HomeMy WebLinkAboutRESOLUTION 1981-21 s~ .rte CITY OF RENAI RESOLUTION N0. 81--21 i ;~ ;i ~~~ P. -., , A RESOLUTION OF THE COUNCIL OF THE CITY OF RENAI, ALASKA, TO THE BOROUGH ASSEMBLY OF THE RENAI PENINSDLA BOROUGH ADVOCATING THAT THE ASSEMBLY $Y ORDINANCE CREATE A BOt~RD OF EQUALIZATION WITH MEMBERS APPOINTED FOR OVERLAPPING TERMS [iND DELEGATE TO SUCH BOARD THE AUTHORITY TO HEAR APPEALS FROM DETERMINATIONS OF THE BOROIIGH ASSESSOR. WHEREAS, the City of Kenai, like other cities within the Kenai Peninsula Borough, has an interest in securing fair and equal asaCOr~ent valuations on taxable property, both within the City of Kenai and throughout the Borough, and WHEREAS, in the past the Borough Assembly has heard appeals from the Borough Assessor as a Board of Equalization, and many members of the Assembly have no professional expertise in the field of property valuation, and WHEREAS, due to the length of time such hearings consume and the number of members of the Assembly, often members cannot be present during the entire time of hearings and a change of membership during such hearings results in varying valuations between properties of similar nature which result in unequal taxation, and WHEREAS, there are within the Kenai Peninsula Borough ample numbers of appraisers, lenders, real estate brokers and salesmen, and others with expertise fn the valuation of property from whom members could be appointed to a permanent Board of Equalization which would be more knowledgeable in valuations and less subject to political pressures and emotional appeals than the Borough Assembly and would result in better and more equal valuations and consequently more equal tax burdens on the citizens on the Kenai Peninsula Borough, and WHEREAS, AS 29.53.135 provides the authority far the Assembly to appoint such a Board and to delegate to it the authority to hear appeals from the determination of the Borough Assessor and to make adjustments only when there is proof of unequal, excessive, or improper valuation based on facts which are stated in a valid I i J .= {r ~. Resolurion 81-21 written appeal timely filed or proved at the hearing as provided in AS 29.53.140 (c) , NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ~ RENAI, ALASKA, as follows: 1. The Council of the City of Renai, Alaska hereby advocates that the Renai Peninsula Borough Assembly enact an ordinance setting up a Board of Equalization ~~ith rules for its membership and conduct as provided in AS 29.53.135, and 2. The Council further advocates that such Board be small enough fa size so that it would be feasible for its members to be present during all hearings of equalization and further providing ~ that members thereto be appointed for overlapping terms by the " Mayor with the approval of the Assembly from persons who are knowledgeable and have expertise in the field of property Y ~. valuations, and 3. That copies of this resolution be distributed to the Mayor of the P.enai Peninsula Borough, to each member of the ~ ) Assembly of the Renai Peninsula Borough, and to the cities of ~ Homer, Seldovia, Seward and Soldotna.
