CITY OF KENA1 RESOLUTION NO. 73-29
FINDING FOR THE NECESSITY AND PROVIDING FOR THE FORMATION OF SEWER IMPROVEMENT
DISTRICT NO. 73-52 WITHIN THE CITY O~ KENAI, PROVIDING A ME~HOD OF EQUITABLE
DISTRIBUTION AND APPORTiONING OF COST THEREOF, AND AUTHORIZING THE CITY TO
PROCEED WITH SAID IMPROVEMENT.
WHEREAS, the City Council directed the City Manager to make a survey and
report to the Council concerning the need for and estimated costs of the proposed sewer
improvement project designated No. 73-52, and;
WHEREAS, the City Manager made such survey and report which is before
the Council and submitted in connection with the other documents in support of the project,
all pursuant to Sec. 16-15 (b) of Ordinance 2t8-73, and;
WHEREAwS, appropriate notice has been given to the citizens and property
owners by publication and by mail, ail as required by law, outlining the boundaries of the
proposed Sewer Improvement District No. 73-52, and that the preliminary assessment roll ar,d
maps were made available for review, discussion, protest and objections, and;
WHEREAS, said sewer system improvements have been constructed according
to pians approved by the City Counci I, and;
WHEREAS, it has been determined by City Council that a portion of the total
cost of this project should be bo~ne by the property owners benefited by this installatlon, and;
WHEREAS, the public hearing has been held and written objection by property
owne~s within the proposed district boundary are less than fifty percent (50$) of the total
benefited property owners, and;
WHEREAS, it is now time to make a finding as to the necessity for said
improvemeni and to authorize that the City proceed with the project.
KENAI, ALASKA:
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
SECTION 1 NECESSITY OF SEWER IMPROVEMENT DISTRICT NO. 73-S2
That the above described improvement is necessary for the public health, wetfare, safety,
necessity and convenience and will benefit the properties to be assessed. The plan for said
improvement is approved. That the findings of the Council herein are conclusive.
SECTION 2 ESTABLiSHING SEWER IMPROVEMENT DtSTRIC7 NO. 73-52
That Sewer Improvement District No. 73-S2 is established and that the boundary is as described
by the descriptior. attached hereto as "Exhibit A" and specifically incorporated herein by
reference, except for revisions as indicated in Section 4.

That the fullowing revisions to Sewer Improvement District No. 73-52 are mads:

SECTION 5 COST ACCOUNTING FOR SEWER IMPROVEMENT DISTRICT NO. 73-52
That total wsts will be kept by the City Administration for engineering, rights-of-way,
construction, administration and financing resutting from developmen± of Sswer Improvement
District No. 73-52. That the percen2age of development cost to be assessed against the
properties located within the boundary of Sewer Improvement District No. 73-S2 is to be , ~~D ~.
That all preliminary actions of the City Administration, enginee~s under contract to the City
or initiating petitioners with respect to the above described improvement district are hereby
~atified and approved.
SECTION 6 PREPARATION OF FINAL ASSESSMENT ROLL
That a flnal assessment roll will be prepared by the City Manager for Sewer Improvement
District No. 73-S2. That prior to confirmation of the final assessment roll the property
owner will be given the prescribed notice of i-~earing thereon and time to review the final
asssssment ~oll. That a further hearing shall be held on the final assessment roll in
acco~dance with Kenai Code Ordinance 218-73, Sections 16-15, Sub-paragraph "g" as to all
provisions thereof.

The City of Kenai is holding a put~lic hearing on the sewer imprnvements in proposed
Sewer Improvert~ent District ~o. 73-52.
The improvements made in the proposed district corsisted of trenching, placinq sewer
pipe, and grading of the affected work area. The c,ompleted project provided a sewage
tacility (or transporting raw sev.age to the City Treatment Plant.
