WHEREAS, it is deemed necessary and advisable and to the best interest of the City of Kenai, Alaska (hereinafter called the "City"), and its inhabitant~, that the City construct and equip a concrete municipal office-civic center building composed of a 2-story central building and two 2-story wings, on property owned by the City, with but not limited to City administrative offices, a public library, Cou~cil chambers, Fire and Police Department and other municipal activities, and to provide the funds therefor that it issue its unlimited tax levy general obligation bonds in the principal ~nount of $1,000,000; and WHEREAS, this Council is considering two different sites for the location of said municipal office-civic center building and desires the opinion of the qualified electors of the City as to the location thereof; and WHEREAS, the Constitution of the State of Alaska and the Charter of the City require that the que;~tlon of whether or not such bonds may be issued,for such purposes must be submltt(;d to the qualifies electors of the City for their ratification or rejection; NOW, THEIdCFOId';, BE IT OHDA1NI.';D b:t bt](; Council of the 'Clt:/ of Kenal, Alaska, as fo] lows: .S_c_~;b_l_9.n- ~_. IL ta here*by £ou~l(t arid declared that. thc public health, vl~:.lfare, :;afety and convenlerme require the City to carry out. the plans hereinafter provided. · Section 2, For the purpoze of providing funds neces:~ary to construct and equip a concrete municipal office-civic center building composed o1' a 2-story central bulldlm; and tv:o 2-story ~lngs on property owned by the City, ~ith but not limited to City administrative offices, a public library, Council chambers, Fire and Police Department and c thor municipal activities, the City shall issue and sell its unlimited tax levy general obligation bonds in the principal amount of $1,000,000. Section 3. For the purpose of determining the site upon which such municipal offic~-civic center building shall be located, the quali- fied electors of the City shall be given the choice of whether such building shall be constructed on one of the following two sites: a. At the south end of the Old Runway on City-owned land (Airport land), or b. On the north side of the Kenat Spur Highway across from Walker Drive on City-owned land (Airport land). Section 4. 1'he above-mentioned bonds shall be sold at not less than par ~nd accrued interest to the date of delivery and in such amounts and at such tt~e op times as deemed neces~y and advlsable by this Council and as pe~itted by law, shall bea~ interest payable semiannually at a rate not to exceed the maximum rate permitted by law at t~e time of the sale thereof, and shall mature serially tn such amounts and at such times in not to exceed thirty years fror~ date o~ issue as later authorized by this Council, Both principal of and tnte~ost on ~;uch bond~l i~hall be payable out of annual tax levle:~ to be made upon all the taxable property ~ithln the City ~lthout limitatlor~ as to rate or' a~,o,ml.. Said propositions shall be in the following form: PROPOSITION NO. 1 MUNICIPAL OFFICE-CIVIC CENTER BUILDING gENERAL OBLIGATION BONDS, $1,000,000 Shall the City of Kenai, Alaska, for the purpose of providing funds necessary to pay the cost of constructing and equipping on property owned by the City a municipal office-civic center building with facilities for, but not limited to, municipal offices, a public library, council chambers, fire and police departments, and other municipal activities, issue its general obligation bonds in the principal amount of $1,000,000, said bonds to bear interest at a rate not to exceed the maximum rate permitted by law at the time of any sale thereof, to mature in not to exceed 30 years from date of issue, and to be paid both principal and interest from annual tax levies to be made upon all the taxable property within the City without limitation as to rate or amount, all as more specifically provided in 'Ordinance No. 157-69, adopted February 19, 19697 BONDS, YES ....... /__7 BONDS, NO ....... /-7 PROPOSITION NO. 2 LOCATION OF MUNICIPAL OFFICE-CIVIC CENTER BUILDIN0 SITE In the even~ Proposition No. 1 above carries, shall the City construct and equip said municipal office-civic center building on City-owned land (Airport land) on either A. They must be citizens of the United States, and for at least one year preceding the election citizens of the State of Alaska, and for 30 days immediately preceding the election residents of the City of ~enai, Alaska. c. They must be able to read and write the English language, as p~escribed by law. d. They must not be barred from voting by any other provision of law. e. They must be registered in the manner Prescribed in Sections 6-3, 6-~, 6-5, 6-6, 6-?, and 6-8 of the Kenai Code, 1963. f. Their names must appear on the latest tax assessment roll of the Kenai pen~n~la Borough, as prepared for, and applicable to, taxes for purposes of general municipal taxation of the City of Kenai, pursuant to Section 6-2, Kenai Code, 1963. Section 7. For elector or voter registration the book will be open daily in the office of the City Clerk, City Administration Building, Kenai, Alaska, from 8:00 o'clock A. M. until 8:00 o'clock P. M. daily, except Saturdays, Sundays and holidays. Registration shall be closed five days preceding the said special election. A duplicate registration index shall be furnished by the City Clerk-Registrar to the precinct Judges and clerks of the election. Section 8. Notice of this special election shall be puoiished once a week for not less than three consecutive weeks in a newspaper of general circulation in the City, and the firs~ publication thereof shall be not less than twenty days prior to said election date. Said notice shall be published in "Th- Cook Inlet Courier" which is hereby deter- mined to be a newspaper of general circulation within the ~*" Notice of this special election shall also be posted on the official City bulletin board in or on the City Administration Building and in two other conspicuous places within the City. Section 9. The designated polllni~ places will be the City Administration BuildinG, and the Kenal Airport Te~ninal Building. Said polls shall be open from 8:00 o'clock A. M. to 8:00 o'clock P. M. on the 18th day of March, 1969. Section 10. Section 11. An emergency is hereby declared to exist, and the rules governing the introduction, reading, passage and approval of this ordinance are hereby suspended and this ordinance shall be effective immediately upon its passage and approval. Publi~ation of this ordinance shall be made by posting a copy thereof on the City Council bulletin board for a period of ten days following its passage.
