F~R+I FOR MUN ICI PAL (~tANTS Th i~ ag reement i s executpd be tween the S tate of A1 a ska , Departrnent of Adr!iinistration, (Hereinafter calted the "State"). and City of Kena~ (Hereinafter called the "Grantee"), WI~(+tESSETH that : Whereas, the Grantee is willing to undertake the performance of this grant under the terms of this agreertient; Wher~as, the State has the authority to enter into this agreement by I1S 37.05.315, Whereas, funding for this grant lapses on June 30, 1981 XX upon canpletion of the pro,iect, i~i'~erEdS, ~he g~a~-i, a 2-029 of $ I~~,Gt, is iur f~se ~ ~urpose of orovidinq addit;onal funds for the construct-. , and furnishing of chiidrens' f~omes,* (please provide further explanatfon and details in tfie space provided), *workshop and office space. These monies wi11 be granted from the Cfty of Kenai to the Renai Peniasula Communfty Care Center to supplement a$250,000 grant to that org,anization awarded by the State of Alaska, Department of Health and Social Services. •- The Kenai Peninsula Communitq Care Center will be responsible to ~khe Ca.ty of Kenai for the proper disbursement of monie~, and to en~ure that monies are spent for the gurgoses stated above. - . ~_ ~ ! ~~~ ~ - - -~.._. : ~ ' . !' ~ -~- NOW THEREFORE, *.he parties hereto ag ree as follows• ARTICLE I. (3) assures that, to the extent consistent with the aurnose of the appropriation. the facilities and services provided with the grant will be avaitab1A for use of the qeneral pvhlic. {4) wi1l re Ulrn to the State all grant funds received for construction of a oublic facility if the State, upon reviewir,g the documentation pravided and other evfdencP, deterr~ines that substantial . onqoinq work on the nroject has not begun t~efore '~ay 31, 1985. (5) will, for all grants for construttion of a ouhlic facflity, operate and mainLain the facility for its practical lffe and :hat it wfll not lo~k to the State to operate or maintain the facility or pay for its operation or riafntenance. (6) will provide the State, annually and within 90 days of proiect completion or fina] payr~nt, whichever comes first, with a"financiai reoort" on a cony of the forrr provided fn exhibit 1. (7) will, ff the grant noney is being paid fn monthly in- stallr~ents, submit a monthly "financial report" on a form as shovin in ezhibit 1. (8) will retain for a oeriod of 3 years after proiect cam- pletion all contracts, invoices, materials, payrolis, personnel records, conditions of enptovr~ent, and other data relatfng to matters covered by the ~rant. :- (9) will reburn a11 unexpended qrant monies to the State within 90 days of pro.fect campletfon. ARTICLE II. TEF~'1S (~F PAYMENT. For all arants of S1nQ,000 or less, 2A percent of the qrant shall be paid to Lhe grantee, as an advance, within 10 days of the effe~~ive date of this aqreer~ent. The renainder of the qrant wi11 Ae paid in a lump sum 30 days laLer unless otherwise requested by the qrantee. For all grants of 51~0,000 or greater, 20 percent of the erant Shall 6e paid to the qrantee, as an advance, within IO days of the effective date of thts agreement. The renainder of the grant will he paid: (1) in ranthly installr.ients equal to the amount of qrant money the grantee expended in the previous month.
