The proposed communications tower would be constructed at 6576 Kenai Spur Highway (parcel 04106115) and be 150-foot in height. The tower would be used for wireless communications and would accommodate Verizon initially as a provider and later offer a location spot for collocation by additional providers. ANALYSIS Kenai Municipal Code 14.20.255 details City requirements for Communications towers and communications antennas. Kenai Municipal Code 14.20.255(c)(1) states the City Planner may permit a communications tower in zones where it is a Principal Permitted Use, provided that the applicable Code requirements of Kenai Municipal Code 14.20.255 – Communications towers Page 2 of 5 and communications antenna(s) are met. The proposed tower location is on a parcel within the General Commercial (CG) Zone. Kenai Municipal Code 14.20.010 Land use table states that within the CG Zone, a communications tower is a Principal Permitted Use. Kenai Municipal Code 14.20.255 – Communications towers and communications antennas(s) The following conditions as outlined in Kenai Municipal Code 14.20.185(d) must exist before issuing a Communications Tower Permit:  Kenai Municipal Code 14.20.255(c)(4)(A) - Location and Visual Impact. The proposed communications tower/antenna or accessory structure will be placed in a reasonably available location which will minimize the visual impact on the surrounding area and allow the facility to function in accordance with minimum standards imposed by the applicable communications regulations and applicant’s technical design requirements. STAFF FINDINGS: The communications tower is proposed to be within the General Commercial (CG) Zone of the City on a parcel with frontage along the Kenai Spur Highway. Immediately adjacent parcels are vacant with the parcel to the east having infrastructure for the Homer Electric Association. This location will not impact the viewsheds of neighborhoods or commercial businesses along the Kenai Spur Highway. The tower has been designed for eventual collocation with multiple carriers using the tower and will reduce the need for several separate towers within the City.  Kenai Municipal Code 14.20.255(c)(4)(B) - Inability to Locate on an Existing Structure. The applicant must show that a proposed communications tower/antenna and equipment cannot be accommodated and function as required by applicable regulations and applicant’s technical requirements without unreasonable modifications on any existing structure or tower under control of the applicant. STAFF FINDINGS: The applicant states that Verizon is unable to locate on any existing infrastructure within the City to expand their network.  Kenai Municipal Code 14.20.255(c)(4)(C) - Necessity for Location in a Residential District. Applicant for a permit in a residential district must show that the area cannot be adequately served by a facility placed in a nonresidential district for valid technical reasons. STAFF FINDINGS: The communications tower is proposed to be placed in the General Commercial (GC) zone. There permit will not place a communications tower within a residential district.  Kenai Municipal Code 14.20.255(c)(4)(D) - Location on public property or other private property not suitable. Prior to consideration for a permit for location on private property which must be acquired, applicant must show that available publicly owned sites, and available privately owned sites occupied by a compatible use, are unsuitable for operation of the facility under applicable communications regulations and applicant’s technical design requirements. STAFF FINDINGS: The applicant states that no towers are within 1,000 feet of the Page 3 of 5 proposed tower site. The applicant has provided maps of anticipated coverage with the new communications tower in place and how it will improve connectivity within the City of Kenai. There is not a suitable alternate site on public or private property and the proposed site is in alignment with surroundings containing other utility infrastructure.  Kenai Municipal Code 14.20.255(c)(4)(E) - Design for Future Use. The applicant must show that a new communications tower is designed to accommodate additional communications antenna(s) equal in number to applicant’s present and reasonable foreseeable future requirements. STAFF FINDINGS: The tower is being constructed 150 feet in height. The application states that this height will allow for collocation of additional carrier infrastructure.  Kenai Municipal Code 14.20.255(c)(4)(F) - Safety Code Met. The applicant must meet all applicable health, nuisance, noise, fire building and safety code requirements. STAFF FINDINGS: The drawings submitted thus far meeting applicable health, nuisance, noise, fire building and safety requirements. The applicant submitted drawings and renderings prepared by qualified engineers showing the proposed tower design. The materials are professional with care taken to address safety. The drawings show a proposed 50-foot x 50-foot chain link fence that is 8-feet in height in order to limit unsafe or casual access to the site. The applicant must obtain a building permit from the City prior to construction approval and the applicant notes that construction drawings will be signed and stamped by an engineer on their application. The site is approximately 4 miles (21,120 feet) from the Kenai Municipal Airport, a sufficient distance to comply with Kenai Municipal Code 14.20.255(d)(1)(F), which places height limitations on towers near Kenai Municipal Airport. The applicant has stated that the tower will be designed to crumple instead of topple in the event of catastrophic failure of the structure.  Kenai Municipal Code 14.20.255(c)(4)(G) - Paint. Towers and attached antennas must be painted or coated in a color that blends with the surrounding environment. Muted colors, earth tones, and subdued hues, such as gray, shall be used. All associated structures such as equipment buildings, including the roofs, shall be painted with earth tone colors unless otherwise required under KMC 14.20.150 or by State or Federal law or regulations. STAFF FINDINGS: The applicant has submitted photo simulations of the proposed tower that display it in gray paint. The tower assimilates into the surrounding environment which already has telephone poles/wire, a cleared fenced area, and infrastructure belonging to Homer Electric Association on the adjacent parcel.  