ALASKA This Zoning Ordinance is enacted for the purpose of promoting health, safety, morals, comfort, and General Welfare. It is enacted to conserve and protect property values, to secure the most appropriate use of land, and to facilitate adequate but economical pr~visions for public improvements. This Ordinance is in accordance with a Comprehensive Plan and contributes to The desirable future development of the City, provides a mernod of administration, and prescribes penalties for the vioi~tion cf provisions hereafter described. .'H3.~$, ~ 29.10.21~- 29.10.2~3 empowpr~ the Ci=~ ro enac~ a Zoning Ordinance and to provide f~r m~s adminis~ra=ion, enforcement, and amendment; and .h£2~S, the City Council has established a City Planning Comnission and appointed it as the Zoning Commission; and .;H~.~2m.$, the City Council deems it necessary, for the Tur~osc of promoting the health, safety, morals, or general ~eif~re, =o enact a Zoning Ordinance; and .::g;(Z~.-$, the City has adopted a long-range City Plan =o ~'~de ~nd facilitate orderly and beneficial growth of ~he Community; and ',~£EZAS, =he City has adopted a Comprehensive Study and based ~ Zoning Ordinance on it to serve as a most important ~o. achieving such orderly and beneficial community ~row~h; ~nd '..'F~REAS, a Zoning Ordinance is necessary in order to Dromo~e ~e health, safety, morals, and general welfare of =he City for its immediate and future growth period; and .~J=~,~S, the City Planning Commis~ion and City Council ~mve :~dcp=ed a Comprehensive Plan and other pertinent factors ~ec=ssary =o the preparation of a Zoning Ordinance: ';~W, THEREFORE, BE IT ORDAINED by the Council of the City :f ?:ena~, Alaska: vi rITLE~ YZ2~OD 0F.~FECTIVE~ESS. A. This Crdinance shall be kno~m and may be cited as the Zoning Ordinance of the City of Kenai, Alaska. B. 2his Zonin~ Ordinance shall remain in force until repealed. C. This Ordinance becomes effective one month after date of APPLiCATIC:[ OF REGULATIONS. The regulations set by this Ordinance within each district shall be minimum regulations and shall apply uniformly to each class or kind of structure or land and, particularly, except ~s hereinafter provided: A. .o building or land shall hereafter be used or occupied :nd no building or part thereof shall be erected, moved, :r '~izered unless in conformity with the regulations herein specified for the district in which it is located. B. .:o structure shall hereafter be erected or altered. -. Uc exceed the height; 2. Jo accommodate or house a greater number of families; ~o occupy a greater percentage of lot area; or -. Zo have narrower or smaller rear yard, front yard or side yard than is specified herein for the district i;: which such building is located. ;;o yard or other open space provided about any building for the purpose of complying with the provisions of this c~oter shall be considered as providing a yard or open z~ace for any other building, and no yard or open space :n one lo~ shall be considered as providing a yard or t~en space on any othez, lot. vii ORDINANCE NO. 56 bECTIOH 2~ SEVERABILITY In the event any portion, sec$ion, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction such decision shall not affect the validity of the remaining portions of this ordinance. Truck gardening, the raising of bush and tree crops, flower gardening, and the use of green houses. Home occupations. Accessory buildings and uses not used or operated for gain. Churches, provided that no part of any building be located nearer than 50 feet to any adjoining lot or street line. 7. Required off-street parking. Buildin~ ~i~ht Limit. 1. No limit except where limited by City Airfield Regulations. Lot Area. The minimum lot area shall be 7200 square feet and the minimum lot w~dth shall be 60 feet. The minimum lot area for dwellings shall be: For a one-family dwelling - 7200 square feet per dwelling unit.
