HomeMy WebLinkAboutRESOLUTION 1978-24TZ -~ ..,. ~ ~, CITY OF KENAI RESOLUTION N0. 78-24 A RESOLUTION OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, REQUESTING AN AMENDMENT TO TITLE 38 OF THE ALASKA STATUTES RELATIVE TO STATE LANDS LYING WITHIN A CITY. WHEREAS, State lands lying within a City are tax exempt, and WHEREAS, much of the State-owned land is not dedicated to an immediate public use or an approved future planned use, and WHEREAS, the retention of lands for no given use may well deny the affected City control of its destiny. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Kenai, Alaska, that Representative Hugh Malone, Speaker of the House, Representative Leo Rhode and Senator Clem Tillion, representing the Kenai Peninsula, are hereby requested to move legislation with the State Legislature to require disposition of State lands lying within a city on a proper request of that city's governing body. To wit, amend AS 38.65.030 by adding paragraph (f) as follows: Par_ a~ra~h ~. State of Alaska lands lying within a city and not dedicated to an mmediate public use or to an approved planned use shall be, on formal request of the city's governing body identifying specific land or lands, offered by the State for sale to the public at large at fair market value within 180 days following receipt of such request.
