HomeMy WebLinkAboutResolution No. PZ2021-32CITY OF KENAI PLANNING AND ZONING ADMINISTRATION RESOLUTION NO. 2021-32 A RESOLUTION OF THE PLANNING AND ZONING ADMINISTRATION OF THE CITY OF KENAI APPROVING THE ATTACHED LANDSCAPING/SITE PLAN APPLICANT: James Duffield PROPERTY ADDRESS: 1803 Second Avenue LEGAL DESCRIPTION: T6NR11WSEC31 Seward Meridian KN E1/2 Govt Lot 141 KENAI PENINSULA BOROUGH PARCEL NUMBER: 04314003 WHEREAS, the City of Kenai Planning and Zoning Administration finds this plan provides for orderly and safe development within the City commensurate with protecting the health, safety, and welfare of its citizens, and provides adequate and convenient open spaces, light and air in order to avoid congestion of commercial and industrial areas, meeting the intent ·of Kenai Municipal Code 14.25.010(a) -Landscaping/Site Plan Regulations -Intent (Site Plans); and, WHEREAS, the plan provides for landscaping and/or the retention of natural vegetation in conjunction with commercial and industrial development within the City, meeting the intent of Kenai Municipal Code 14.25.010(b) -Landscaping/Site Plan Regulations -Intent (Landscaping Plans); and, WHEREAS, the landscaping/site plan meets performance criteria outlined in Kenai Municipal Code 14.25.040 -Landscaping/Site Plan Regulations -Landscaping plan -Performance criteria; and, WHEREAS, the landscaping/site plan meets performance criteria outlined in Kenai Municipal Code 14.25.045 -Landscaping/Site Plan Regulations -Site plan -Performance criteria. NOW, THEREFORE, BE IT RESOLVED, BY THE PLANNING AND ZONING ADMINISTRATION OF THE CITY OF KENAI THAT THE LANDSCAPING/SITE PLAN IS APPROVED SUBJECT TO THE FOLLOWING CONDITIONS OF APPROVAL: 1. Development of the property will conform to all federal, State of Alaska, and local regulations. 2. At such time as a building and/or buildings are constructed on the parcels, the applicant will obtain a Building Permit from the City of Kenai prior to construction and occupancy of any buildings shown on the site plan. 3. Prior to issuance of a Building Permit, the applicant must submit a Landscape/Site Plan Resolution No. PZ2021-32 Page 2 of 2 meeting KMC 14.25.030 -Landscaping/site plan requirements, detailing plans for parking, snow storage, drainage, dumpsters, and any proposed landscaping on the parcels . 4. A driveway permit is required from the City of Kenai Public Works Department. 5. No snow may be stored in such a manner that could block visibility for ingress and egress to the parcel. 6. If the clearing and grubbing has not started within one year of the approval of the landscaping/site plan (August 4, 2022), the approval may be revoked by the Administrative Official after providing at least thirty (30) Day notice unless extended for good cause. 7. Any plants used for landscaping will be appropriate for the climate and not invasive per the Alaska Cooperative Extension Service. Reviewed and approved this 4th day of August, 2021. STAFF REPORT TO: Planning and Zoning - File FROM: Ryan Foster, Planning Director DATE: August 4, 2021 SUBJECT: PZ2021-32 – Landscaping Site Plan Administrative Approval Applicant: James Duffield 1610 Tanaga Avenue Kenai, AK 99611 Submitted By: James Duffield 1610 Tanaga Avenue Kenai, AK 99611 Requested Action: Landscaping/Site Plan Approval Legal Description: T6NR11WSEC31 Seward Meridian KN E1/2 Govt Lot 141 Property Address: 1803 Second Avenue KPB Parcel No: 04314003 Lot Size: 1.25 Acres (approximately 54,450 square feet) Existing Zoning: General Commercial Current Land Use: Vacant Land Use Plan: Mixed Use GENERAL INFORMATION The ap plicants are proposing grubbing and clearing the property and constructing a gravel pad site. ANALYSIS KMC 14.25 outlines landscaping/site plan regulations. The intent of these regulations is to provide for orderly and safe development of the City of Kenai and to have landscaping that retains natural vegetation in conjunction with development. The Planning Director deemed the application to be complete and in accordance with KMC 14.25.030 – Landscaping/site plan-Submittal requirements. Page 2 of 3 Performance criteria for landscaping/site plans are outlined in KMC 14.25.040 and KMC 14.25.045. These criteria are reviewed and summarized as follows: • Variety of techniques to address perimeter/buffer/interior/street right-of -way/parking lot landscaping; The submitted site plan illustrates the required 10 foot buffer of natural vegetation, landscaping beds, or planted trees/shrubs along the City street rights-of-way on Second Avenue and Haller Street. The Kenai Spur-Highway is owned and maintained by the Alaska Department of Transportation, it is recommended the applicant contact the Alaska DOT regarding any buffer or landscaping requirements they may have along the Kenai Spur Highway. • A use compatible with surrounding properties; Adjacent parcels to the east and west are zoned General Commercial. The parcel to the north, across Second Avenue is zoned Suburban Residential. The Kenai Spur Highway is located to the south of the subject parcel. • Additional permits or approvals; When the parcels are further developed a Building Permit and Landscape/Site Plan must be obtained from the City of Kenai. The Fire Marshal for the City of Kenai must also approve of the occupancy of the building. A Conditional Use Permit may also be required depending on whether the intended use is a permitted or conditional use. • Parking lots must comply with KMC 14.20.250, provides as follows: There are not any parking lot requirements for the current improvements to the parcels. At such time as the parcels are further developed, a Landscape/Site Plan must be submitted to verify that the parking requirements are being met. • Kenai Municipal Code 14.25.045(d)(1) provides that paving of the parking lot is required. Non-Applicable at this time – further development of the property will require paving. • Snow storage and drainage must be referenced on the site plan; The applicant indicates that drainage will occur toward the front of the lot; there is a ditch with natural drainage. When the parcels are further developed a Landscape/Site Plan must be submitted detailing the plans for snow storage and drainage. • Dumpsters must be screened with a sight-obscuring structure; Dumpsters are not required at this time. When the parcels are further developed a Landscape/Site Plan must be submitted detailing the placement of dumpsters. • Ingress and egress should route traffic away from residential streets; Page 3 of 3 A driveway permit is required from the City of Kenai Public Works Department for the access from Haller Street indicated on the site plan. • Trees, shrubs, and plants should be appropriate for the climate and not invasive; At this time, any natural vegetation will be retained. When the parcels are further developed a Landscape/Site Plan must be submitted detailing the planting of trees, shrubs and plants. RECOMMENDATIONS Based on the application and a review of the criteria required to approve the landscaping/site plan, the application meets the intent of landscaping/site plan requirements and performance criteria. The plan is approved as submitted with the following conditions of approval: 1. Development of the property will conform to all federal, State of Alaska, and local regulations. 2.
