BOATING ACCIDENTS. ' Sec. 0:5.25.250. ACCIDENTS; DUTY OF OPERATOR. The operator of a boat involved in a collision, accident, or casu,alty shall (I) render assist~ce, as is practicable nnd necessary, to save other persons from danger or to minimize the danger to other persons to the extent that the operator can do so without scrious danger to the operator's bant. crew. and passengers; and (2) give thc operator's name and address and identification number of' the opcnttor's boat in writing to each person injured in the COllision..accident. or other casualty and to the owner of' property damaged in the collision, accident, or other casualty. Sec. 05.25.320. APPLICATION FOR IDENTIFICATION NUMBER. (a) The ownc of a boat required to obtain an identification number under AS 0~.2~.300 - 05.2~.450 shall appl: for a certificate of number on a form approved by the department. The application form shal ' be si§ned by thc owner of the boat and shall be accompanied by the fca set by the department '" (b) Upon receipt of thc application in satisfactory form, thc department shall issue to th~ owner a certificate of number stating thc i~t~tification numbcr awarded to thc boat and thc nam, and address of the owner. · (c) The department shall prescribe by regulation the form of application, thc form of certificate of number, and thc manner of rcncwal. Sec. 05.25.330. RENEWAL OF CERTIFICATE OF NUMBER. (a) An application fo. th~: renewal of a certificate of number shall be prepared by the department and mailed to th~ owner of the boat during thc period of the last 90 days before the expiration date of the ccnifi. Sec. 05.25.370. NUMBERING SYSTEM. (a) The identification number consists of the letters AK followed by a combination of four numerals then followed by two letters. (a) A person may not paint, att.,ch, or otherwise display a number on either side of the bow of a boat other than the idcntif'ic..,tion number awarded to the boat. ISSUANCE OF CERTIFICATES OF NUMBERS; AGENTS FOR DEPARTMENT. (a) Thc department may issue a certificate of number directly or may authorize a person to act as its agent for issuing certificates. An authorized agent may issue ccrtificatcs o£ number that are valid as if issued dirccdy by thc department. (b) Att authorized agent who is authorized to issue certificates of number shall execute a performance bond of not less ihan $1.000 in favor of the department. Sec. (}5.25.410. COPIES OF REGULATIONS. Copies of regulations adopted under this ch;q)tcr shall be provided without cost with each certificate of number that is issued. Sec. 0;5.25.420. PROOF OF OWNERSHIP. (a) A certified statement on an application .fOr a6 identification number is the minimum evidence necessary to establish ownership of a boat for the purposes of this chapter. '(b) Liens, including reservations or u'ansfcrs of tide to secure debts or claims, m'e through an action ns a licnholder, may apply for n certificate of number and shall attach nn . affidavit or repossession to thc application for certificate of number. ' · Sec. 05.25.430. CHANGE IN OWNERSHIP INTEREST; NOTICE TO DEPARTMENT. (a). The owner o.f a boat for which nn idehtification itumbcr has been issued in this state shall not,fy thc deportment within 20 days of the dcsu'uctson or abandonment of thc boat or of thc transfer of all or part of the owner's interest in the boat, other than thc creation of a security interest. The notice shall be accompanied by a surrender of the certificate of number. (b) If a boat is dcstroycd or abandoned, thc department shall cancel the ccnit'icatc of number for the bo~K and enter the cancellation in thc department's records. All records of ownership of boats kept by the~'~ · department under this. chapter at~'public records. Sec. 05.25.460. EXEMPTIONS. (a) The following classes of boats are exempt from the provisions of AS 05.25.300- 05.25.450: (1) a boat with a curt'cat, valid certificate of number issued by anothei' state having n federally approved numbering,system that is operated in the state for a period not exceeding 90 consecutive days; (2) a foreign boat operated only temporarily in state water, (3) a boat owned by 'the United States or an'entity or pOlitical Subdivision of the United States, or Owned by a state or an entity ~)t political subdivision of a state; · .= .... (4). a.ship's lifeboat. · (b) The department may exempt a class of boats from AS 05.25.300.05.25.4:50 if the department finds that the numberin§ of that class of boats will not materially aid in identifying those boats. The department may also exempt a boat from AS 05.2:5.300 - 05.25.450 if' the department finds that thc boat belongs to a class of boats that would bo exempt from numbering under the numbering system of a federal agency if thc boat ~vere subject to federal law.
