That Section 14. 3 of tn~ Kenai Code, 1963, as a~ended, shall have subparagraph (b) thereof, repealed and be reenacted to read as (b) Act as advisory board for the genai Peninsula Borough Planning Commission on platting and subdivision of lots, blocks, or land within the city limits. All proposed plans, plats, or replats of lorn, blocks, or lands within the City limits, and all streets, alleys and other portions of the sat,e intended tc be dedicated to public or private use within the corporate limits, shall first be submitted to the commission for its approval or rejection; and before such plans, plats, or reolats shall be fo~,~arded for Kenai Peninsula Borough Planning Commission approval. In exe[cising the powers granted it by this section, the Planning Commission shall prepare and recommend for borough adoption, regulations governing the subdivision of land w~thin the C~ty limits. Such regulations may provide for the harmonious development of the City and its environs, fo~ the coordination of streets and other ways within ~he stubdivided land with other existin~ or planned ways or for conformance to the master plan or official map, for adequate open space, for space for traffic, utilities, recreation, lights, and air, and for the avoidance of congestion of population. Section 2. That the ~enai code, 1963, as amended, Section 14-13 is hereby repealed and is reenact,d to read as follows: Sect{on !4-13 .'.:;ach subdivider r~f land should confer with the borough planning department before preparing a prelim~ inary s~3division plan in order to become thoroughly familiar with the st~division requirements and with the .proposals of the City Plan affecting the territory in which th(,. proposed :~ubdivts} o_n lies. Section 3. That the Kenai (:ode, ].963, as amended, Section 14-14 is he~uby repealed and in lieu th(~reof, tl.e following provision shall be enacted. Section 4. Section 14-15, :~ub~;aragraph (a) theruof :~hall be reDealed and the following provision shall be reenacted to read as follows: Jurisdiction and Prodecure Section 14-15 (a) It shall be unlawful for any person being ~e owner, agent, or person having control of a~y land within the City of Kenai to subdivide or lay out such land in lots unless by plat, in accordance with the regulations contained herein. A preliminary plat shall first be submitted to the Kenai Peninsula Borough planning department for study. There copies will be furnished by the borough to the City of Kenai, who shall r~ke recommendations to the Borough Planning Co~mission. Section 5. Section 14-16 of ~enai Code, 1963, as amended, shall be repealed and in lieu thereof the following provision shall be reenacted as follows: rata Required Up_~n Preliminary~_an_d_~A_nA~_~A Section 14-16 There is hereby incorporated herein by reference the applicable provisions of Ordinance 26 of the Kenai Peninsulasula Borough, which are also identified as Section 20.15.045 and Section 20.15.060 of the Code of Ordinances of the Kenai Peninsula Borough, as maended prior tO or as amended hereafter. Section 6. Section 14-17 of the Kenai Code, 1963, as amended, iS hereby re~euled and reenacted to read as follows: Filinq Fe~ Section 14-17 The preliminary plat shall be accompanied by a fee in the amount of $0.50 per lot and shall not exceed $25.00. Section 7. Section 14.-18 of KeDai Code, ].963, as amended, ie hereby repealed and reenacted to read as follows: Submission tq.~it__y- Council Section 14-18 ~ftor review of the final plat by the City Planning Commission, such final plat, together with the re~ommendatio~a of the Commission, shall be submitted to the Borough Planning Commission for approval. If the City Planning Commission rejects or withholds approval of a plat, the subdivider may r=quest said plat be submitted to the City Council. The secretary of the City Planning Co~ission shall fo~;ard the proposed plat, together with the report of the City Planning Commission, stating the reason or reason~ for the action takan. The City Council may make such findings and determinations as are deemed proper. If either a preliminary or final plat is disapproved by the City Planning Commission, it mav be aeproved by the City Council. Seetion 8. Section 14-19, Kenai Code, 1963, as amended, ~lbsection (d) (1) thereof is hereby repealed and hereb~ reenacted to read as follows~ (d) Blocks (1) No block shall be longer than 1400 feet.
