WHEREAS, a Mutual Aid Agreement has been negotiated with the City of Soldotna, the City of Kenai and the Nikiski Fire Service District for fire and ambulance services, and WHEREAS, the agreement meets the pressing needs of all parties. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Kenai, Alaska, that the Mutual Aid Agreement attached hereto and incorporated herein by reference is approved. That the senior [fireman on duty of the fire department of any of the participants in this agreement may solicit the efid of any or ell of the other members hereto in the form of men, equipment or materiels, in order to fight fire. aid in clean-up, mop up operations or to aid in the prevention of a fire where it has spread and to render such other assistance as may be necessary in an emergency situation. 2. That upon solicitation by any other member fire department. the department solicited will respond with the equipment. men or materiel requested. and provide such further equipment, mon or materials as may be necessary during the course of the emergency. Such reepomse and request for materials, equipment and men may include those owned by the municipality and is not limited to that in the control of the fire department. Ruch a request for fire department equipment, n-aterial and men may be denied in part or in total it the senior fireman on duty of the requested agency determines one of the following: (a) That there is en emergency then in,progresa which, by releasing such requested men, materials or equipmont, would endanger the health. welfare, safety or property of the inhabitants of their own protection area. (b) That it an emergency situation is anticipated which may require the requested men. materials or equipment. That the requesting agency shall, upon its request, give concise direction ea to the location of the emergency, the men, equipment and materials then needed, and make full end complete disclosure es to the then known cir- cumstances and nature of the fire emergency. 4. That upon arrival of the requested agency at the scene of the emere~ency all men, material and equipment shall be turned over to the commanA o~ the reauestinP agency and its officer then in char@e of said emergency. S. That upon response with the requested men, materials or equipment. should it become necessary to withdraw a portion or all in onder to meet an - - emergency situation in their own district. such withdrawl maq be at the sole dis- - eretion of the senior fireman of the requested ageneq. such withdrawl maq also be made at the sole discretion of the highest ranking officer of the requested ~ agency at the scene. it he should determine that the orders and demands of the _ officer then in charge of the requesting agency ere unreasonable or place said men, equipment or materiels in unnecesserq or ur..reasonable danger. 6. That each participant therein shall bear his own costa of the response. Beah responding agency shall bear their own liabi]itq while travelintc to the scene. at the scene end returning to their own quarters. No equipment shall be loaned for use bq personnel who have not been trained in their use. Any equipment loaned to the requesting agency which is in their care. cuatodq and control shall be returned in as good a condition as when it wea loaned. Anq equipment lost, damaged or used by the requested agency. such cost shall be borne bq the requested agency so long ea it was lost. damaged or used while under the control of the requested ~'°eiicyta officer in command. ?. That information as to the location. nature o~ the service required, and extent, circumstances and number of injuries known should be made et the time of the request for aid. 8. The agency requested to respond for such emergency medical service may refuse it it shall determine that the service requested is then needed within its own area or a situation is occurring which may require its service before the anticipated return of the men, materials or equipment. 9. In rendering emergency medical services, each party will bear responsi- bility for its own acts. 10. Should it be determined by the command officer of anv nr the respecti~~~ agencies that emergency medical service or mutual ai9 for fire protection cannot be rendered. said official shall immediately notify the requesting. apercv and attempt to supply whatever men. materials or equipment that can be released. 11. This agreement shall continue for three years from the date o~ its signing. Any party hereto may withdraw from this agreement upon thirty f30) days notice. in writing, given the remaining parties. This agreement entered into by and between the parties above mentioned on fire date and year hereinbefore set out. Witness their hands end seals.
