WHEREAS, the City Council directed the City Manager to make a survey and report to the Council concerning the need for and estimated costs of the proposed sewer improvement project designated No. 73-51, and; WHEREAS, the City Manager made such survey and report which is before the Councii and submitted in connection with the other documents in support of the project, all pursuant to Sec. 1b-15 (b) of Ordinance 218-73, and WHEREAS, appropriate notice has been given to the citizens and property owners by publlcatfon and by mail, atl as required by law, outlining the Faoundaries of the proposed Sewer Improvement District No. 73-51, and that th~e preliminary assessment roll and maps were made available for revlew, discussion, protest and objections, and; WHEREAS, said sewer system improvements will be constructed according to plans approved by the City Council, and; WHEREAS, It h~s been determined by City Council that a portion of the toWl cost of this project should be borne by the property owners benefited by thic i~stallation, and; WHEREAS, the public hearing has been held and written objection by property ° owners within the proposed district boundary are less than fifty (50$) of the total benefited property owners, and; WHEREAS, it is now time to make a finding as to the necessity for said improvement and to authorize that the city proceed with the project. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA: SECTION 1. NECESSITY OF SEWER IMPROVEMENT DISTRICT N0. 73-51 That the above described improvement is necessary for the public health, welf:.r•e, safety, necessity and convenience and will benefit the properties to be assessed. The plan for said improvement is approved. The the findings of the Cuuncil herein are conclusive. SECTION 2. ESTABLISHING SEWER IMPROVEMENT DISTRICT NO. 73-S1 That Sewe~ Improvement District No. 73-S1 is established and ihat the boundary is as described by the description attached hereto as "Exhibit A" and specifical ly incorporated herein by reference, except for revisions as indicated in Section 4. ~_ _ ~ 1 L - - - - - - - - -- - - -- - ---- ~- ~ . ~tr~:_c ' ~~SECTION 3. REVISIONS TO SEWER IMPROVEMENT DISTRICT NO. 73-S1 That the following revisions to Sewer Improvement District No. 73-Si are made: 1. SECTION 5. COST ACCOUNTING FOR SEWER IMPROVEMENT DISTRICT NO. 73-S1 That total costs will be kept by the City Administration for engineering, rights-of°way, construction, administration and financing resulting from development of Sewer Improvement Oistrict No. 73-51. That the percentage of development cost to be assessed against the properties locatec! within the boundary of Sewer Improvemer~t District No. 73-51 is to be $. That all preliminary actions of the City Administration, engineers under contract to the City or initiatir~g petitioners wi~h respect to the above described improvernent district are hereby ratified and approved. SECTION 6. PREPARATION OF FINAL ASSESSMENT ROLL That a final assessment roll will be prepared by the City Manager for Sewer Improvement District No. 73-S1. That prior to confirmation of the flnal assessment roll the property ~ owner will be given the prescribed notice of hearing thereon and time to review the final ~ • assessment roll. That a further hearing shall be held on the final assessment roll in accordance with Kenai Code Ordinance 218-73, Sections 16-15, Sub-paragraph "g" as to all , ~ provisions thereof. ..
