IMPROVEMENT DISTRICT WITHIN THE CITY OF KENAI FOH THE PURPOSE OF

WHEREAS, it has been ~etermined and ratified by the Council
that the public health, welfare, safety and convenience require con-
struction and installation of a water supply improvement district,
WHEREAS, the costs of the construction contemplated within
the said improvement district are being assisted by Federal Grants
of money which provide not less than ~ % of the total insta]ied
cost of the said systems, and
WHEREAS, the said Federal Grants provide a fixeo amount so
that the costs required to be paid by the benefitted property shall
include only those which have exceeded the available grant funds,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA:
Section 1. That Water Supply & Distribution System District
No. 2 for the constructin~ and installation of ~dded facilities to the
municipal water supply and distribution system is hereby established
and designated, consisting c~~ the following areas:
All of the real property indicated on those certain
plat and plans, funded by bonds authorized ~.n 1R67,
and on file in the office of the City Clerk of Kenai,
Alaska, said plat being specifically incorporatee by
reference herein.
Section 2. COSTS TO BE ASSESSED. The costs to be assessed
shall consist of, but not be limited to, not less than all that amount
which shall be require~,to pay for construction and installation of
the said District No.~ exclusive of all such costs as may be paid
by Feceral Aid Grants made to the said City for the specific purpose
of installation of the said improvements. Such assessments for the
non-grant portion shall be for the cost of the work, acquisition of
right-of-way, and such other costs as are attributable to the instal-
!atlon, initial equipment for maintenance and contingency expenses
of said improvements, but not necessarily limited to those items
enumerated herein, and shall be at the expense of the owners of the
land fronting thereon and benefit;ed$$ thereby for each parcel of land
within Improvement District No.~sp~ciall~ benefitted shall be
assessed for the square footage there~ t'~ ~a-~--o~~~'-7/

Section 3. PLANS - SPECIFICATION. The plans and speci-
flca~;ons for the installation and construction of improvement D~.strict
No.~a~e on file with the City of Kenai. The construction to serve
the benefitted properties indicated on the plat of the said improve-
ment district, said plat, plat plans and specifications of the district
are hereby ratified and approved.
Section 4. All the property included within said district
is hereby designated as the property specially benefitted by the said
improvements as conforms to criteria guiding assessment roll to be
approved by this ordinance. A list of the tracts of benefitted ~"eal
property and the statement of the cost of' the improvements is on
file in the office of the City Clerk, City of Kenai, and are open
for inspection.
Section 5. The improvements contemplated hereby have had
total costs compiled and complete cost will be born by the land
included within the sa~d district and benefitted thereby, except for
grant funds previously received. The assessment for such costs shall
be payable as to principal, interest and penalty as specified by
resolution of the council. Such costs shall not include the portion
thereof paid for by Federal Grants to facilitate construction of the
project contemplated.
Section 6. PUBLICATION. This Ordinance, after passage,
shall be published at least once in the Inlet Courier and shall be
posted in not less than three public places within the City of Kenai
and such publication is hereby designated as public notice to all
persons concerned with the nature, extent and approximate cost of the
improvements and costs to be assessed against the properties bene-
fitted thereby. Notice is hereby given to all persons concerned and
any property affected by the said assessment for the improvement dis-
trict that public hearings have been held and due notice thereof
received by all interested parties.

~ 3. After passage on first reading ordinance must be posted on City bulletin
heard with notice o£ date, ~i.~¢ and place £or public hearin8 and second and
£inal readinG. This publication, by posting, shall be done 5 days prior to
public hearing, (An ordinance may be adopted on £irst reading provided an emer-
gency is declared by unanimous consent of the Council and interested part/so
are given ~n opportunity to be heard.)
4. A£te~ public hearing, ordinance may be adopted with or w£tlmut amend-
merits. The second passage of ordinance is £1nal and no further passage is
required.
