Cowan Estates KENAI PENINSULA BOROUGH PARCEL NUMBER: 04939055 WHEREAS, the City of Kenai Planning and Zoning Administration finds this plan provides for orderly and safe development within the City commensurate with protecting the health, safety, and welfare of its citizens, and provides adequate and convenient open spaces, light and air in order to avoid congestion of commercial and industrial areas, meeting the intent of Kenai Municipal Code 14.25.010(a) -Landscaping/Site Plan Regulations -Intent (Site Plans); and, WHEREAS, the plan provides for landscaping and/or the retention of natural vegetation in conjunction with commercial and industrial development within the City , meeting the intent of Kenai Municipal Code 14.25.01 O(b) -Landscaping/Site Plan Regulations -Intent (Landscaping Plans); and, WHEREAS, the landscaping/site plan meets performance criteria outlined in Kenai Municipal Code 14.25.040 -Landscaping/Site Plan Regulations -Landscaping plan -Performance criteria; and, WHEREAS, the landscaping/site plan meets performance criteria outlined in Kenai Municipal Code 14.25.045 -Landscaping/Site Plan Regulations -Site plan -Performance criteria. NOW, THEREFORE, BE IT RESOLVED, BY THE PLANNING AND ZONING ADMINISTRATION OF THE CITY OF KENAI THAT THE LANDSCAPING/SITE PLAN IS APPROVED SUBJECT TO THE FOLLOWING CONDITIONS OF APPROVAL: 1. Development of the property will conform to all federal, State of Alaska, and local regulations. 2. The dumpster shall be screened with a sight-obscuring structure made of wood or concrete. If construction of the project has not started within one year of the approval of the landscaping/site plan (July 20, 2022), the approval may be revoked by the Administrative Official after providing at least thirty (30) Day notice unless extended for good cause. 5. Any plants used for landscaping will be appropriate for the climate and not invasive per the Alaska Cooperative Extension Service. 6. All required landscaping as presented in the approved landscaping plan shall be installed within two (2) years of the approved landscaping plan (by July 20, 2023). Cowan Estates Property Address: 1050 Angler Dr. KPB Parcel No: 04939055 Lot Size: 1.41 Acres (approximately 61,420 square feet) Existing Zoning: Rural Residential Current Land Use: Four Cabins Under Construction Land Use Plan: Low Density Residential GENERAL INFORMATION The applicants are in the process of constructing four cabins on the parcel. The City of Kenai issued a building permit to the applicants to construct the four cabins. Their intent is to use the cabins as short-term rentals. Cabin rentals are listed as a conditional use within the Rural Residential zone in Kenai Municipal Code 14.22.010, Land Use Table. KMC 14.20.320 Definitions, defines cabin rentals “Cabin rentals” means the renting out of one (1) or more individual, detached dwelling units or buildings to provide overnight sleeping accommodations for a period of less than thirty (30) consecutive days. Accordingly, on May 12, 2021, the applicant applied for and was granted a Conditional Use Permit for short term rentals by the Planning & Zoning Commission. Page 2 of 3 ANALYSIS KMC 14.25 outlines landscaping/site plan regulations. The intent of these regulations is to provide for orderly and safe development of the City of Kenai and to have landscaping that retains natural vegetation in conjunction with development. The Planning Director deemed the application to be complete and in accordance with KMC 14.25.030 – Landscaping/site plan-Submittal requirements. Performance criteria for landscaping/site plans are outlined in KMC 14.25.040 and KMC 14.25.045. These criteria are reviewed and summarized as follows: • Variety of techniques to address perimeter/buffer/interior/street right-of -way/parking lot landscaping; The applicant’s application and site plan indicate that the natural vegetation has been undisturbed except the driveway and minor cutting to accommodate utilities, driveway and parking areas. The addition of 40 White Spruce, five Birch trees and native wild Alaskan wildflowers will be planted in areas thin in landscaping to bolster vegetation and retain natural landscaping. • A use compatible with surrounding properties; A large number of parcels located along Angler Drive have Conditional Use Permits for Bed and Breakfast establishments, Lodges, Cabin Rentals, and Guide Services. • Additional permits or approvals; The applicant was granted Conditional Use Permit PZ2021-15 for short term cabin rentals. A building permit was issued by the City of Kenai for the construction of the four cabins. • Parking lots must comply with KMC 14.20.250, provides as follows: One (1) per principal dwelling unit and one (1) per guest room or one for every two (2) beds whichever is greater. • Kenai Municipal Code 14.25.045(d)(1) provides that paving of the parking lot is required. Non-Applicable – this parcel does not lie within the area requiring paving. • Snow storage and drainage must be referenced on the site plan; The applicant’s site plan indicates that a 50 x 50 foot area in the Northeast corner of the parcel shall be used for snow storage. • Dumpsters must be screened with a sight-obscuring structure; The application indicates that a Dumpster will be on-site. The dumpster will be located in the northwest corner of the property. Page 3 of 3 • Ingress and egress should route traffic away from residential streets; Access to the parcel is located via Angler Drive. The properties along Angler Drive consists of single family dwellings, bed and breakfast establishments, short term rental cabins, lodges and guide services. • Trees, shrubs, and plants should be appropriate for the climate and not invasive; A large portion of the natural vegetation on the parcel has been retained. Forty White Spruce, five Birch trees, and wild Alaskan wildflowers will be planted to fill in the landscape area. RECOMMENDATIONS Based on the application and a review of the criteria required to approve the landscaping/site plan, the application meets the intent of landscaping/site plan requirements and performance criteria. The plan is approved as submitted with the following conditions of approval: 1. Development of the property will conform to all federal, State of Alaska, and local regulations. 2.
