WHEREAS, the Federal Government through the State of Alaska has available construction funds that could be used far the Kenai Community Library Addition, and WHEREAS, the Council of the City of Kenai is the Kenai Community Library governing body, and WHEREAS, the City Manager has the responsibility and authority to act on behalf of the City of Kenai concerning grant applications. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, that the Council authorizes the filing of the application entitled, "Public Library Construction Pro3ect Application for Library Services and Construction Act, Title II Grant," including all understandings and assurances contained therein, and directing and authorizing Wm. J. Brighton, City Manager, to be the official representative to act in connection with the application. It will require the facility to be designed to comply with the "American Standard Specifications for Making Buildings and Facili- ties Accessible to, and Usable by, the P}iysically Handicapped," Number A1i7.1-1961, as modified (41CFR 101-17.703). The applicant will be responsible for conducting inspections to insure compliance with these specifications by the contractor. m. It will comply with Title VI of the Civil Rights Act of 1964 (P.L. 88-352) and in accordance with Title VI of that Act, no person in the United States shall, on the ground of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination under any program or activity for which the applicant receives Federal financial assistance and will immediately take any measures necessary to effectuate Chis agreement. If any real property or structure thereon is provided or improved with the aid of Federal financial assistance extended to the Applicant, this assurance shall obligate the Applicant, or in the case of aciy transfer of such property, any transferee, for the period during which the real property or structure is used for a purpose for which the Federal financial assistance is extended or for another purpose involving t}ie pro- vision of similar services or benefits. n. It will insure that the facilities under its ownership, lease or supervision which shall be utilized in the accomplishment of the i project are not listed on the Environmental Protection Agency's (EPA) list of Violating Facilities and that it will notify the Federal grantor agency of the receipt of any communication from the Director of the EPA Office of Federal Activities indicating that a facility to be utilized in the project is under consider- s ation for listing by the EPA. i r. It will comply with the requirements of Title II and Title III of the Uniform Relocation Assistance and Real Property Acquisition Act of 1970 (P.L. 91-646) which provides for fair attd equitable treatrsent of persons displaced as a result of Federal and Federally assisted programs. ^^ s. It will comply with the standards under the Occupational Safety and Health Act of 1970 in planning for and designing the facility. t. On March 24, 1983, the President signed the Flneryency Sobs Bill into law as P.L. 98-8, a copy of which is enclosed (Attactmer.t 1). This law includes S50 million 5or public library construction to be a9ministered under L~CA Title IZ. The standard Application for Federal Assistance (for Construction Programs), as specified by OMB Circular A-102, Attachment M, (specific approval for use of this form is pendirz,~) is enclosed with the State allocation tables. Instructions for program submissions are attached. You may want to note particularly the instructions ceder Part Iv, Prograr Narrative, for required LSCA sutmissions f` under the Annual Program and the Ipng-range Program. This prograa memorandum is not meant as an all inclusive list of rcaquirsnents with which States must comply in order to receive funds under Pub. L. 98-8. The applicable requirements a.~e stipulated in the statutes art9 regulations noted in section 3(a) below. However, the following steps, roughly in chronological order, provide highlights of procedures for handling construction project applications. . APPLICATIAV PROCEDIJRE.S 1. The State agency provides up-to-date instructional materials, including an application form to applicants for construction grants and provides consultant service as required. 2. The lcica2 applicant submits its application to the State agency on foams and in accordance with directions supplied by States. 3. State agency reviews local application for: (a) Conforncity with the criteria, policies, and procedures in the • State's Lr~rr}-range programs and the following statutes and regulations: ~-. ~ :, - ~:=.-- Page 2 Statutes: P.L. 84-597, as a~+ierrled, LSCA; P.L. 98-8, ca~uronly referred to as the Ffiergency Jobs Bill (See "Program Narrative" under Part IV of the application) Regulations: 34 CFR Part 770, regulations implementing the ISCA; 34 CFR Part 76; 34 CFR Part 74 (Note particularly Subpart P -- Procurement Standards); 34 CFR 75.600-616.
