AN O.~D~L~NCE of the City of Kenai, Alaska
providing for the submission to the
qualified electors of the city at a
special election to be held therein on
October 29, 196~, of two propositions:
the first, of whether or not the city
should issue its water revenue bonds in
the principal sum of $100,000 to provide
part of the funds necessary to construct
t4e first stage of a municipal water
supply and distribution system for
city; the second, of whether or not the
city should issue its sewer revenue bonds
in the principal sum of $75,000 to provide
part of the funds necessary to construct
the first stage of a municipal sewage collec-
tion and disposal system for the city; and
declaring an emergency.
~s, to further the health and welfare of the
inhabitants of the City of Kenai, Alaska it is deemed necessary
and advisable that the city construct the first stage of a
mu~lcipal water supply and distribution system for the city
and to provide funds to pay part of the cost thereof that the
city isoue and sell its water reve,~ue bonds in the principal
s,Am of $!00~000; and

inhabitants of the city it is also deemed necessary and ad-
visable that ~he city construct the first sta~e of a municipal
sewage collection and disposal system for the city and to pro-
vi~e funds to pay part of the cost thereof that the city issue
and sell its sewer revenue bonds in the principal sum of
$75,000; and
';~E=~J'~$, the eon-~t,,tion and laws of the State of
Alaska provide that the questions of whether or not suca bonds
may be issued for such purposes must be submitted to the
qualified voters of the city for their ratification or re~ection;
NOW, TH~FORE, BE IT (~INED by the City Council
of the City of Kenai, Alaska as follows:
Section 1. It is hereby found and declared that tho
public health, welfare, safety and convenience require the city
to carry out the plans hereinafter provided.
Section_ 2. The city shall construct the first stage
of a municipal water supply and distribution system for the city
consisting of two wells complete ~l~h c~lorin~tors, water stor-
age tanks, well houses, pumps, hydro-pneumatic tanks, and auto-
m~tlc controls, water ~ins, valves, fire hydrants~ appurtenances
and related street repairs to serve properties abutting streets
listed in the Schedule of Improvements of 23 September, 1963,
prepared by the engineers for the city and now on file with
the Clerk thereof.
The city shall construct the first stage of the muni-
cipal sewage collection and disposal system for the city con-
sistiug of collector sewers, cleanouts, manholes, one pneumatic
ejector lift station, interceptor sewers, sewage treatment
facilities, outfall sewer and appurtenances, together with
necessary street restoration caused by such construction,
serve properties abuttin~ the streets listed in the Schedule
of Improvements of 23 September, 1963, prepared by the engi-
neers for the city and on file with the Clerk thereof.
If the funds available will not per.it the construc-
tion and installation of all of the above described improve-
ments, or if anticipated government grants for the construction
of said improvements arc not obtained or are reduced, then such
portion thereof as may be found to be most necessary umder all
~ne cxrcums~ancos by the Ci~ C~ac£1, upon the advice of
engineers, shall be a,~Qui~ed, constructed and installed.
Section ~. The bonds of e~ch issue shall be sold in
such amounts at not less than par p!~s accrued interest to date
of delivery and ~t such time or times as found to be necessary
and as permitted by law, shall bear interest at a rate of not
to exceed 6%per tnnum and shall mature at such time or times
withtu thirty (~0) years fro~ date of iss,~e as the City Council
may hereafter determine.
Both principal of and interest on the water revenue
bonds shall be payable solely out of revenues of the w~ter
system of the city.
Both principal of and interest on the sewer revenue
bonds shall be payable solely out of revenues of the sewer
system of the city.
The exact date, form, terms, maturities and covenants

The proposition of whether or not the city shall issue
said revenue bonds for the purposes described in Section 2
hereof shall be submitted to the qualified voters of the city
for their ratification or re~ection at a special election to be
held within the city on October 29, 1963.
Said proposition shall be in the following forms:

Shall the City of Kenai, Alaska for the purpose of

Section #. Those eligible to vote at said special
election ~uet possess the following qualifications:
They must be at least 19 years of age.

They must be able to read and write the English
language, as prescribed by law.
d) They must not be barred from voting by any other
provision of law.
e) They must be registered in the manner prescribed
in Ordinance No. ~ of the City of Kenai.
Section ~. Registration shall be required as a
qualificat~-~ of voters at this special election as provided
in Ordinance No. ~ of the City of Kenai. The registration book
will be open daily in the office of the City Clerk, City Admin-
istration Building, Kenai, Alaska, from 9:00 o'clock A.M. until
5:00 o'clock P.M. daily, except Saturdays, Sundays and holidays.
Registration shall be closed five days preceding the said
~pecial election.
A duplicate registration index shall be furnished by
the City Clerk-Registrar to the judges and clerks of the election
at the precinct,
Section 6. Notice of the election shall be published
once a week for not less than three consecutive weeks and the
first notice thereof shall be published not less than twenty
(20) days prior to said special election. Said notices shall
state the time of closing of registration and shall be published
in the Cheechako News which is determined to be a newspaper of
genercl circulation in the City of Kenai, Alaska.
Notice of the election shall be posted at least twenty

within the city.
Section 7. The dei3ignated polling place will be the
City Administration Building for all voters living within the
city limits of the City of Kenai,-~aska. Said polls shall be
open from 8:00 o'clock A.M. to 8:00 o'clock P.M. on the 29 day
of October, 196~.
Section 8. The following qualified voters of the city
are hereby appointed to serve as Judges and clerks at said
special election:

and the rules governing the introduction, reading, passage and
ordinance shall be effective immediately upon its passage and
approval,
Publication of this ordinance shall be made by posting
a copy hereof on the City Council bulletin board for a period

WHEREAS, the constitution and laws of the Stats of
Alaska provide that the questions of whether or not such bonds *
