A RESOLUTION OF THF. COUNCIL OF THE CITY f1F KENAI, ALASKA, SUS-
PENDING THE CITY t1F KENAI POI.IC.E RESRRVF PROGRAM
WHEREAS, the Police Reserve Program for the City of Kenai is considered
to be a viable asset to crime deterrence within the City of Kenai, therefore,
a program that this community does wish to continue, and
WHEREAS, there is a problem in procuring insurance coveraKe to protect
both the City and Police Reservists while they are nn duty. and
WHEREAS, there appears to be no resolution to this insurance problem in
the foreseeable future .
NOW. THEREFORE, BE IT RF,SOLVF.D RY THF, COUNCII. ~1F THF CITY l1F
KENAI, ALASKA, that the Police Reserve Program shall be suspended and
both the Governor of the State of Alaska and the Legislative delegation o4 the
Kenai Peninsula be petitioned to resolve the impasse over insurance problems
to provide reasonable reaugmentation of this valuable program .

Sir~oe July of this year no reserve officers were added
to the iaolice Reserve Program. Zfiis action was necessitated
by the unclear insurance picturrn as to their coverage and
status.
In Oct-Aber of this year the only then active Reserve
Officer was advised that he would be allowed to continue
training, but would no longer be allowed t70 aoca[Qany regular
officers in the perforn~ar:oe of their duties. This action was
taken as a result of the still unclear insurance picture, as
a means of protecting the Admizistratar, individual officer,
anti City of Kenai from a tenons liability situation.
The Finance Depar~nent has spent numerous hours and calls
in trying to resolve this problsn. However, this is nut a
problgn peculiar to the City of Kenai. The only other Agency
ar the pPnin~„la wi,~ a reserve program found it necessary to
suspeiul the active duty status of its reserved in December of
this year far insurance reasons. Ntatterous other agencies
both jn the State and others have faced the pmob]~a of
obtaining reasonable insurance coverage, at reasonable rates,
duri-~+? t;he past year Mani, have been foro~d to also suspend
c+pPxation of their programs.
The finar~c+e director has advised this office that he sees
no resolution to the in~„ra~ problem in the fareseeable
future. Rased an Leis, it is now our intent bt, terminate any
individuals affiliated with the Reserve Program, as a means of
providing maxiiman liability protection to all concerned.
It is our recam~endatio~n that the City of Kenai officially
terminate the IGenai Police Deserve Program until such time as
a fawrable insurance program, }cased both on coverage and
financial considerations can be developed.
