I WHEREA~, it is necessary and desirable ta move the City of s Kenai, Alaska, (the "City") offices from the Kenai Airport ~.__ Terminal Building so that buiiding can be remadelled to ' I provide more space, and more efficient use of that space, ,~ for airport operation; and WHEREAS, to insure efficient operation of the City, it is deemed necessary and advisable that the City construct a capitai improvement referred to herein as a City Administration Buildinq and the City Council has heretotore determined and ~~es r~:eby de~ermine that constructing and equippinq such a capital improvement which is presently estimated to cost $950,000 is in the public in~erest and is required for the welfare and convenience of the public; and WHEREAS, even though the City has determined to build a City Administration Suilding, financing such construction entireiy by cash would deplete cash reserves of the City to a point where other needed capital improvements might be delayed for one to two years; znd a ~:. ;; ,; ~ _, ~. .. ~~- ; ~ t ~ --~~ ~ ,' . WHEREAS, it is in the best interest,s o~ the City that the City issue and sell its qeneral obligations hands in a principal sum not to exceed $40~,OOU or to otherwise incur debt in an amount which does not exceed $400,000 to pay part of the cost of cons~ructing a City Administration Building, so as to leave ample reserves for funding other capital improvements and for gener.al operat,ions of the City; and WHEREAS, the Constitution and laws of the State of Alaska and the Charter of the City of Kenai provfde that the question of wheth~r or not such debt may be incurred for such a purpose taust be submitted ta L•he qualified voters of the City for their ratification. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF TEiE CITY OF KENAI, ALASRA, AS FOLLOWS: . r ~ ~ I~ Resolution No. 80-32 ~; Page 2 ~ ~ ~ Section 1: It is hereby determined to be for a public ~ purpose and in the public interest of the City of Kenai to incur indebtedness cf thE City in an amount not to exceed ( $4Q0,000 for the purpose of paying a portion ot the costs of E ~l~nning, designing, acquiring, constructing, improving, and j aquipping of a City Administration Building capital improve- ~ ment in the City. SecL•i~n 2: A sum not exceedin~~ $400,000 shall be borrowed by, for, and on behalf of the City of Kenai for the aforesaid capital improvement and shall be evidenaed by the issuance of general obligation bond~ or other evidence of ~ ~ debt of the City. The amounts so borrowed shall be used for capital improvements only. The full faith and credit of the I City is pledged for the payment of the principal and interest on the ~onds or other debt instrument, and ad valorem taxes ~ upon a21 the taxable property in the City shall be levied ' without limitation as to rate or amou~~t in amounts sufficient to pay principal and interes~ on the bonds or other debt ' instrument when due. The bends or u~her debt instrument shall bear interest at a rate not to exceed the maximum rate permi~ted by Iaw, and shall mature at such time or times within 30 years from date of issue as the Cit~ Council may hereafter determine. The exact date, form, terms, maturities, and covenants of said bonds or other debt instrument shall be as hereafter fixed by ordinance of the City. Secti~n 3: A special election shall be held on April ! 9, 1980, in an8 for the City of Kenai, for the purp~se of submittincT to the qualified voters of the City for approval or rejection a proposition authorizing the borrowing of ~ money and issuing of general obligation bonds or other such evidence of indebtednEas. A majority in favor of the qualified voters who vote on the proposition is required for approval. ~he proposition shall be in substantiall~~ the following form: PROPOSITION City Administration Building -i. A'f ". !~j Section 6: Registration in advance of the elec~ion ~ shall not be required as a qualification of votets at this ; ~ ~ , special election. Sectian 7: Notice of the election shall be published once a week for not less than two consecutive weeks and th~e first notice thereof sha11 be published not less than twEnty (20) days prior to said special election.
