HomeMy WebLinkAboutRESOLUTION 1975-51:.. a. ~m~.. ~- ~.. ._ ~ i_~__ »~_ .._ .. _~ J..__ _ ____...~ r ..._ .___ - CITY OF KENAI RESOLUTION NO. 75-51 A RESOLUTION OF THE COUNCIL OF THE CITY OF KENAI SUSPENDING ENFORCEMENT OF RESOLUTION 70-23 OF THE PERSONNEL MANUAL WHICH REQUIRES PER ANNUM CITY EMPLOYEES TO RESIDE WITHIN THE CITY . WHEREAS, it has been the policy of the Council of the City of Kenai to require employees of the City to reside within the City of Renal, as evidenced by Resolution No. 70-23, and WHEREAS, certain employees of the City of Kenai intend to file suit against the City challenging the constitutionality of the residence requirements, and WHEREAS, the Council of the City of Kenai does not wish to interfere with the constitu- tional rights of City employees, should any such rights attach in this situation . NOW, THEREFORE BE IT RESOLVED by the Council of the City of Kenai that: 1. The City of Kenai hereby voluntarily suspends enforcement of Resolution No. 70-23 of the Personnel Manual which requires per annum employees to reside within the City. 2 . New personnel will continue to be hired under the policy , but no employee will be terminated for failure to comply with such requirement while the suspension herein provided for is in effect. 3. The suspension provided for herein shall remain in effect until such time as the employees' suit has beers settled or determined by a Court of competent jurisdiction unless it is sooner terminated bq resolution of the Council.
