PZ08-39 - A resolution of the Planning and Zoning Commission of the City of Kenai, Alaska, recommending to the Council that KMC 14.20.200 (a) Accessory Structures be amended to allow accessory structures in the rear setback and to define one (l j story height. Kebschull reviewed the staff report included in the packet, noting for accessory structures greater than 120 square feet, the rear setback would change from 20 feet to five feet, and one story was defined as 12 feet from the ground to the highest point of the roof. The floor was opened to public hearing. Kristine Schmidt, 513 Ash Avenue, Kenai -- Schmidt spoke in opposition to the resolution, noting setbacks create separation between structures and there were no maximum square footage limits in the resolution. There being no one else wishing to speak, the public hearing was closed. MOTION: Commissioner Brookman MOVED to approve PZ08-39 and Commissioner Romain SECONDED the motion. Kebschull noted the maximum lot coverage was 30 % for rear yards. Commissioner comments included: • Should the resolution be for smaller lots only? • Should the size of the structures be limited? Borough Plainning -- No report. 9-e. Administration -- Kebschull noted city projects completed or in progress and that Larry Semmens would be sworn in as the new Soldotna City Manager on July 15, 2008, and Terry Eubank had been hired as the City of Kenai Finance Director and would begin work on July 28, 2008. STAFF REPORT To: Planning & Zoning Commission Date: June 27, 2008 Res: PZ08-40 GENERAL INFORMATION Applicant: Scott Wehrstein 283-0626 1514 Stellar Drive Kenai, AK 99611 Requested Action: Encroachment Permit -- Rear Yard Setback --15-Feet Legal Description: Lot 22, Block 4, Redoubt Terrace Subdivision Addition No. 1 Street Address: 1514 Stellar Drive KPB Parcel No.: 04713044 Existing Zoning: R5 -Suburban Residential Current Land Use: Residential Land Use Pian: Neighborhood Residential ANALYSIS General Information: The applicant was in the process of constructing a 16' X 10' shed, when he was notified a building permit was required for structures over 120 square-feet. During the review process it was determined the shed encroached into the rear property setback. A 20-foot rear setback is required for structures over 120 square-feet. The applicant is able to meet the 5- foot side setback, but not able to meet the rear setback and have a useable backyard. The applicant advised that this shed is approximately 9'6" high from the ground to the peak. Attached is a site plan of the property showing the location of the shed. KMC 14.20.185 detaiis the definition, intent, and permit application process for Encroachment Permits. Code also lists the review criteria that should be considered by the Planning and Zoning Commission when determining if a permit should be granted. The Commission is to establish that the following conditions exist before issuing an Encroachment Permit: • An encroachment as defined in KMC 14.20.185 (a) exists. "E'ncroachment means any object or structure above or below ground and constructed or located in a manner other than set forth in the Development Requirements Table." The 96i?- square foot shed is being built into the rear setback and meets the definition of encroachment • The encroachment does not encroach upon a Federal, State or City right-of-way 0840 Comment.doc Page 2 or utility easement. The shed does not encroach into aright-of-way or easement. • The issuance of the encroachment permit will not authorize a use which is a not a principal permitted use in the zoning district in which the property is located. The structure is a permitted accessory structure use in the Suburban Residential Zone. • The encroachment is not located across a platted lot line. The shed does not cross a !ot line. Public Works Director: No Comment. Building Official: Approval of this encroachment will not violate the building code. RECOMMENDATIONS Mr. Wehrstein was unaware a building permit was required for structures over 120- square feet. After being notified of the requirement, the applicant immediately applied for a building permit. During the review process it was determined the 16 X 10 foot shed encroached into the rear setback. The applicant is requesting a 15-foot encroachment for asingle-story, 160-square foot, shed built in the rear setback. Structures 120-square feet or less may be built within three-feet of the side or rear lot line. Requiring the shed to meet the rear setback would drastically reduce the useable rear yard. The house sits approximately 35-feet from the front property line and is approximately 45- feet deep. By requiring the shed to meet the 20-foot rear setback there would only be approximately 9-feet between the house and the shed leaving very little useable yard. The property owner has a tree on the east side of his back yard he would like to keep. By allowing the property owner to keep the shed where it is he will be able to have some use of the back yard. After measuring the parcel, the Building Official believes an as-built will not be required for the shed. The Commission is in the process of reviewing the required 20-foot rear setback for accessory structures. The encroachment would meet the guidelines in the proposed resolution recommending an amendment to allow single story accessory structures to be placed up to 5-feet of the rear lot line. The shed measures 9'6" from the ground to the peak. While constructing the shed I was notified I needed to contact the Building Official. Mr. Springer informed me a building permit was required for structures over 120-square feet. I was unaware of this requirement, and immediately completed an application for a building permit. During the review process it was determined the shed encroached into rear setback. • My lot size is approximately 8,712 square feet, and my house was built in 1982. • After measuring the property my front setback was 3S-feet which is 10-feet more than the required 25-feet. I had no control as to the layout of the house on the property. • If I moved the shed 20 feet from my rear lot line it would limit the amount of space between the house and shed. • There is a large tree opposite of the shed that I would like to leave so the shed can't be moved. • By granting me the 1 s-foot rear setback encroachment I could: o Finish the construction of my shed; o Maintain the separation distance between the house and shed and o Still have a useable backyard space. Box 178 Soldotna, AK 99669 Requested Action: Legal Description: Street Address: KPB Parcel No.: Existing Zoning: Current Land Use: Land Use Plan: ANALYSIS Conditional Use Permit -Assembly {Large Fair) Lots 1, 2 & 3, Beaver Bluff Subdivision 4736 & 4760 Beaver Loop Road 04905006 & 04905011 RR -Rural Residential Residential Rural Residential General Information: This is