HomeMy WebLinkAboutRESOLUTION 1984-129 ~w.. . ~ .. ~ - _ --_ r ~~ - ~' Sugge3ted by: Council CITY OF KENAI RESOLUTION N0. 84-129 A RESOLUTION OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, ESTABLISHING A POLICY REGARDING PARTIAL ASSESSMENT FOR ROAD PAVING, WA1FR AND SEWER IMPROVEMENTS. WHEREAS, the Council desires to increase the number of projects that can be constructed using grant monies that are expected to be received from the State of Alaska, and WHEREAS, assessing benefitted property owners fifty percent of the costs of certain types of improvements that the Council desires to be constructed will allow the grant monies to be used for more projects. NOW, tHEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, that the following policy be established as direction to the City Administration and information to the citizens of Kenai: 1. Following petition from the benefitted property owners, pursuant to Title 16 of the Kenai City Code, the City will consider assessing the owners fifty percent of the costs of road paving improvements for those projects that are included in the City's adopted capital improvement lint for gravel or paving road improvement. Gravel road improvements on the capital improvement list may be accomplished totally with grant monies without assessment. 2. Following petition from the benefitted property owners, pursuant to Title 16 of the Kenai City Code, the City will consider assessing the owners fifty percent of the costs of water and/or sewer improvements for those projects that are included in the City's adopted capital improvement list for road or water or sewer improvement. 3. If proper petitions, as discussed in paragraphs 81 and ~2 above, are not received in a timely manner, the projects will be subject to deletion from the capital improvement list. 4. The City intends to use available grant monies for the non-assessed portion of the projects until such grant monies are depleted. The City intends to allocate its grant monies based upon the relative priority established in its capital improvement list, rather than on a first come-first served basis. 6. It remains the City's policy that, in all cases other ~ than those outlined above, the City assess 100A of project costs in approved assessment districts. 7. All assessments are subject to availability of financing of both the assessed and non-assessed portions of the projects. MEMO T0: Kenai City Council FROM: Charles A. Brown SUBJECT: Assessments/Resolution ~ 84-129 DATE: October 12, 1984 have drafted the above resolution to reflect the decisions that came ~om last Tuesday's worksession. I think it's important that Council ealize what this says. Assuming you adopt and follow this policy it sans that: 1) Only gravel road improvements (along with things like public buildings) will be done without assessment. 2) The people must pay SOX of an~- paving or water and sewer improvement, assuming it's on the list. If it's not on the list, they'll pay 100X. Also, if its on the list for water and sewer only, and they want any road work, they'll pay 100X of the read work. 3) If Council desires to perform work on the CID list (let's say pave a road, or lay a water line) and we don't get a proper petition from the property owners, you can't do it. This would be the case for both commercial and residential property. 4) If a project (let's say a waterline - how about to a car dealership) is not on your list, you can't do_it, unless we have a 100X assessment. ve discussed this with many City employees. My recommendation to ou is to fail this resolution. Don't set a formal policy.
