HomeMy WebLinkAboutRESOLUTION 1973-22_ - _._- _ _ - ^ _` -- -- ----._ . .. ..:- - - ~-. . -- -~ , _~_._ . - --.. . .~-• ~ CITY OF KENAI RESOLUTION NO. 73-22 I i 1 ~._~ 'I L FINDING FOR TfiE NECESSITY AND PROVIDING FOR THE FORMATION OF WATER IMPROVEMENT DISTRICT NO. 73-W1 WITHIN THE CITY OF KENAI, PROVIDING A METHOD OF EQUITABLE DISTRIBUTION AND APPORTIONING OF COST TFIEREOF, ADTD AUTSORIZING THE CITY TO PROCEED WITH SAID IMPROV'EMENT. WHEREAS, the City Council directed the City Manager to make a survey and report to the Council concerning t~hP need for and estimated costs of the proposed water improvement project designated No. 73-w1, and WHEREAS, the City Manager made such survey and report which is before the council and submitted in connection with the other documents in support of the project all, pursuant to Sec. 16-15 (b) of Ordinance 218-73, and WHEREAS, appropriate notice has been qiven to the citizens and property ownere by publication and by mail, all as required by law, outlining the boundaries of the proposed Water Improvement District No. 73-W1, and that the preliminary assessment roll and raaps were made available for review, discussion, protest and objections, and; WHEREAS, said water system improvements will be con- structed according to plans approved by the City Council, and; SnTHEREAS, it has been determined by City Council that a portion of the total cost ~f this project sY~ould be borne by the property owners benefited by this installation, and; WHEREAS, the public hearing has been held and written objection by property owners within the proposed district bounafiary are lese than fifty (50%) of the total benefited property owners, and; ~ ~ ~_._,~ - ~:~ .~.. . _. ~ ~ . v ~ •. WHEREAS, i*., is now ti.me to make a finding as to the necesaity for said fmprovement and to authorize that the ci~cy proceed with the project. N041, THEREFORE, BE IT RESOLVED BY THE COUNCIL ~' TAE CITY OF KENAI, ALASKA: SECTION 1. NECESSITY OF WATER IMPROVFI-4ENT DISTRICT N0. 73-W1 Z'hat the abave described improvement is necessary for the public health, welfare, safety, necessity and convenience and will benefit the properties to be assessed; The plan for said improve- ment is approved. T'hat the findings of the Couricil herein are conclusive. SECTION 2. ESTABLISHING WATER IMPROVEMENT DISTRICT NO. 73-W1 That Water Improvement District No. 73-W1 is established and that the boundary is as described by the description attached hereto as "Exhibit A" and specifically incorporated herein by reference, except for revisions as indicated in Section 4. SECTION 3. P'ROJECT~ PROCEED That the City should prviceed with the proposed improve~nent as by ordinance and law provided. SECTION 4. REVISIONS TO WATER IMPROVEMENT DISTRICT NO. 73-W1 That the following revisions to Water Improvement Distr~et No. 73-W1 are made: l. (NONE) SFCTION 5. COST ACCOUNTING FOR WATER IMPROVEMENT DISTRICT N0. 73-W1 T'hat total costs will be kept by the City Administration for engineerinq, rights-of-way, construction, administration anc] fin~ncing resulting from development of Water Improvement District ~ No. 73-W1. T'hat the percentage of development cost to be assessed ' against the properties located within the boundary of Water ' Improvement District No. 73-w1 is to be ~~%. SECTION 6. PREPARATION OF ASSESSMENT ROLL That an assessment roll will be prepared by the City Manager for Water Improvement District No. 73-w1. That prior to confirmation of the assessment roll the property owner will be given the prescribed notice of hearing thereon and ti.me to review the assessment roll. Z'hat a further hearing shall be held on thE asseasn~ent roll in accordance with Kenai Code Ordinance 218.73, Sectiora 16-15, Sub-paragraph"g" as to all provisiona thereof.
