CITY OF KENAI - ORDINANCE 211 -72 A~ENDINO ~IE KENAI CODE AS AMENDED, TO CONFOR~ TO A.S. 29.53.020 FOR PROPERTY TAX EXEMPTIONS, PROVIDING FOR AN EFFECTIVE DATE, AND DECLARING AN EMERGENCY · HEREAS~ Chapter llS, SLA 1972 incorporated into Alaska statutes a section conmonly known as the "~{unicipal Code" and in such section there is provision for property tax exemption for citizens age 6S or older for relief from taxes and reimbursement of the exempted reven- ues by the State of Alaska.to political subdivisions; BE IT ORDAINED BY THE COUNCIL OF TIlE CITY OF KENAI, ALASKA: SECTION 1. Kenai Code, 1963, Section 7-3 is hereby repealed and reenacted to read as follows: Senior Citizens Tax Exemption. Section 7-3. Th~ provisions of A.S. 29.53.020 (a) (6), A, S, 29.$3.020 , and A. S. 29.S3.020 (i), are hereby incorporated herein by reference as though..se~,forth verbatim herein. SECTION 2. Kenai Code, 1963, as amended, is hereby further amended to repeal and re-enact section 7-4 to read as follows: Procedure for Applying for Exemption. Section 7-4. T~eprocedure for applyin§ for the exemptions provided for herein in Section 7-3 of this code shall be accomplished as provided in A. ~. 29.$3.020 (f). SECTION 3. Kenai, Code 1963, as amended, is hereby further amended to add the following provision: Direction to Apply for State Sub!id~z~ Sect,~ v-$. Pursuant to A.S. 29.53.020 (g) (h) and (i) ~ ,re eve y,,,of revenues lost through tax exemption is provided for and the administration i~ hereby dlr~ctea to make such applications '~or take ~uch actions as may be required in order to secure the reimbursement £or revenues ~hich may be lost by A.S. 29.S~.020 (a) and (6) Kenal Code, 1963, as amended, is hereb~ £urthar amended to add the foll~wing provision: ~xDmptton of State augumented. Section 7-$. If a person qualifying for an exemption from property tax pursuant to ^. S. 29.53.020 (a} does not receive an exemption of a value of Two llundred Fifty Dollars ($250.00} then the city shall exempt such person for taxes up to the total sum of Two tlundred Fifty Dollars ($250.00) SECTION 5. ienai Code, 1963, ag amended, is hereby further amended to add the following provision: Disabled Persons Exem~ti!n. Section 7-6. One (1) piece of residential property owned and Occupied by a citizen . dis- abled within the meaning of the provisions of the U.S. Social Security Act and found to be totally disabled by administrators thereof, who is a resident of the City of Kenai, Alaska, shall be exempt from so much of such property tax levy by the City up to and including the sum of $250 providing such Citizen is head of the household and providing that not more than one exemption shall be allowed on any one piece of real property. This exemption is not automatic, but must be applied for prior to the lSth day of January during the year which such citizen is qualified. The first year for qualification pursuant to this enactment shall be the calendar year 1973 and the dead- line for applying shall be not later than the lSth day of ~anuary 1973. Application shall be made in the same fashion as provided for senior citizens of 65 years of age or more. SECTION 6. EbIERGBNCY DECLARED. An emergency is hereby declared to exist and the rules governing int,~rduction, reading, passage and approval of ordinances are hereby suspended and this ordinance shall be effective the first day of January, 1973.
