HomeMy WebLinkAboutRESOLUTION 1976-39_v _ __ _-, __ __ _ _____ __ _ ___ __ ~ _._ - tt -iL-... ~/ i' _` ~1 ~ CITY OF KENAI RESOLUTIONV *.'O. 7G-3$ A RESOLUTION OF THE COUNCIL OF THE CITY OF KENAI PLACING THE QUESTION OF THE DUTIES OF THE POSITIONS OF FINANCE DIRECTOR AND CITY CLERK ON THE BALLOT FOR THE OCTOBER, 1976, GENERAL ELECTION. WHEREAS, the Council of the City of Kenai has by ordinance separated the position of City Clerk from the Finance Department and provided that the City Clerk be appointed by the Council; and WHEREAS, the Council has determiined that such arrangement contributes to the efficiency and smooth operation of the City; and WHEREAS, in order to make such arrangement effective, a change in the Charter of the City of Kenai is necessary , and WHEREAS, sn amendment to the Charter may only be made by approval of a majority of the qualified City voters who vote on the question, NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Kenai, Alaska, as follows: Section 1: That Section 2-5, 3-4, 3-5, and d-3 of the Charter of the City of Kenai be amended to read in their entirety as follows: CITY CLERK Section 2-5: There shall be a City Clerk, who shall be an officer of the City appointed by the Council for an indefinite term . The City Clerk shall serve as clerical officer of the Council. He shall keep the journal of the proceeding of the Council, and shall enroll in a book or books kept for the purpose all ordinances and resolutions passed by it. He shall be custodian of such documents, records and archives as may be provided by law or ordinance; shall be custodian of the seal of the City, and shall attest, and affix the seal to, documents when requfred in acxordance with this charter, law or ordinance; shall keep a correct and up-to- date record of the City boundaries and chances therein; and shall have such powers and duties relating to elections as this charter or the Council may prescribe. DEPARTMENT OF FINANCE: FINANCE DIRECTOR Section 3-4: There shall be a Finance Director who shall be an officer of the City appointed by the City Administrator for an indefinite term, and who shall be head of the Department of Finance. Except as Council by ordinance provides otherwise the Finance Director shall collect or receive revenue and other money for the City. shall deposit the same with the City Treasurer or for the City Treasurer in an account or accounts maintained by the City Treasurer in a depository or depositories, - ~ L - - - - - - ----- RESOLUTION NO. 76-39 -Page Two and shall maintain a general accounting system for the City government. He shall have such other powers, duties and functions as may be prescribed by the charter, by applicable law, or by ordinance. CITY TREASURER: OFFICE CREATED, DUTIES Section 3-5: Within the Department of Finance, there shall be a City Treasurer; provided that the Finance Director shall be ex-officio City Treasurer except when the Council by Ordinance provides that the city Administrator shall appoint a City Treasurer for an indefinite term. Subjectto such regulations as the Council may prescribe, the City Treasurer shall deposit funds received for the City in such depositories as the Council may designate . He shall have such other powers, duties and functions as may be prescribed by the charter, by applicable law, or by ordinance . OFFICIAL BONDS Section 4-3: The City Administrator, the Finance Director, the City Treasurer, and such other officers and employees as the Council may designate. before entering upon their duties, shall be bonded by individual and/or group bonds, for the faithful performance of their respective duties, payable to the City, in such form and in such amounts as the Council may prescribe, with a surety company authorized to operate within the state. The City shall pay the premiums on such bonds. Section 2: That the question of the charter amendments set out in Section 1 hereof be submitted to the qualified voters of the City at the October, 19?6, General Election and be phrased substantially as follows: PROPOSITION ASSUMPTION OF CITY CLERK DUTIES BY FINANCE DIRECTOR Shall the Finance Director of the City of Kenai assume those duties relating to Finance which are prescribed by the Charter to be performed by the City Clerk and more specifically sha118eetion 2-S, 3-4, 3-5. and 4-3 of the Charter of the City of Kenai be amended to read as follows in order to effectuate the assumption of those duties?: CITY CLERK $ecti`on 2-5: There shall be a City Clerk, who shall be an officer of the City appointed by the Council for an indefinite term.
