FINDING FOR THE NECESSITY AND PROVIDING FOR THE FORMATtON OF Water
IMPROVEMENT DISTRICT NO. 73-WS WITHIN THE CITY OF KENAI, PROVIDING A
METHOD OF EQUITABLE DlSTRIBUTION AND APPORTIONING OF COST THEREOF, AND
AUTHORIZING THE CITY TO PROCEEO WITH SAID IMPROVEMENT.
WHEREAS, the City Council directed the City Manager to make a survey
and report to the Council concerning the need for and estimated costs of the proposed
Water improvement project designated No. 73-W5 , and;
WHEREAS, the City Manager made such survey and report which is before
the council and submitted in connection with the other documents in support of the
project, all pursuant to Sec. 16-15 (b) of O~dinance 218-73, and;
WHEREAS, approprRate notice has been given ta the citizens and property
owners by publication and by mail, all as required by law, outlining the boundaries of
the proposed_ Water Improvement District No. 73-WS , and that the preliminary
assessment roll and maps were made available far review, discussion, protest and objections,
and;
' WHEREAS, said Water system improvements have been constructed
according to plans approved by the City Council, and;
WHEREAS, it has been determined by City Council that a portion of the
total cosi of this project should be borne by the property owners benefited by this
installation, and;
WHEREAS, the public hearing has been held and written objection by
property owners within the proposed district boundary are less than fifty (50$) of the
Wtat benefited prope~ty owners, and;
WHEREAS, it is now time to make a finding as to the necessity for said
improvement and to authorize the city to proceed with the project.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF KENAI , ALASKA:
SECTION 1. NECESSITY OF Water IMPROVEMENT DISTRICT NO. 73-WS
That the above described improvement is necessary for the public health, welfare, safety,
necessity and convenience and wi II benefit the properties to be assessed . The plan for
said improvement is approved. That the findings of the Council herein are conclusive.
SECTION 2. ESTABLISHING Water IMPROVEMENT DISTRICT NO. 73-W5
That Water Improversent District No. 73-WS is estabiished and that the
boundary is as described by the description attached hereto as "Exhibit A" and specifically
incorporated herein by reference, except for revisions as indicated in Section 4.

SECTION 3. PROJECT TO PROCEEG
That the City should proceed with the proposed imp: ovement as by ordinance and law
pr•ovided .
SECTION 4. REVISIONS TO Water IMPROVEMENT DISTRICT NO. 73-W5
That the following revisions to
Water
Improvement District No. 73-WS are made:

SECTION 5. COST ACCOUNTING FOR Water IMPROVEMENT DISTRICT N0. 73-WS
That total costs will be kept by the City Administration for engineering, rlghts-of-way,
construction, administration and financing resulting from development of Water
Improvement District No. 73-W5 . That the percentage of development cost to be
assessed against the properties located within the boundary of water Improvement
District No. 73-WS is to he ;.0675 per sq. k. . That all preliminary actions of the City
Administration, engineers under contract to the City or initiating petitioners with respect
to the above described improvement district are hereby ratified and approved.
SECTION 6. PREPARATION OF FINAL ASSESSMENT ROLL
That a final assessment roll will be prepared by the City Manager for Watsr Improvement
District No. 73-WS . That prior to confirmation of the final assessment roll the property
owners will be given the prescribed notice of hearing thereon and time to review the final
assessment roll . That a further hearing shall be held on the final assessment roll in
accordance with Kenai Code Ordinance 218-73, Sections 16-15, Sub-paragraph "g" as
to all provisions thereof.

The purpose of the public hearing is to determine the necessity for the ir~~provements, to
provlde the concerned property owners and citizens ~vith an opportunity to review the
preliminary assessment roll ancf maps for the proposecl improvement district, to discuss
the procedures used in ths determination of the apportioned ~ssessments an~ to receive
protest and objections.
