Qtl I~tTS This agreement is execut~ hetween the State of Alaska, Oeparbnent of Adr~fnistration, (Het~einafter called the "State"), and City of Kenai (Hereinafter called trie "Grantee"~, WITNESSETH that: Whereas, the Grantee is wiliirtg to undertake the performance af this grant under the terms af this aqreement; Whereas, the State has the authority to enter inta th+s agregnent by AS 37.05.3l5, Whereas, funding for this grant lapses on June 30, 198I XX upan campietiori of the pro.fect, Whereas, tbe grant ~ 8-~5~ of $ 500,000 is for the ' purpose of harbor study and design (please provide further expianatton and detafls in the space ~rcvfded), Engineering design and fessibi2ity study for a small boat harbor in the Kenai river, including administrative supFort services. , i ! .-. NOW THEREFORE, the parties hereto agree as rollows• ARTICLE I. GRANT CON~ITIOriS. The C,rantee • (1) will spend the qrant only for the rx+rposes specified , above. (2) will allow on request. an audit by the State of the uses maAe of the granL. ~ (3} aswres that, ta the extent cansistent with the puraose ~ . of the appropriation. the facilities and services provided with j the grant will he availabte for use of the qeneral puhlic. (4) will return to the State all grant funds received for ~ construction of a oublic facility if the State, upon reviewing ; the documentation provided and other evidence, deterr~ines that ~ substantial , ongoing work on the nroject has not ~equn hefpre'~ay ,_ i 31, 1985. ~ (5~ will, fo r all grants for construction of a oublic facility, ~ operate and maintain the facility for its practical life an~ that i it will not look to the State to operate or mairttain the ~acility ; or pay for its operatfon or mai:~tenance. ~ (6) will provide the State, annuaTTy and within 90 days of . ARTICLE II. TE(~1S ~F PAYMENT. The remainder of the qrant wi11 he paid is a ~~ iump surts 3C' ~ays later untess otherwise requested by the grantee. -. For all grants of SI4A,000 or greater, 2a percent of the arant '; shall be paid to the grantee, as an advance, wittiin 10 days of the "! effective date of thts agreenent.
