HomeMy WebLinkAboutORDINANCE 0112-1967i. ~TAINI~ IN E~ FOR A L~ITED ~RIOD C~AIN ~OVISIONS OF ~ SA~ ~ ~DI~S~ ~ ~ CITY OF ~I, ~EALI~ ~E~IONS 2-2~ ~~ ~ ~I~ ~~R TO BE EFFE~I~ AS TO ~LL F~RSONS ~VI~ ~N~D FIll ~RTS ASD ~AID TA~ DUE AND TO ~ T~ ~AL BE~ FIll A~ TO ALL Cll't ~A~S T~ A~GRITY ~N i~INING THeE DELINQ~ SEL~RS ~ BEEN DISheD OF F~Ii~R L~BILITY AND PR~IDING FOR AN EF~I~ DATE, WHEREAS, the City o£ Kenai, b7 its O~dJnance No. ~-65 r~as ratEf£ed and acqulesed fot~ally in the exercise of taxing power authorized pursuant to AS 07.l~.310, by the Kenai Peninsula Borough, but such action t~ not sufficiently clear to repeal C~ty taxln~ authority, and k~ItEREAS, certain portions oi the code relating to sale~ taxes £ormerly collected by the City of Kenai should ba repealed, but such repeal should not be accomplished until all sellers have ~ade the required reports, and k3iBREAS, the authority presently existin8 in the ~enaJ Code, 1963, should be retained to the extent required for an equitable conclu~£~'l{ of the City claims asainst three delinquent taxpayers may b~ accomplished. NO~ THEREFORE, be it ordained by the Council of the City of Kenai, Alaska: Section 1. That sO much of the repeal of the provisions of the Code o£ tbs City o£ K~naf, 1963,*as set £orth in Sectlon 2., as may be necessary to be retalued in order to provide adequate authority £or col- lection of remainini delinquent tax payers, are hereby ratified and con° tim~ed tn full force and e£fect until the conclusion of such collection has be<,n accomplished through voluntary payment and settlement, or by the appropriate court actions as may be initiated or indicated, in order to accomplish £inal and equitable collection £rom all sellers. Section 2. Subject :o the saving provisions Sections 7o25, 7-26, 7-27, 7-2~, 7-29, 7-30, 7~31, 7-32,L~-~, ~-~, 7-~c, ~:2, '? ~, ? ~7of the Code of the City o£ Ker~!, 1963, are hereby repea l;,d. to Section 3. That it £s the intent of this ordinance/be sure that all p~rsons required to perform pursuant to the above-cited ordi~mnces shall be equitably treated and that such equitable treet~ent sh~!l consist of keeping in full ~orce and e~£ect the authority of the above-cited pro- visions of the Renal Code, 19~,3, until the renmining delinquent ~ellers have paid or other~ise settled their presently undischarged obligations pursuant to the Le~.
