Fees. Permit fees shall be considered paid as pm't of the building permit fee. If no such building permit is issued, then the fees shall be computed according to Table No. 3-A of the Uniform Building Code adopted by K.C. $.01.010. (Ord. 260 §1, 1975.) Art icl.e 8. Enforcement .4 -41 Board of Appeals. In order to provide for final interpretation of the provisions of this Title and to hear appeals provided for hereunder, there is hereby established a Board of Appeals consisting 104 of five members who are not employees of thc City. The Building Official shah be ~n ex officio member of and shall act as Secretary to said Board. The Board shall be appointed by the Mayor and shall serve at his pleasure. The Board may adopt reasonable rules and regulations for conducting its business and shall render all decisions and findings in writing to the appellant with a copy to the Building Official. (Ord. 260 §1, 1975.) 4-4 2 Penalty. Any person, firm or corporation violating any of the provisions of this Title shall be guilty of a misdemeanor, and each such person shah be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this Title is committed, continued or permitted, and upon conviction of any such violation, such person shall be subject to punishment by a fine of not more t.han one hundred dollars.