an application to hold an event similar to a fair or farmer's market in support of women in broadcast and a local radio station. The applicant describes the event as, "The Wench's Faire intends to be an opportunity for our community to come together and support not only women in broadcast locally but also public broadcast radio. Located in between Kenai and Soldotna on Beaver Loop Rd, will be free food, music, entertainment and 12 booths for a variety of educational and shopping purposes for the entertainment of those who attend." Attached is a full description of the proposed event. It is noted that licensed and bonded security will be provided and the event will be insured. Port-a- pot~ies and trash containers will be on-site. A drawing attached to the application shows the planned layout for the event. The plan for this year's event is for September 12th and 13th. At this time, there is not a plan to hold a yearly event but the applicant wouldtlike to have that option. In the Land Use Table under Miscellaneous Uses, Assemblies {Large Circuses, Fairs, etc.) are listed as a Conditional Use in the Rural Residential zone. Footnote 15 is listed as PZ08-41 -Staff Repgrt Pagq 2 a requirement for the Conditional Use. Footnote 15 states, "Allowed, provided the following conditions are met: a. An uncleared buffer strip of at least thirty {30) feet shall be provided between said use and any adjoining property in a residential zone. b. Exits and entrances and off street parking for the use shall be located to prevent traffic hazards an the public streets." The proposed location for this event is off Beaver Loap Road. The parcels are zoned Rural Residential. The applicant owns three adjoining parcels containing approximately 6.8 acres. Aerial photographs show a single access to the parcels via a long driveway. There is a large cleared area buffered by trees on all sides of the parcels. It appears there are sufficient trees along the perimeter of the site to meet the required 30-foot buffer. Beaver Loop Road is straight in this area and access to and from the event should have clear visibility. There should not be a traffic hazard created by patrons of the event. KMC 14.20.150 details the intent and application process for conditional uses. The code also specifies the review criteria that must be satisfied prior to issuing the permit. The criteria are: 1. The use is consistent with the purpose of this chapter and the purposes and intent of the zoning district. The RR Zone is intended to provide for low density residential development in outlying and rural areas in a form which creates a stable and attractive residential environment. This is an application for atwo-day event. The use is specifically allowed as a Conditional Use as long as the two conditions in Footnote I S can be met. These conditions are met and it appears that the proposed event should not violate the intent of the zoning district. 2. The value of the adjoining property and neighborhood will not be significantly impaired. This event is a planned fora 2-day period. The value of the adjoining property and neighborhood will not be significant impaired. 3. The proposed use is in harmony with the Comprehensive Plan. The area is designated as Rural Residential in the Comprehensive Plan. The Plan describes the distract as, "The Rural Residential district includes areas that, due to location or site conditions, are hest suited for large-lot single family residential development. Homes in this district typically rely on individual on-site water supply and wastewater disposal systems. Compatible institutional uses such as churches, schools, and daycare facilities may be intermixed if they comply with zoning design guidelines. Small home-based businesses may be accommodated within certain design guidelines. " The Comprehensive Plan provides for developmentpolicies for growth and change in the community (City of Kenai Comprehensive Plan, Page 26). This is an outdoor event, planned for two-days, and does not include any permanent development to support the event. The City of Kenai Police Department and Fire Department were asked to review the application. - Police Chief Kopp advised the department does not have any concerns or objections. He dad add that once an event has been held, they would have a better idea if there are issues that should be considered for any future events. - Fire Chief Tilly advised he did not see any problems since the event is being held on private property. Chief Tilly added that if there is a plan to hold large warming fires, a request should be submitted to the Fire .Department and the .Department would process the burningpermit. 6. Any and all specific conditions deemed necessary by the commission to fulfill the above-mentioned conditions should be met by the applicant. WHEREAS, ,KMC 1.85.060 (Conflicts of interest prohibited) currently regulates conduct of elected and appointed officials and city employees; and, WHEREAS, properly functioning municipal government requires ethical behavior by public officials and employees; and, WHEREAS, •reasonable standards of conduct are needed for elected and appointed public officials and city employees in order to maintain the public's trust in municipal government; and, WHEREAS, the current conflict of interest rules need to be replaced by a more comprehensive set of guidelines far council and commission members and city •.~~,~ employees; and, ~, , `- ---- WHEREAS it is in the best interest of the Cit of Kenai to amend KMC 1.SS.060 and Y .070. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA that KMC 1.85.060 and .070 is amended as follows: 1.85.060 Conflicts of interest prohibited. (a) A municipal officer, appointed commission member, or employee of the City of Kenai may not solicit or receive money for advice or assistance given in the course of their official dutaies for the City of Kenai. (b) A municipal officer, appointed commission member, or employee of the City of Kenai may not represent a client before the City Council for a fee. However, a commission member may represent a client before a commission or the Ci.ty_Councii for a fee if it does not involve a matter that is was before the member's commission. (c) A municipal officer, appointed commission member, or employee of the City of Kenai may not accept a gift, loan, gratuity, or other valuable consideration, or a promise of any of them, with the understanding or agreement, expressed or implied, that he/she will cast a vote or given an opinion, decision, or judgment in a particular manner, in a matter, question, cause, or proceeding which then is or may by law come or be brought before him, or with the understanding or agreement that the officer or employee will, in his/her official capacity, act in a particular manner to produce or prevent a particular result.
