NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, that: Section 1: The water and sewer improvements in the Aliak McCollum area are necessary and of benefit to the properties to be assessed. Section 2: The assessment district has not been objected to by owners of properties bearing 50% ar more of the estimated costs to be borne by property owners. Section 3: An accounting shell be kept of the costs of these improvements, and after all costs are known, the City Manager shall prepare an assessment roll for the improvements. Brown, Finance Director ~° ~ DATE: April 23, 1985 SUBJECT: Aliak/McCollum Assessment District != ,. I am writing this memo because I do not expect to be at the May 1, 1985 Council Meeting. A resolution is before you which forms the assessment district in the Aliak/McCollum area. This is being done in accordance with RMC 16.10.060 and 16.10.070. Theze are two parcels of City-owned land that we expect to add to the final assessment roll. The first parcel is 045-010-13, which lies west of the district. This was omitted from the preliminary assessment roll because the maps I had used had indications that this was owned by the U. S. Government. The Borough tax roll showed uo owner. I have since learned that it is City-owned, and will add it to the final assessment roll. The second parcel is 045-010-03, which lies north of the Spur and south of the line to Baron Park. It is a narrow strip of land along the right-of-way, which I thought was part of the right-of-way. I have since learned that it•is City-owned. That parcel also will be added to the final roll (water only). As of this date, the City still does not have plans and specs for this project, so I am unable to determine the exact area to be assessed to the City. However, I expect that it will add about 310,000 sq. ft. to the water assessment, and about 121,500 aq. ft. to the sewer assessment. The approximate results of this will be: 1) The City's share of water costs will be about $62,500 at 100X, or $31,250 at SOX. 2) The City's share of sewer coats will be about $26,700 at 100X, or $13,350 at 50X. 3) This will tend to reduce all the other assessments indicated on the preliminary assessment roll. Water assessments should be about 8.8X lower than shown, and sewer assessments should be about 4.2X lower. Of course, at a SOX assessment rate, this would only reduce the amount assessed by 4.4X for water and 2.1X for sewer. Page 2 It would have been easier for me to issue a new preliminary assessment roll. But, I believe it could be very confusing to Council and the public to have two preliminary assessment rolls at this point. The relatively small percentage changes indicated above should not affect Council's decision regarding the desirability of the assessment district. I would also like to point out that the Administration recognizes that some assessments may be limited by the 25X Charter limitation. This is simply that no assessment may exceed 25X of the fair market value of the property, after taking into account the work to be done on the project. i have made no effort to estimate fair market value at this time; I will do that when the project is done. The information is not readily available and it should be done at a later date. It has been argued that the City should simply pay for the water extension loop to Baron Park, and omit it from the district. I have discussed this with Public Works, and we feel that tine line should be part of the district: 1) The loop is an integral part of the water improvements. It is of importance to the properties in the district for prrpoaes of reliable supply and water pressure. 2) The City would not construct the Baron Park extension alone. It is only needed in conjunction with the other work, and is therefore caused by that work. 3) It would be difficult (not impossible) to isolate the cost of just that work. 4) RMC 16.05.060 (a) (8) contemplates "water mains" and "water distribution lines" as part of assessment districts. Finally, I believe I should give qou some information on the action you may take on May 1. Below is KMC 16.10.070 in total. 16.10.070 Council Action: After the public hearing is closed, the Council may increase or decrease the scope or value of the improvement, or may delete from the proposed improvement district properties not benefited by the improvement or add properties which would be benefited and shall adopt a resolution directing continuation or termination of the modified improvement district. No change may be made resulting in an improvement district objected to by owners of properties bearing SOX or more of the estimated cost to be borne by the property owners except with the approval of at least six members of the Council. The resolution directing continuation shall find that the improvement is k !~ Page 3 necessary and of benefit to the properties to be assessed, and that it is not objected to by owners of properties bearing SOX or more of the estimated costs to be borne by property owners or, in the alternative, that it has been approved by at least six members of the Council. The findings of the Council are conclusive. The resolution shall further require that an account be kept of all costs of the improvement and that after all coats are known the City Manager shall prepare an assessment roll for the improvement. The resolution shall state the estimated percentage of the costs of the improvement to be assessed against the benefited properties. (Ord ?91) As of this date, the City Clerk has received no objections from property owners. Frankly, I expected objections because the petition for assessment was at 20X. i notified all property owners that the Citq expected to assess at 50X of coat. You may have significant objection at the meeting. If it appears that objections have been made, either in writing to the Clerk prior to May I or st the public hearing, by owners of properties bearing 50X or more of the estimated coat to be assessed, perhaps you should postpone action until May 15 to give me a chance to compute the exact percentage of objection. Brown, Finance Director ,;:,.j DATE: March 25, 1985 SUBJECT: Assessment District - Aliak/McCollum On :larch 19, 1985, the City received a revised petition for a water and sewer assessment district in the Aliak/McCollum area. The petition asked for the assessments to be limited to 20X of actual costs. In addition, as with the first petition we received on February 5, 1985, it is contingent upon the validity of a rezoning petition. The scope of the water and sewer improvements requested by the petition is smaller than that planned by the City. The benefitted lots, as requested by the petition, number 72, Therefore, 36 valid signatures are required. I believe that we have at least 39 valid signatures. The petition appears to be valid, pending the validity of the rezoning petition. You can review the map that is enclosed marked "Planned by City" and see the difference from that "Requested by Petition." The lots that are benefited by the water and sewer improvements, as planned by the the City, number 89, They are listed in detail on the two enclosed printouts. One printout shows legal descriptions, names, and addresses of benefitted property owners. The other printout serves as a preliminary assessment roll. A review of the preliminary assessment roll shows that the City expects total costs of the water and sewer improvement to be about $1,352,000 (excluding .3esign). The City expects to assess 50% of that cost, a* about $676000. Note that this is not what was requested by the petitioners; they requested an assessment of 20X of cost. Page 2 ~ The City Administration concludes that this project is desirable, and urges approval of an assessment district, as is being currently designed, _ ~ at SOY, of cost. The assessed portion is to come from the 1983 bond ;. suthorizati~n. That authorization was for $4,000,000 of assessment bonds, We sold $2,850,000 of the bonds in 1984. That leaves $1,150,000 °: 'c~ available. This project would use $676,000 of these available bonds. -- -'" q The non-assessed portion is planned to be derived from a D.E.C. grant, °~o ~; which has been applied for. The City Administration believes that the prospects of receiving such a grant are good.
