' . 7 _.~ __ ~'0 ~ CITY OF KENAI RESOLUTION NO. 73-20 .~ - ~ Finding for the necessity and providing for the formation of Water Improvement District No. 8 within the City of Kenai, and providing a method of equitable distribution and apportioning of cost thereof. WHEREAS, it has been determined by the City Council that a new water line and well are required for the public health, welfare, safety, necessity and convenience, and; WHEREAS, said water line and well have been constructed according to approved plans and completecl and accepted by the City Council, and; WHEREAS, it has been determined by City Council that a portion of the total cost of this project sfiould be borne by the property owners benefited by this instailation, and; WHEREAS, appropriate notice has been given to the citizens and property owners by publication and by mait, outlining the boundaries of the proposed Water Improvement District No. 8, and that the preliminary assessment roll and maps were made available for review, discussion, protest and objections, and; WHEREAS, written objections by property owners within the proposed boundary are less than fifty (50$) of the total benefited pro~erty owners, and; WHEREAS, it is now time to make a finding as to the necessity for said improvement, NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA: SECTION 1. ESTABLISHING WATER IMPROVEMENT DISTRICT NO. 8 That Water Impravement District No. 8 is established, and that the boundary is as described by the description attached hereto as "Exhibit A" and specifically incorporated herein by reference, except for revisions as indicated in Sec. 2. That the above described improvement is necessary and will benefit the properties to be assessed. SECYION 2. REVISIONS TO WATER IMPROVEMENT DISTRICT NO. 8 That the following revisions to Water Improvement Oistrict No. 8 are made. SECTION 3. COST ACCOUNTING FOR WATER IMPROVEMENT DISTRICT NO. 8 That total costs have been kept by the City Administration for engineering, rights-of- way, construction, administration and financing resulting from development of Water ~~ ~ ~ ., ; ~_ ~ i f ' v._. .. - -- - -- - - - --- . _. _ .. . /~ '~ . . . , . Improvement District No. 8 and that the totat accumulated cost against Water Improvement District No. 8 is a . That this amount represents fairly the cost of water supply and transmission together with the equivaient cost of installing a six-inch main to service all lots fronting on the improvement. That the percentage o.f development cost to be assessed against the properties located within the boundary of Water Improvement District No. 8 is to be $. That all preliminary actions of the City Administration;. engineers under contract to the City or initiating petitioners with respect to the above described imporvement district are hereby ratified. SECTION 4. ASSESSMENTS That two zones shall be established within Water Improvement District No. 8 to distribute the costs of the improvement. Zone 1 shall include all individual subdivided lots fronting on the improvement and all unsubdivided lots to a depth of one-half the distance from the centerline of the street to the back line of the governme~t lot or equivalent aliquot part. That costs to be distributed to the area of Zone 1 shall consist of the equivalent cost of installation of a six-inch diameter water main to service all lots within Zone 1. That the cost of said installation is determined to be ~8-A6-per square foot in Zone 1. That Zone 2 shall include all area within Water Improvement District No. 8 including the area of Zone 1 and excluding only platted, subdivided and proposed street rights- of-way. That the areas within Zone 2 are additionally benefited by fire protection capability. That the cost to be distributed to the area in Zone 2 shall consist of the water distribution supply and transmission line cost within the improvement district proportionate to the toWl cost of the water distribution, supply and transmission line. That the proportionate cast of said installation is determined to be #9-92 per square foot in Zone 2. SECTION 5. PREPARATION OF ASSESSMENT ROLL That an assessment roll will be prepared by the City Manager for Water Improvement District No. 8. That prior to confirmation of the assessment roll the property owner will be given the prescribed time to review 2he assessment roll . That a further hearing si~all be held on the assessment roll in accordance with Kenai Code Sections 16-3, Sub- paragraph f.
