A.RESOLUTION OF THE COUNCIL OF THE CITY OFKENAI, ALASKA ACCEPTING A
G~ANT FROM THE. STATE OFALASKA, DEPARTMENT OF TRANSPORTATION AND
PUBLIC FACILITIES FOR AIRCRAFT RESCUE AND FIREFIGHTING EQUIPMENT.
WHEREAS, the State of Alaska has offered the City of Kenai a grant in
the ~mount of $12,812.50 or 3.125% of eligible costs for Aircraft
Rescue and Fireftghting Equipment, and
WHEREAS, the State requires that the City accept the grant by
resolution.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF KENAI,
ALASKA, that the City of Kenai accepts thi~ $12,812.50 grant from the
State of Alaska, and the City Manager is authorized to enter into the
grant agreement.
PASSED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, this 6th day of
November, 1991.

Kena! Airport ARFF,,,,EquiPment_ GRANT AGREEMENT
The State of Alaska, Department of Transportation and Public
Facllitles, hereinafter referred to as the "State", and the City
'of. Ke. nal ... , a municipal corporation, hereinafter referre~=to
as' the "NuniCipality',, agree as follows =
1. pursuant to Alaska Statute 02. !5. ~20, the State w~11 grant
matching funds to the Mun~c~pal~t~ for a federal a~d project ~or
~ 2. Until the a~rPort and its facilities are abandoned, the
Municipal~tyagrees that the airport and its facilities will at all
times be maintained as, available for the use of, and accessible
to the general public as a. public airport. The Municipality must
have a satisfactory title interest in the airport as required by
the Federal Aviation Administration (FAA).
3. The State w£11 match Municipality funds up to a
contribut~on by the State of 3.125 percent of the federal aid
project costs found eligible for participation by the FAA or the
maximum state grant amount of $ .12,812~0,
4. The State wiX1 pay the matching funds Ln two or more
Installments. The State w111 make the first payment after receipt
of a copy ofthe grant .agreement signed by the FAA and the
Municipality. The first payment must be 50 percent of the maximum
state grant amounts. In its discretion, the State may make
additiona! payments up to 90 percent of the maximum Statp grant
amount. The State will. make the final payment after the
Nunlc!pal!ty submlts_a .copy of .the FAA!s audlt._.and, final grant...
payment voucher. The final payment must be the amount remaining
for payment by the State of the 3,125--percent of-the federal aid
project cost found ellglble by the FAA o= the remaining 50 percent
of the maximum State grant amoUnt described in paragraph three of
this agreement, whichever is less.
5. The Municipality will indemnify, hold h~rmless, and defend
the State from any claim, action, expense, or liability, including
costs and attorneys fees, from damage or. injury to any person or
property caused by, arising out of, or An any way connected..with
any act, omission, use, occupancy, or operation of the
Municipality, its agents, or employeesl under .this agreement,
including any caused or alleged to be caused tn whole or in part
by the negligence, of the State, its agents, or employees.
~.6. This agreement may only be amended in a writing signed by
the authorized representatives of the State and the Municipality.
Statements previously made, verbal or written, are merged ~n this
agreement. This agreement may not be assignedby the municipality
without the advance written consent of ~he State.
7. ThiS' agreement expires five years 'after ,the e~fective date
this .agreement if the .Munic~palit¥ 'has not submitted
audit- and. final, grant..:pa~ment voucher.to, the state. The state and
the. Municipality may. extend this agreement "by mutual consent. .
