I~IEREAS, tn order to provide the City of Ken·t, Alaska (herein·ftc1' called the "Cl~y"), 1ts inhabitants, and people living tn the vicinity the~of ~iCh ~ adequate supply of ~at~r fo~ all p~poses ~t Ls deemed necessa~ ~d advisable Chat the City acquJ.~e, eo~t~mc~ ~d 1nstall certaln additions ~d ~mp~ovements Co and ex- tensto~ off t~s eate~ supply ~d dlst~1butlon system, and to provide part or all off the f~ds the~efo~ ~hat It tssue 1ts unlimited tax levy ~ene~al obll8atton bond~ tn the p~tnclpal ~ount of $150,000; and ~HERBAS, in o~der to further ~he health and welfare of the City a~d its 1nhabttantm and tn order to provide the same wlth a proper and e£flclent system of sanitary ~e~age collection and disposal 1t t6 deemed n~cessary and advisable tha~ the Clty acquire, construct and lnstall ce~tain additions and improvements to and extensions of its sanlta~ sew·se collec~ion and disposal system, and to provide part or all of the ~unds therefor that it issue its unlimited tax levy general obligation bonds 1n the principal a~ount of $100,000; and WHEREAS, in order co pro.vide the City with an adequate street system it is deemed necessary and advisable that the City construct certain capital improvements to it~ existing ~trect ~y~tcm, ~nd t~ provide par~ or all of the funds therefor that it Issue lt~ unlimited tax levy 6end,al obligation bonds in the principal a~ount off $150,0.00; and ~EREAS, the Constitution off the State off Alaska and the Charte off the CIty require that the questions off whether or not such bonds may be issued for such purposes must t~e submitted to the qualified electors of the City for their ratificatlc~n or rejection; NOt~, THBREFOBE, BE IT ORDAINED by the Council of the City of Kena~, Alaska, as follows: Section 1. It ts hereby found and declared that the public health, welfaze, shfety and convenience require the City to carry out 'the plans hereLnaffter provided. Section 2. For the purpose of prov~ding funds necessary to pay par~ or all of the costs of acquiring, constructing and developing adequate ~ate~ store~e f:scilities and water sources and for contribution toward the a~sess~..ent p~ogra~s of ~he C~ty for additions and improvements to and extensions off the water supply and d~tributior~ system, the C~ty shall issue and sell its unlimited tax levy general obligat~on bonds in the p~nc~pal amount of $150,000. Section ~. For t~ej~r1~ose of prov~ding £~nds necessary to pay part or all off the co~t~ o:£ contribution toward the assessment programs of the C~ty for additions and improvements to and extensions of the sanitary se~age collection and d~sposal system, the City shall issue and sell its unlisited tax levy general obligat~on bonds ~n the prtnc~pal a~ount of $100,000. Section ~. For the purpose of providin~ funds necessary to pay part or all oF the costs of ~rad~n~, £~ll~n~, ~u~facin~ and pav~ng st~eet~ throushout the City ~here deemed necessary and also co~$t~uct- ~n~ and ~ns~all~ng gutters and curbs where deemed necessary (~omet~me~ in conjunction ~th assessments lev~ed ag~nst propertie~ benefited by such ~mprovements), the C~ty shall issue and ~ell its unlimited tax levy general obltgat~on ~onds ~n the pr~nc~p21 a~ount of * acqu~Hng, constmct~ng and ~nstall~ng certain cap~tal ~mp~ovements to ~ts san~taryse~a! collection end disp~al system and for ~ctLon ~. To carry out the above-described plans of provements the City shall acquire all real and personal property, easements,.rl~hts of way, and water rlEhts necessary therefor. Part of the costs off each of the above-described plans of improvements may come from assessments, Erants, or other moneys which the CIZy m~y now or later have on hand and available for such purposes. Upon determination of the amounts of money available from such sources other than the proceeds of the sale of such bonds, the Council shall determine the specific improvements to be acquired, constructed and installed. Section 6. The bonds .of each ~ssue shall be sold at not less than par and accrued interest to the date of delivery and ~n such a~ount~ and at such time or times as deemed necessary and advisable by this Council and as permitted by law, shall bear interest payable ~emiannuall~ at a rate not to exceed the maximu~ rate pe~nitted by law at the time of the sale thereof, and shall mature serially In such amounts and at such times in not to exceed thirty yea~s from date of issue as later author- ized by this Council. Both princ~pal of and interest on the bonds of each ~ssue shall be payable out of annual tax levies to be made upon all the taxable property within the City without limitation as to rate or ~uount, and fro~ such other sources (such as assessments) as Council may hereafter legally provide. The exact date, fo~m, terms, maturities and covenants of said bonds shall be as hereafter fixed by ordinance o~o ordinances of this Council. Section ?. The propositions of whether or not the City shall issue said bonds for the purposes described in Sections ~, ~ and hereof shall be submitted to the qualified electors of the City at a special election to be held therein on March 18, 1969. Section 8_. T~ose eligible to vote at said special election must possess the following qualifications: a. They taus~ be at least 19 years off age. b. ~ey mu~ be c~t~zens off the Un,ted 3tares, ~d for at le~s~ one ye~ pPecedg~ ~he elect~on c~t~zens off the State of Alaska, ~d fop 30 ~ys ~ed~ately preceding the elect~on residents of the City off Kenai, Alaska. c. They m2$t be able to read and write the English language, ~s preflcrAbed by la~. by d. They must not be barred from voting/any other provision of law. e. They must be registered in the manner prescribed Sections 6-3, 6-~, 6-~, 6-6, 6-?, and 6-8 of the Kenai Code, Pen, a Borough, as prepared for, aha .~pp~ca~e of the Kens! ~aXes for purposes of general municipal taxation of the City of Kenai, pursuant to Section 6-2, Kenai Code, 1963. Section 9. For elector or voter registration the book will be open daily in the office of the City Clerk, City Administration Buildin~, Kenai, Alaska, from 9:00 o'clock A. ~. until 5:00 o'clock p. ~. daily, except Saturdays, Sundays and holidays. Registration shall be closed five days preceding the said special election. A duplicate registration index shall be furnished by the City Clerk-Registrar to the p~ecinct Judges and clerks of the election. Section 10. Notice of this special election shall be publishe~ once a week for not less than three consecutive weeks in a newspaper of general cfrculation in the City, and the first publication thereof shall be not less than twenty days prior to said election date. Said notice shall be published in "The Cook Inlet Courier" which is hereby dete~ine, to be a newspaper' of ~eneral circulation within the City. Hotice of this special election 8hall also be posted on the official CLty bulletin board in or on the City Administration BuLld~n~ and ~n two other conspicuous places within the City, 8ectLon ll. The desi~nated polling places will be the C~ty Adm~nlst~ation BuildLng, and the Kenai A~rport Terminal Building. Said polls shall be open ffrom 8:00 o'clock A. M. to 8:00 o'clock P. H. on. the 18thday of March, 1969. Section 12. An emer&ency ~s hereby declared to ex,st, and the rules ~ove~ntng the Introduction, reading, passage and approval of this ordinance are hereby suspended and thts ordinance shall be effective immediately upon its passage and approval.