Kenai Municipal Code 14.20.255(c)(4)(H) - Distance from Existing Tower. A permit for a proposed communications tower within one thousand feet (1,000') of an existing communications tower shall not be issued unless the applicant certifies that the existing tower does not meet applicant’s structural specifications and applicant’s technical design requirements, or that a collocation agreement could not be obtained. STAFF FINDINGS: No other tower is within 1000 feet of the proposed communications facility. Page 4 of 5  Kenai Municipal Code 14.20.255(c)(4)(I) - FCC Rules. The applicant must show by certificate from a engineer properly licensed in the State of Alaska that the proposed facility will contain only equipment meeting FCC rules. STAFF FINDINGS: Construction drawings will be signed and stamped by an engineer. Signed and stamped drawings are a condition of approval with the expectation that this condition will be met concurrently with the building permit approval.  Kenai Municipal Code 14.20.255(c)(4)(J) - Application of Zoning Rules. Land development regulations, visibility, fencing, screening, landscaping, parking, access, lot size, exterior illumination, sign, storage, and all other general zoning district regulations except setback height, shall apply to the use. Setback and height conditions in this section shall apply. STAFF FINDINGS: The applicant complies with general zoning district regulations of the CG Zone. As outlined in Kenai Municipal Code 14.20.120(a), the intent of the CG Zone is, “to provide for areas where a broad range of retail, wholesale, and service establishments is desirable. Uses are regulated to concentrate commercial development to the greatest extent possible and to prevent any uses which would have an adverse effect upon nearby properties”. The setback requirement for a 150-foot communications tower is 150 feet from all sides. However, the City of Kenai Planning and Zoning Commission approved of a variance reducing the setback requirements for a 150-foot communications tower to 75 feet from all sides with Resolution No. PZ2020-21. An 8-foot fence will surround the communication tower infrastructure on all sides.  Kenai Municipal Code 14.20.255(c)(4)(K) - Setback. In all zones, a communications tower must be a minimum distance equal to the height of the communications tower from all lot lines. No variance from the setback requirements of this section may reduce the minimum setback distance to below a distance equal to fifty percent (50%) of the height of the tower from a lot line. STAFF FINDINGS: The applicant obtained a variance from the City of Kenai Planning and Zoning Commission with Resolution PZ2020-21. The variance granted a reduction equal to 50% of the height of the tower from the lot line, reducing the required setback from 150 feet from all lot lines to 75 feet from all lot lines. With the approved variance, the applicant’s plans meet the required 75-foot setback.  Kenai Municipal Code 14.20.255(c)(4)(L) - No advertising is permitted of the communication tower with the exception of identification signage. STAFF FINDINGS: The applicant stated on their application that no advertising will be used.  Kenai Municipal Code 14.20.255(c)(4)(M) - No signs or lighting shall be mounted on a communications tower except those reasonably needed for safety purposes or as required by the Federal Communications Commission, Federal Aviation Administration or other government agency with jurisdiction. STAFF FINDINGS: The applicant stated on their application that no signs or lighting will be mounted on the tower as specified. Page 5 of 5  Kenai Municipal Code 14.20.255(c)(4)(N) - The communications towers shall be secured by a fence with a minimum height of eight feet (8') to limit accessibility to the public. STAFF FINDINGS: The application drawings show a chain link fence 8-feet in height surrounding the 50x50 foot area expected to be used for the communications tower. DECISION City Administration finds that the applicant meets the criteria for issuance of a Communications Tower Permit as set forth in Kenai Municipal Code 14.20.255, subject to the following condition: (1) Applicant must comply with all Federal, State and local regulations, including obtaining a Building Permit from the City prior to construction and complying with terms of the variance granted under Resolution No. PZ2020-21 for setback requirements. (2) Prior to obtaining a Building Permit, the applicant will provide the City with a report from a structural engineer registered under AS 08.48 in the State of Alaska showing the communications tower/antenna capacity by type and number, and a certification that the tower/antenna is designed to withstand winds in accordance with the latest revision of ASI/EIA/TIA/222 standards (“Structural standards for steel communications antenna towers and communications antenna supporting structures”), as required by Kenai Municipal Code 14.20.255(c)(3)(D). (3) Prior to obtaining a Building Permit, the applicant will provide the City with a certificate from an engineer properly licensed in the State of Alaska that the proposed facility will contain only equipment meeting FCC rules, as required by Kenai Municipal Code 14.20.255(c)(4)(I). (4) Prior to obtaining a Building Permit, the applicant will sign a written agreement, on a form approved by the City Attorney, to remove the communications tower/antenna(s) within one hundred eighty (180) days after the communications tower/antenna(s) is substantially unused for a period of twelve (12) consecutive months, as required by Kenai Municipal Code 14.20.255(c)(3)(I). (5) Prior to obtaining a Building Permit, the appeal period for the setback variance granted by Resolution No. PZ2020-21 must expire. Vertical Bridge is proposing a new 150' Wireless Communications Facility at 6576 Kenai Spur Hwy. The WCF will be within a 50' X 50' Lease Area to accommodate Verizon as the initial carrier and have room to include space for additional. carriers in the future . This site is located .in the CG -General Commercial zone, which is a preferred location for new towers. The site will be screened from the neighboring properties and the publi c road. Due to setback lim itations, we will require a variance to achieve the height needed to allow for network coverage as well as co-location capability.
