IVUEREAS, the penalities and interest charged by the City of lenat for delinquent assessments, utility payments or other charges are not presently established on a uniform basis, liE IT ENACTED BY TIIE COIIb/CIL OF TIlE CITY OF KENAI, ALASKA: Section 1 - The Code of the City of Kenat, 1963, as amended, is hereby further amended to add Section 1-50 to the Code to read as follows: Penalty and Interest Section 1-50 (a) Whenever a penalty charge for late payments on utilities charges, or assessment charges or any other charge of the City shall be due the City of Kenai, such penalty rate shall be computed in the amount of ten percent (10%) on the total sum due. (b) lqhenever interest is due on unpaid accounts or charges or assessments of any kind to the City of Kenai, the rate of such interest shall be computed at the rate of eight percent (8%) pel' annum. (c) Unless otherwise .qpecifted, a penalty charge shall be due on any sum or charges or payments not paid to the City within the first twenty-five (25) days after due date. Section 2 - The Code of the City of Kenai, 1963, as amended, is hereby further amended to add Section 16-16 to the Code to read as follows: Interest and Penalty .o.n I~elinquent Assessment Paymen~t.s. Section 16-16. Failure to pay an assessment before delin- quency shall result in imposition on such assessment payment, of a penalty charge of ten percent (10%) of the amount due and the assessment and penalty shall ,Iraw interest at the rate of eight percent (8%)per annum. ............... ~,,~ ~ ~,,e City of Kenai, i963, as amended, is hereby further amended to add Section 17-76, after repeal of the existing Section 17-75, to read as follows: Penalty for I,ate Payment of IVater or Sewer Bill Section 17-76. Failure to pay a water or sewer bill for services in full by the 25th day of the month, following the · first day o£ each month, shall result in n penalty char~.,.e on the amcunt due. S~ctton 4 The administrative s~aff of the City is directed to publish notice of this evac~aent tn at least one newspaper o~ general circulation in the area and (2) alert all persons or b, qtnesses paying regular accounts to the Cit~ of the enactment of this penalty. Finance Director Chen requested preparation of a general penalty provision in Kenai's Code of Ordinances because of variations presently existing in the Kenai Code. One example of variations is the water and sewer penalty charge of 5% (Code Section 17-75). The electrical p~nalty Code Section 17-22 D -- should not be utilized at all and its repeal is provided tot in the proposed ordinances. The attached proposed ordinance is hereby £orwarded for your consideration. Other sections having penalties might be found in the Kenai Airport regulations which authored pursuant to Code Section 17-25 through 17-34. An additional penalties section is Kenai Charter 9-3 which deals primarily with criminal penalties. An effective date will have to be selected. It can not be the 1st day of Jan uary 1974 unless this ordinance is passed as an emergency or.-~inance. After consultation with Finance Director Chen the effective date has been established on the 1st day of February, 1973.
