HomeMy WebLinkAboutRESOLUTION 1973-27.. _ . ___ __ ,*_ _ _ -~ _--_ _. ~_ _ _ _ _ _ _ _ _ _ _ ~ _ __ T ~ _ .~, ~ ~ CITY GF KENAI RESOLUTION NO. 73-27 FINDING FOR THE NECESSITY AND PROVIDING FOR THE FOft1~1ATION OF WATER IMPROVEMENT DISTRICT NO. 73-W2 WITHIN THE CITY OF KENAI, PROVIDING A METHOO OF EQUITABLE OISTRIBUTION AND APPORTIANING OF COST THEREOF, AND AUTHORIZING THE CI~'Y TO PROCEED WITH SAID IMPROVEMENT. WHEREAS, the City Council directed the City Manager to make a survey and report to the Council concerning the need for and estimated costs of the proposed water improvement project designated No. 73-W2, and; WHEREAS, The City Manager made such survey and report which is before the Council and submitted in connection with the other documents in support of the project, all pursuant to Sec. 16-15 (b) of Ordinance 218-73, and; WHEREAS, appropriate notice has been given to the citizens and property owners by publication and by mail, all as required by law, outlining the boundaries of the proposed Water Improvement District No. 73-W2, and that the preliminary assessment roll and maps were made available for review, discussion, prot~st and objections, and; WHEREAS, said water system improvements will be constructed according to plans approved by the City Council, and; WHEREAS, it has been determined by City Council that a portion of the total cost of this project should be borne by the property owners beneflted by this installation, and; WHEREAS, the public hearing has been held and written objection by property owners within the proposed district boundary are less than fifty (50$) of the total benefited property owners, and; WHEREAS, it is now time to make a finding as to the necessity for said improvement and to autho~ ize that the city proceed with the project. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA: SECTION 1. NECES5ITY OF WATER IMPROVEMENT DISTRICT N0. 73-W2 That the above described improvement is necessary for the public health, welfare, safety, necessity and convenience and will benefit the properties to be assessed. The plan for said improvement is approved. That the findings of the Council herein are conclusive. SECTION 2. ESTABLISHING WATER IMPROVEMENT DISTRICT NO. 73-W2 That Water Improvement District No. 73-W2 is established and that the boundary is as described by the description attachcd hereto as "Exhibit A" and specifically incorporated herein by reference, except for revisions as indicated in Section 4. REVISIONS TO WATER IMPROVEMENT DISTRICT NO. 73-W2 That the following revisions to Water Improvement District No. 73-W2 are made: 1. SECTION 5. COST ACCOUNTING FOR WATER IMP~tOVEMENT DISTRICT NO. 73-W2 That total costs will be kept by the City Administration for engineering, rights-of-way, construction, administration and financing resulting from development of Water Improvement District No. 73-W2. That the percentage of development cost to be assessed against the prop- erties located within the boundary of Water Improvement District No. 73-W2 is to be ~u0 $. That all preliminary actions of the City Administration, engineers under contract to the City or initiating petitioners with respect to the above described improvement district are hereby ratified and approved. SECTION 6. PREPARATION OF FINAL ASSESSMENT ROLL That a final assessment roli will be prepared by the City Manager for Water Improvement District N~. 73-W2. That prior to conflrmation of the final assessment roll the property owner will be given the prescribed notice of hearing thereon and time to review the final assessment roll . That a further hearing shall be held on the final assessment roll in , accordance with Kenai Code Ordinance 218-73, Sections 16-15, Sub-paragraph "g" as to all provisions thereof. Farmatfon of this district would enable construction of a water supply tacility. The work would consist of trenching, placin~ water pipe, and yrading of the aftected work area. The eompleted project would provide service and fire protection capability to the property localed xithin the proposed district bounJary. It runs northeasterly along Kaknu lane to 19th Avenue N.E. then northerly along 19th Avenue N.E. to "0" Street N.E. thence easterly along "D" Street N.E. to Stock Subdivision, also northerly along 27th Ave. N.E. and east and west from 27th Ave. N.E. along Eek Street N.E.
