A RESOLUTION OF THE COTJNCIL OF THL CITY OF KENAI, ALASKA,
AuTHORIZZNG THE CITY MANF,GER TO EXECUTE THE ATTACHED COOPERATIIIE
AGREEMENT WITH THE U.S. SOIL CONVERSATION SERVICE AND AUTHORIZING
THE CITY MANAGER TO AMEI~?D THE EXISTING CONTRACT WITH UNWIN,
SCHEBEN, KORYNTA AND IiUETTL, INC. DATED JULY 30, 1979 TO
PROVIBE F~R TOPOGRAPIiICAL MAPPING OF TEN (10} ABDITIONAL
QUARTk:R SECTION~ AND EYTENDING THE EFFECTZVE DATE OF THE
$2,000 PER QUARTER SECTION COST UNTIL SEPTEMBER 30, 1980.
WHF:iEAS, the U.S. Scsil Con:.ervation Service has offered to
~ay for topographica2 mapping of land within the City of
Kenai in an amount of $20,000, and
WHEREAS, !:here presently exists a ~ontract between the City
of Kenai ond Unwin, Scheben! Korynta and Huettl, Znc.
(U.S.K.H.j which provides for U.S.K.H. ta perform additional
mapping for $2,000 per quarter section upon d~r:!anci by the
City, which price shall be effect.ive until DQCember 33,
1979, and .
WHEREAS, U.S.K.H. has agreed to amend sai8 contrac~ t:a
provide such mapping for $2,000 per quarter section through
September 30, 1980, and
WHEREAS, the (T.S. Soil Conversa~ion Service desires to
utilize the City's existing contract with U.S.K.H. to per-
form the additional map~ing for which it has cffered to pay.
NOW, THEREFORE, $E IT RESOLVED BY THE COiII~CIL OF THR CITY OF
RENAI, ALASRA that:
Section 1: The City Manager be avtharized to execute
the attached Cooperative Aqreement with the U.S. Soil
Conservation Service.
Section 2: The City Mana~er be authorixed to amend the
exist ng~ontract with Unwin, Scheben, Korynta and Huettl,
Inc. dated Ju].y 30, 1979, to provide for topographical
mapping of ten (10) additional quarter sections and extendinq
the effective date of the $2,000 per q~aarter section cost
until September 30, 1980.

between
City of Kenai, Alaska
and the
Soil C~nservation Service
Ilnited States Department of Agricalture
Relative to: Acceleration of flood plain mapping for land use planning
in certain areas of the City of Kenai
Authority: Yublic Law 83-566, 16 U.S.~. (590 a-E)
THIS AGRE~IENT, made and entered into this 21st da~r of February, 1980} by
and between the City of Kenai, Alaska (hereinafter called the "Cooperator") and
the United States of America, acting by and tnrough the Soil Conservation
Service of the United States Department of Agriculture (hereinafter called
"Service").
Parpose:
The Service, in carrying out fts assigned responsibilities under applicable
legislation, has aeed for certain infdrmation that may be obtained as a resti2t
of this cooperation; hss certain resources availabl~, but does not have suf-
ficient resources available to obtain the desired information within the period
specified in this agreement.
The Cooperator, for planning p~srposes, has requested certain ~lood plain infor-
a~ation that is p:esently unavailable, and within the limits c,f ;~s resources, is
willing to obtain the inforwation through their ~cisting concract.
Therefore, both the Cooperator and the Service deem it mutual2y advantageous to
cooperate in this undertaking, and hereby agree as fo2Zec?s~
I. The Cooperator agreess
A. That all information obtained under the terms of this agreement
is public property.
B. 2o comply with the Clean Air and Water Pollution Control. Act, the
nvn sesregation of facilities and EEO provisions Which are attached hereto and
taade a part of this agreement.
C. To obtain aerial photography and topographic mapping in accord-
an~r with Yhe existing contract between ttie City of Kenai and Unwin Scheben
Korynta and Fiuettl consulting engineers.
II. The Service agrees:
A. To provide the Cooperator with a detailed flood plain study of .
the area mapped.

B. To provide the necessacy technical service~, on site assistance,
aud materials to compile a flood plain study rPport.
~• To provide $20,U00 to r.he Cooperator for the photographfc and
topographic mapping.

III. It is mutually understood and agreed:
A. Completion Date - All vork under this agreement is to ~e com-
pleted and in the possession of the Service on or about ~eP7'e...~Q.- 3o i9i~~ ~`~•~
B. Area Covere~ - all tl~t area shown~within the boundaries de-
lineated on the attached sap.
C. Methal of Payment - The Cooperator will bill the ServicP at the
conp7.etion and acceptance of the work.
E. Renewals - This agreement will remain in force until
September 30, 1980. It may t,e affirmatfvely :.enewed each fiscal year by the
parties t~rough an exchange of corresgnn3ence until the purposes of the agreement
are completA, but not ?ater than the end of the fiscal year in which ~he woric is
co:sp~eted.
D. Intent to Cooperate - It is the i.ntent of the Service to fulfill
its obligat~ans under this agzeement. However, commitwents can~ot be ma3e
beyond the period for which funds have been appropriated by Congress. In event
funds £row which the Service may fu..il?. its obligaxi.ons are noti appropriated,
the agreement wi1.1 automatically terminate. Reimbursemenr, will then be for work
comgleted that is otherwise eligible for reimbursement prior ta the effective
date of terminatioa.
F. Modification - This agreement may be modified by amendment duly
exccut~~ ~y aut:sarfzed off;.tials ~L tne Coope.:ator and the Service, provided
such ~odification does not extend the agreement beyond the close o£ tt~e fiscal
year in which the work is completed.
G. Ufficials Not to Benefit - No Member of or delegate to Congress
or Resident Commissioner sha].1 be admitted to any share or part of this agreement,
or to any benefit that may arise therefrom; but this provision shall not be
construed to extend to thi's dgreement if made with a corporation for its general
benefit.
H. Copyright - No reports, maps, or other docwnents produced in
whole ar in part under this agreement shall be the subject of an application for
copyright by or on behalf of the Cooperator.
